This letter is to confirm several telephone conversations that I have had with you and
other NYSEG employees over the last week.
Although I issued a "Street Opening Permit" for the underground piping work related to
the above referenced project, such permit did not include approval of the above grade
structure(s) that have been installed on the school's property. The main "building" that
houses the control equipment is subject the Village's Zoning Ordinance that specifies that
all structures must be setback 25' from the street ROW. The building, as constructed, is
less than 5' from the ROW on both the Hanshaw Road and Upland Road sides.
Since the building, as constructed, does not meet the minimum setback requirements you
will need to propose an alternative location. If relocation is not feasible, it may be possible
to allow the equipment to stay in the existing location if a minimal enclosure is installed
that would not be considered as a building. Additionally, any such enclosure would need
to be designed to allow clear sight distance for traffic stopping on E. Upland Road.
Since no permit was issued for this building, you will need to make an application for any
permanent structures, unless an alternative design can be proposed that would not be
subject to the zoning regulations. I would be available to me with you, and /or your staff, at
the site to make a determination of what could be acceptable. Please call me @ 257-
