Village of Cayuga Heights
Board of Trustees
Present. DeputyMayor Antil, Trustees Staley, Mount, McNeil, Tavelli and
Collyer. Atty. Tyler, Fire Supt. Tamborelle, , Supt. Cross, Treasurer Silber,
Clerk Manning.
Absent: Mayor Lynn, Supv. Quick Police Chief Lansing
Others: Cayuga Heights Residents Pam Baxter, Mary Lynn Broe, and Richard
LUing.
At 7:00 pm, Deputy Mayor Antil called the meeting to order and asked for a
motion to pass the minutes of May 17. Certain corrections needed were noted.
Motion by Trustee McNeil
Seconded by Trustee Tavelli
Move to approve the minutes of May 17, 2004 with corrections on
page 7 [ "effective date of new garbage pickup will be June 14 "]
and page 10 [ "Supt. Cross stated that he is concerned about this
transfer because it will take away from road repairs this year"].
Deputy Mayor Antil, Trustees Staley, Mount, McNeil, Tavelli and
Collyer voted YES.
Privilege of the Floor -
Resident Mary Lynn Broe of 712 Hanshaw Road distributed a letter she
wrote to the Mayor and the Board regarding the damage that has been
done to her 20 year old arborvitae shrubbery because of, in her opinion,
the reckless salting of Village streets and roads. Upon walking the
Village, Ms. Broe has noticed other shrubbery in the same peril. Her
bushes had been fine for over 18 years and the problem has just become
apparent lately. Ms. Broe also distributed photos for the Board's review.
Deputy Mayor Antil thanked her for her input and said that the Board
will discuss the situation at a later date.

At this time, Mr. Cross asked the Board to act as the Planning Board to
hear a request by Richard Uhhg of 115 NorthwayRoad to subdivide his
propertyinto two lots. One of the lots would have the existing house
and the "new" lot would be a vacant parcel of land. Since this is
classified as a minor subdivision, no public hearing was required.

Move to pass Resolution 6085 to approve subdivision of Lot 10 -6 -5
into two separate lots
Whereas, the Owner of 115 Northway Road, Tax Parcel No. 10 -6 -5, has
requested to subdivide the lot into two lots, with the existing house on the
northerly lot and a the southerly lot to be a vacant building lot, and
Whereas, the Village Zoning Ordinance allows for such subdivision of
land, and classifies a two lot subdivision as a minor subdivision which
shall not require a public hearing, and
Whereas, the Village Zoning Officer has determined that both lots will be
in compliance with all Village Zoning Regulations, and
Whereas, the NYSCRR 617.5.b SEQRA Regulation classifies this type of
application as an action that does not require environmental review, and
Now Therefore, the Village of Cayuga Heights Planning Board hereby
approves the subdivision of 115 Northway Road, Tax Parcel No. 10 -6 -5,
Into two separate parcels with the existing house on one parcel and the
other parcel to be a separate building lot, and
Therefore, authorizes the Planning Board Chairman to sign the plat,
which is to be filed at the County Clerks Office by the property owner,

Announcements of the Deputy Mayor -
The successful bidder for the trickling filter upgrade project was
Henderson Brothers Contractors of Central Square, NY. Theyhave been
notified.
Don Hartill, Mayor of the Village of Lansing, sent a letter to the Mayor
authorizing the Village of Cayuga Heights to proceed with the Kline Road
Bypass. Attorney Tyler asked if our Insurance Company needed to know
about the Village of Cayuga Heights acting as an agent for the Village of
Lansing. It was decided that they did not, but the Insurance Company will
provide a Certificate of Insurance for us. Coz4c* 's
Report of the Police Chief - Police Chief Lansing was not in attendance. His
report is on file.
Report of the Fire Superintendent - Report Distributed and on File
Trustee Mount asked about the demonstration of the TIC (Thermal Imaging
Camera). Supt. Tamborelle suggested that we hold a demonstration at the July
board meeting.
Supt. Tamborelle announced that Mercy Flight will be landing a helicopter
behind the Fire Station on Thursday, June 24 for a fire /rescue training.
Report of the Working Supervisor - Report Distributed and on file
There was discussion on item B of the report where the DPW installs drainage
pipe for Village residents while the residents pay for the supplies. This has
become very popular with the residents, while being very time consuming for
our employees. We have been working on an unofficial policy, and now have
modified it so that residents who wish this type of work done must now get
everyone on the block to partake in the project The Village will engineer the
project to make sure that it is done correctly and further, it will probably not be

done in the same year as it is requested. The average price per home is
approximately $1 -$2 thousand; with the average time for 3 workers would be 1-
2 days. If the whole block doesn't participate, residents can get a private
contractor with Supt. Cross checking and approving the plans first. This policy
went into effect on June 1.
Report of the Supt. of Public Works — Report Distributed and on File
Supt. Cross reported that on March 9, 2003, the NYSDEC SPDES Permits for
Stormwater Management went into effect. The NYSDRC Permit is a result of
the USEPNs Phase II Stormwater Regulations that designate municipalities
within an urbanized area to be MS4's (municipal separate storm sewer system).
One of the requirements of the NYSDECPermk is that each MS4 municipality
shall file an annual self - certification report, which must be presented in a public
meeting. To complywith the filing requirements, Supt. Cross has produced a
report and submitted it to the NYSDEC prior to the June I' deadline. The
Executive Summary is attached to this report, with the entire report available at
the Clerk's office.

Move to present the Stormwater Management Plan Report and
files to the Clerk for availability to the Public.
Deputy Mayor Antil, Trustees Staley, Mount, McNeil, Tavelli and
Collyer voted YES.
Supt. Cross reported that the Village has opened the bids for the Kline Road
Bypass, which is a project that will connect the Village sewer system to the City
of Ithaca to allow diversion of Town of Ithaca waste water to the Ithaca Area
WWIP. TG Miller Engineers has reviewed the bids and has recommended
that we accept the low bid from Bat -Con Construction.

Move to pass Resolution 6086 to award the contract for the Kline
Road Bypass Project to Bat -Con, Inc.

Whereas, the Village has agreed to participate in the Intermunicipal
Sewer Group which requires the connection of the Village sewer
system to the City of Ithaca sewer system, and
Whereas, the Village of Lansing has hired TG Miller Engineers to
prepare plans and specifications for such project, and
Whereas, the Village has duly advertised and received bids for
construction of the sewer connection in conformance with the plans
& specifications, and
Whereas, TG Miller, PC has reviewed the bids and has determined
that Bat -Con, Inc. is the lowest responsible bidder, and
Whereas, the Bat -Con, Inc. bid of $96,246.00 is satisfactory to the
Village of Lansing which has committed to reimburse the Village of
Cayuga Heights, and now
Therefore, The Village of Cayuga Heights Board of Trustees hereby
accepts the bid of $96,246.00 by Bat -Con, Inc. for the Kline Road
Bypass Project, and
Therefore, the Trustees direct TG Miller to prepare the Notice of
Award and Contract with Bat -con, Inc. and authorizes the Mayor to
sign said documents.
Deputy Mayor Andl, Trustees Staley, Mount; McNeil, Tavelli and
Collyer voted YES.
Trustee Mount asked about Pleasant Grove Lane. The Village took the request
by the Pleasant Grove Lane Association to make the Lane a Village Street
under advisement at the last meeting. It was decided that the decision on
Pleasant Grove Lane is one related to'another decision that needs to be made
so it will not be decided quickly.

Report of the Treasurer — Abstract distributed and on file.
Treasurer Silber presented the abstract with the following corrections:
Deletion on page 3 — A03410.490, VR 00007298, Pannenter, Inc.
Addition on page 6 — A03410.460, Medtronics,
Defibrillator Maintenance, $1120.00.

Move to pass Resolution 6087 approving the Abstract of Vouchers
dated 6/20/04 in the amount of $204,814.88 and instruct that the
Treasurer make payments thereon.
Deputy Mayor Antil, Trustees Staley, Mount, McNeil, Tavelli and
Collyer voted YES.
Treasurer Silber reported that per General Municipal, Law., the police chief's
salary needs to be increased to be in step with the recently concluded PBA
contract. The Treasurer asked the Board to pass a Resolution to that effect.

Move to pass Resolution 6088 stating that subsequent to the
signing of the PBA contract, and in accordance with General
Municipal Law Section 207, Chief Lansing's salary is to be
increased to $1668 /week, exclusive of health supplement, effective
6/1/04.
Deputy Mayor Antil, Trustees Staley, Mount, McNeil, Tavelli and
Collyer voted YES.
Treasurer noted that the Village's insurance agent has been changed to Olver
and Associates. Neil Olver would like to make a presentation to the Board on
his services that are available to the Village. DeputyMayor Antil to relaythis to
Mayor Lynn.
Report of the Attorney—
Attorney Tyler reported on the Trickling Filter upgrade. The DEC decided to
require a consent order for both our's and their protection. Mayor Lynn,
Attorney Tyler and Steve Eidt of Stearns and Wheler have discussed this.
There will be more to discuss with the Board at the July meeting when the
Village is expected to have the document in hand.

Attorney Tyler reported on Parkway Place, a private street in the Village. The
residents would like the Village to upgrade the water and sewer infrastructure in
the street before the residents pave the road. The sewer system shows up on
Village maps as part of our sewer system. Attorney Tyler stated that whenever
the Board talks about Pleasant Grove Lane we are also referring to Parkway
