MINUTES of a regular meeting of the Board of Trustees held Monday, December 212 1970
at 7:30 P.M. in the Village Hall.
PRESENT: Mayor F. G. Marcham; Trustees Ronald E. Anderson, Harold R. Fisher,
Verne A. Fogg, Carl H. Nelson, Virginia Powers; Treasurer Gordon B. Wheeler;
Engineer John B. Rogers; Attorney Roger B. Sovocool; Fire Chief Ned G. Boice.
ABSENT: Trustee Rane F. Randolph and Police Chief Jack W. McGraw, Sr.
OTHERS PRESENT: Judith Horstman representing The Ithaca Journal and Mr. Tallman of
Architects Tallman and Thomas.
Mayor Marcham asked the Clerk to read the bids received for the additions to the
Fire Station. They were as follows:

Mayor Marcham then asked Mr. Tallman to give the Board his views and recommendations.
Mr. Tallman, after much discussion, recommended the Village accept the bid of
McCarthy builders who was the lowest bidder. In the event McCarthy Builders are
unable to get a Performance Bond then award the next lowest bidder the contract.
Mr. Tallman answered questions put to him by members of the Board. His answers
were that as Architects for the Village on this job they would maintain on site
inspections as the work progresses at least twice a week, that they would be
continuously present during the three or four critical periods in construction to
• oversee the performance of the work and would verify the bills as they are presented
in a scheduled manner which is determined before work begins. Both low bidders
gave a starting date of April 1 and completion date of October 1, 1971.
The Board asked that the Architect closely follow the progress and to report to
the Board periodically on the performance of the contractor.

At a regular meeting of the Board of Trustees of the Village of Cayuga Heights,

Tompkins County, New York, held at 836 Hanshaw Road, Ithaca, New York in said
Village, on the 21st day of December, 1970, at 7:30 o'clock P.M., Eastern Standard
Time.
The meeting was called to order by Frederick G. Marcham and upon roll being called,
the following were

The following resolution was offered by Trustee Verne A. Fogg, who moved its
adoption, seconded by Trustee Ronald E. Anderson, to wit:
BOND RESOLUTION DATED DECEMBER 210 1970.
A RESOLUTION AUTHORIZING THE CONSTRUCTION OF AN ADDITION TO THE VILLAGE
FIRE STATION OF THE VILLAGE OF CAYUGA HEIGHTS, TOMPKINS COUNTY, NEW YORK,
AT A MAXIMUM ESTIMATED COST OF $71,0003 AND AUTHORIZING THE ISSUANCE OF
$67,000 SERIAL BONDS OF SAID VILLAGE TO PAY PART OF THE COST THEREOF.
BE IT RESOLVED, by the Board of Trustees of the Village of Cayuga Heights, Tompkins
County, New York, as follows:
• Section 1. The construction of an addition to the Village fire station of the
Village of Cayuga Heights, Tompkins County, New York, located on Pleasant Grove Road
adjacent to the Corners Community Center in said Village, including grading or site
improvement and original furnishings, equipment, machinery or apparatus required for
the purposes for which such addition is to be used, is hereby authorized at a
maximum estimated cost of $71,000.
Section 2. The plan for the financing of such maximum estimated cost is as follows:
(a) By the issuance of $67,000 serial bonds of said Village, hereby authorized to
be issued therefor pursuant to the Local Finance Law; and
(b) By the expenditure of $4,000 hereby appropriated from the Capital Fund - Fire
Department Fund. It is hereby determined that said $4,000 shall constitute the
down payment required by Section 107.00 of the Local Finance Law.
Section 3. It is hereby determined that the period of probable usefulness of the
aforesaid specific object or purpose is fifteen years, pursuant to subdivision
12(a)(2) of paragraph (a) of Section 11.00 of the Local Finance Law. It is hereby
further determined that the maximum maturity of the serial bonds herein authorized
will exceed five years.
Zection 4. The faith and credit of said Village of Cayuga Heights, Tompkins County,
New York, are hereby irrevocably pledged for the payment of the principal of and
interest on such bonds as the same respectively become due and payable. An annual
appropriation shall be made in each year sufficient to pay the principal of and
interest on such bonds becoming due and payable in such year. There shall annually
be levied on all the taxable real property of said Village, a tax sufficient to pay
the principal of and interest on such bonds as the same become due and payable.

Section 5. Subject to the provisions of the Local Finance Law, the power to
authorize the issuance of and to sell bond anticipation notes in anticipation of
• the issuance and sale of the serial bonds herein authorized, including renewals of
such notes, is hereby delegated to the Village Treasurer, the chief fiscal officer.
Such notes shall be of such terms, form and contents, and shall be sold in such
manner, as may be prescribed by said Village Treasurer, consistent with the
provisions of the Local Finance Law.
Section 6. The validity of such bonds may be contested only if:
(1) Such bonds are authorized for an object or purpose for which said Village is
not authorized to expend money, or
(2) The provisions of law which should be complied with at the date of publication
of this resolution are not substantially complied with,
and an action, suit or proceeding contesting such validity is commenced within
twenty days after the date of such publication, or
(3) Such bonds are authorized in violation of the provisions of the Constitution.
Section 7. Upon this resolution taking effect, the same shall be published in
full in the Ithaca Journal, the official newspaper, together with a notice of the
Village Clerk in substantially the form provided in Section 81.00 of the Local
Finance Law.
Section 8. This resolution is adopted subject to permissive referendum in accordance
• with Section 36.00 of the Local Finance Law, and Article 7 of the Village Law.
The question of the adoption of the foregoing resolution was duly put to a vote on
roll call, which resulted as follows:

The resolution was thereupon declared duly adopted.
RESOLUTION # 1760 - PUBLISH BOND RESOLUTION
VOTED to authorize the Clerk to publish and post the Bond Resolution for the
financing of the Fire Station Addition.
Trustee Nelson thanked the Board for the flowers sent to him while he was
hospitalized recently. They were greatly appreciated.
• VOTED to approve the minutes of a regular meeting of the Board of Trustees held
November 16, 1970 as previously furnished Trustees in mimeographed form.
VOTED to approve the Abstract of Audited Vouchers dated December 21, 1970 in the
following amounts: General Fund - $9,707.82, Sewer Fund - $3,879.95 with the
addition of vouchers from T. G. Miller for work connected with the Sewer Plant

expansion program. The amount is $1,757 and is approved to be taken from the Sewer
•Plant Surplus Fund to be transfered later when the money is available from the
financing of the complete expansion program. It is also approved to withdraw
$22949.61 from the Street Improvement Capital Reserve Fund for the purpose of
paying for the large culvert pipe installed under Cayuga Heights Road.
Mayor Marcham gave his report and it is on file in the Village Office. He asked
the Board to express their views on the composition of the Board of Managers to
be created for the County Sewer Agency. The Board agreed that a majority of the
members of the Board of Managers for the County Sewer Agency should be representatives
of the municipalities to be served by the district.
On the question from the Tompkins County Board of Representatives regarding partici-
pation in a conservation advisory program, Mr. Fogg explained its purpose. The
Board did not appoint anyone to serve on a committee at this time. Mayor Marcham
is to relate the Board's views to the County Board.
The Fire Chief gave his report and it is on file in the Village Office. The Fire
Protection District of Lansing, namely all lands located in the Town of Lansing
lying south of Route 13, will not be protected by the Village Fire Department after
December 31, 1970. The Board of Fire Commissioners has notified the Clerk in
writing that they have decided not to renew the fire protection contract.
Trustee Nelson stressed the need to notify the people in that area that the Village
can no longer answer their calls, they must call a Lansing Fire Department. Cayuga
Heights Fire Department will, of course, answer Mutural Aid calls. Chief Boice
said he will notify the Fire Underwriters Rating Organization. Fire Chief also
•asked the Board for determination on issuing permits to burn. He said he recommends
he be able to issue burning permits only after the party has obtained a permit from
the County Board of Health. Mayor Marcham said he should stand firm on this
procedure.
Trustee Nelson related the problems connected with getting the fire hydrants flushed
and pressure tested. Flushing was discontinued two years ago and the last pressure
tests performed were in 1966. These tests were not complete, just a blanket test.
After discussion it was decided to have the Attorney go over the water contract
with the City of Ithaca and report back at the next meeting on what he found and
make recommendations.
The mimeographed report of the Police Chief was accepted in his absence and put
on file in the Village Office.
The Engineer gave his report and it is on file in the Village Office. After a
discussion of sick leaves the determination was that the supervisor should decide
time and salary on an individual basis. Mayor Marcham will meet with the Engineer
and Mr. Tyrrell on the matter of Paul Gardner's sick time and settle it as best
they can. The Engineer will report the results at the next meeting.
The Engineer has requested the installation of three valves, one each on the two
radiators in the Chief's Office and one on the heating unit in the main police
office, to allow the regulation of the heat from these radiators. As required by
the insurance company a 3/4 relief valve is to be installed on the boiler at the
.same time. If this doesn't correct the heat problem in the Village Hall we may
have to go to a separate zone in the Police Department.
Delbert Grover has received his High School Equivalency Certificate which is
another step in his receiving his Grade II Sewage Treatment Plant Operators License.

During the drawing up of next years budget the following two items should be
considered.
• 1. Diseased elm tree removal and whether we should continue to pick up private
elm wood for disposal.
2. Having available an extra man for emergency in order to keep current if an
emergency arises such as the Cayuga Heights Road culvert job.
The Attorney gave his report stating that the Judge has ruled to uphold the Village
position in the matter of the Condemnation Proceedings for the land adjacent to
the Sewage Treatment Plant owned by Leonard B. Liberman. He is preparing an Order
now and it should be signed by the Judge within a week then we will have possession.
After a period of 30 days in which time there could be an appeal, we can move
forward in our sewer plant expansion program.
we will next have to settle on the price for the land through a regular prescribed
procedure.
The Attorney has applied for a new permit to remove diseased elm wood from private
property through neglect of the owner.
The Attorney and Engineer will go over the Lucente matter and report back. Attorney
said he would suggest the policing of the outside sewer districts be done by the
zoning officer of the respective townships. Mayor Marcham agreed and said he
would write a letter of request to this effect.
•Treasurer Wheeler gave his six months report and it is on file in the Village
Office.

Trustee Fogg spoke of being approached concerning the Village providing a skating
rink.
The Engineer presented the request of Mr. Stephen W. Jacobs for acceptance of his
development in the Northwest corner of the Village between Cayuga Heights Road and
Route 13. He presented a plan for the area and indicated that Mr. Jacobs intended
to place all utilities underground and wished the Village to approve this and bear
all or part of the expense, as it related to electric lighting. The Board advised
the Engineer to inquire further what the cost to the Village would be for instal-
lation and maintenance. The Board also wished to learn whether Mr. Jacobs will
grant to the Board a right of way from south to north at the extreme northwest
corner of his lot for use by the Village in future installation of the so called
Railroad Trunk Sewers to serve the Town of Lansing.
