April 14, 2003
Village of Cayuga Heights
Zoning Board of Appeals
Present: Chairman Robin Cisne, Members Kenneth Robinson, Wayne Fleming, Joe
Petrillose, Marian Kira, and alternate Peter McClelland. Others: Yelena Kurlavova,
Salim Kasimov, Mary Beth Norton, Barbara and Mort Sosna, Joe Price, Howard Porter,
Dirk Galbreath, Jeremy Dunn, Albert Chang.
Chairman Cisne opened the meeting at 7:00 pm at the Cayuga Heights Fire Station.
Chairman Cisne gave an overview of how the meeting will run and the meeting
requirements. The first case up for review was a request to build a new single family
dwelling at 163 Remington Road. The heights of the proposed structure was to be up to
35’, which is greater than the 25’ allowed by Section 5: Height of Buildings, in the
Village of Cayuga Heights Zoning Ordinance. Mr. Joe Price, owner of the land where the
proposed house is being built, and Mr. Kasimov, proposed owner and builder of the
house, presented the request. There was discussion on the size and style of the proposed
house. The hilly nature of Cayuga Heights means compromise in house plans. Questions
were asked as to how far back off the road will the house be put? (40 -50 ft. back); how
many square feet is the house (2200 sq. ft.); how close to the lot line would the house be?
(within limits). The meeting was closed for deliberations at 7:25 pm. Joe Petrillose felt
that a 10’ difference in the required height vs. the proposed height was too much. Wayne
Fleming and Ken Robinson felt the same way. Marian Kira felt that the plan for the
house and the size of the lot didn’t mesh.
Motion by Ken Robinson
MOVE to deny petition for variance but with the option to come back with an architects
drawing with elevations and dimensions on how the proposed house sits on the lot.
Seconded by Wayne Fleming
APPROVED by Robin Cisne, Marian Kira, Wayne Fleming, Ken Robinson and
Joe Petrillose.

The next variance request was from 505 Wyckoff Road to allow parking for a multi-
family dwelling which was denied. Attorney Dirk Galbreath explained the application
request. Jeremy Dunn, current owner of the property, and Albert Chang, president of the
adjacent fratermity, were in attendance. The parking would be located within 13.9’ from
the front property line, which is less than the 30’ front yard as required by Section 6:
Yard Requirements, in the Village of Cayuga Heights Zoning Ordinance. The existing
building setback is 13.9’ from the front property line. Since this structure was

constructed prior to the current zoning ordinance, this is considered to be an acceptable
pre-existing, non-conforming condition. Since the owner was not able to provide
evidence that the parking has existed in the same front yard setback since prior to the
1952 ordinance, then the parking is considered to e a non -conforming zoning condition.
The current application has proposed to meet the current building setback of 13.9’. Mr.
Dunn has no plans to expand anything over what it is now; therefore, he is asking to
permit existing use.
The meeting closed at 7:55 for consideration of the petition.
Motion by Wayne Fleming
Move to approve request as permitted and maintain existing shrubbery with no further
excavation permitted.
APPROVED by Robin Cisne, Marian Kira, Wayne Fleming, Ken Robinson and
Joe Petrillose.
Meeting was adjourned at 8:10 pm.
