Minutes 9/15/1997244 VILLAGE OF CAYUGA HEIGHTS .BOARD OF TRUSTEES Minutes of a Public Hearing, duly published and posted, held September 15, 1997 at 7:15 PM in the Village Hall to consider a resolution authorizing Village Bond Financing in the amount-of $100,000 to pay costs in connection with the recon- struction of N. Triphammer Road. PRESENT: Deputy Mayor Fleming; Trustees Collyer, Kira, Kusse, Meinhardt; Attorney Tyler; Treasurer Silber; Supt. of P.W. Cross; Police Chief Wall; Fire Supt. Day. ABSENT: Mayor Anderson, Trustee Bisogni. OTHERS PRESENT: Eight to ten Villagers, including David Singley and Dooley Kiefer and Carl Cohen. Deputy Mayor Fleming opened the Public Hearing stating the Village has approved the plan to reconstruct N. Triphammer Road and the.purpose of the Public Hearing is to approve the funding for the project. Treasurer Silber, correcting the wording of the-Public Hearing as published, explained that the Village is actually seeking `approval for the issuance of $100,000 in bonds (BAN issuance will come later) and the total cost estimate of the project is $270,000. He made reference to sections of the Finance Law. Mr. David Singley, a N. Triphammer Road resident, asked if this is "going to cost the Village money" (in the form of tax increase) and wondered if there were alternatives. Treasurer Silber responded that the project cost was dis- cussed at the last meeting — to recap::$57,000 will come from Village reserves, $100,000 from this year's budget,and.'$100,000 in bonds to be repaid over the next 10 years at $12,000 /year. Dooley Kiefer, reading from her prepared memo (copy on file), stated her strong op- position to the part of.the design which focuses on the northern entrance to the Village, where the widening and straightening of the road will result in not only a "loss of a sense of a Village entrance but will encourage motorists to accelerate." She objected also to the Village's undertaking of the bond issue. Deputy Mayor Fleming asked that others who wished to speak confine their comments to the bond issue and not to the design of the road. There were no further questions or comments from the audience and the Public Hearing was declared closed. Villagers withdrew from the meeting. Minutes of a regular meeting held September 15, 1997 immediately following the Public Hearing. PRESENT: As above. ABSENT: As above. 1 OTHERS: Two students — one from Ithaca High, the other from Ithaca College, Carl Cohen. Deputy Mayor Fleming called the meeting to order opening it to.comments from the floor. Mr. Carl Cohen, Assistant Director for Commuter &Parking Services at Cornell University, appeared to request that the "Welcome to Cornell University" sign situtated on Trip- hammer Road north of the Africans Center be allowed to remain at that.location although, according to the Code Enforcement Officer, it does not fit.-into any of the categories in the Sign Ordinance: He stated further there is nothing in their records (nor Village files) to indicate permission to the.UniversiEy to erect the sign — sometime prior to 1985. Therefore, Code Enforcement Officer Cross felt the need to refer the issue to the Board of'Trustees since a variance application was notapplicable. Trustees Collyer, Kira, Kusse, Meinhardt voted YES. ® Motion by Trustee Kira, seconded by Trustee Collyer: VOTED to approve the minutes of a regular meeting held August 18, 1997 as previously furnished Trustees in copy form with a correction that Dooley Kiefer is on the County Board of Reps. Trustees Collyer, Kira, Kusse, Meinhardt voted YES. The Mayor's report was presented in his absence by Deputy Mayor Fleming. It com- prised a list of upcoming meetings.' .Supt. of P.W. Cross submitted his report which has been placed on file. Discussion ensued regarding Supt. Cross' recommendation to purchase a chipper per specifications provided by Tracey Road Equipment (the used chipper has.been sent to -auction). Trustee Collyer questioned whether the recommended 12" diameter capacity represents an overkill in that it is beyond what he believes is required for Village purposes. Motion by Trustee Kusse, seconded by Trustee Kira: RESOLUTION 4855 - AUTHORIZE PURCHASE OF CHIPPER PER SPECIFICATIONS AS RECOMMENDED BY SUPPLIER VOTED to authorize Supt. Cross to purchase a Brush Bandit Model 200+XP disc style chipper from Tracey-Road Equipment at, a cost not to exceed $18,095.00. Trustees Kira, Kusse, Meinhardt voted YES. Trustee Collyer OPPOSED. In connection with the temporary "tent- like" structures which are becoming popular for boat storage and /or garage purposes, and which are not specifically referred to in the Zoning Ordinance, Supt. Cross is instructed to proceed on the basis that such structures are to be regarded as buildings and as such must comply with setback and coverage regulations as set forth in the Village's Zoning Ordinance. Attorney Tyler likened'them to a carport. Fire Supt. Day presented his monthly report.which has been placed on file. Supt. Day reported that the EMS Director and Chiefs have moved into the new office space at the Village Green, and he and Supt. Cross will meet with architects to review the space problem. Attorney Tyler reported on the following: Re Town of Ithaca tax bill for WWTP, he has sent a memo to Mayor Anderson asking that he write to Town Supervisor Catherine Valentino requesting'action before the 1998 tax bills are issued, since there has been no response to Supt. Cross' letter of 1/6/97. A letter from the Executive Director of the T.C. Senior Citizens' Council requesting that the funding previously approved by the Village Board for the•N.E. Senior Citizens' Unit and rescinded at the August meeting based on the law cited by the Attorney pro- hibiting same, be reviewed and reinstated. Attorney Tyler reported he has written to the office of the State Comptroller for an opinion. Attorney Tyler reported that a bond counsel opinion from a bond counsel firm is re- quired before there can be borrowing from T.C.T.C.; and having investigated, he believes this can be done for a reasonable 'fee. He.has obtained.'two verbal quotes for a $100,000 bond in the fee range of $1,000 from NYC and Rochester Bond Counsel Firms. Treasurer Silber submitted his monthly report which is on file. Treasurer Silber reported that a 7 -month lease has been executed with Village Green owner (on a month -to -month basis thereafter), and he likes the fact that the monthly $600 expenditure will "serve as pressure on Fire Dept. and others to look for a long -term solution to the space problem." `46 Mintues of regular meeting — 9/15/97 Discussion resumed regarding the funding issue for the N. Triphamm ment Project. Supt. Cross reported that the meeting he scheduled input from property owners who have frontage on N. Triphammer Road only 6 people and there were no objections to the installation of meeting. It was noted that locations of additional pavement along Road should NOT be designated as "bike lanes." Motion by Trustee Kira, seconded by Trustee Meinhardt: BOND RESOLUTION — 4856 •• September 15, 1997 3 er Road Improve — on 8/27/97 for -was attended by islands at that N. Triphammer A RESOLUTION AUTHORIZING THE ISSUANCE OF $100,000 IN SERIAL BONDS OF THE VILLAGE OF C6YUGA HEIGHTS, NEW YORK, TO PAY COSTS IN CONNECTION WITH THE RECONSTRUTION OF NORTH TRIPHAMMER ROAD. RESOLVED, by the Board of Trustees of the Village of Cayuga Heights, New York as follows: Section 1. There are hereby authorized to be issued $100,000 serial bonds of the Village of Cayuga Heights, New York to pay for the following village purpose, which is hereby authorized: To pay the costs associated with the reconstruction of North Triphammer Road at an estimated cost of $270,000. It is hereby determined that the plan for the financing of such class of objects or -purposes is by the issuance of not exceeding $100,000 serial bonds of said Village; that the period of probable usefulness thereof is ten years, pursuant to subdivision 20 of paragraph a of Section 11.00 of the Local Finance Law; that said bonds will mature over a period not to exceed ten years, and that a down payment is required thereof pursuant to Section 107.00 of the Local Finance Law. The aforesaid serial bonds to be sold at private sale and all further powers in connection with the details and sale thereof are hereby delegated to the Village Treasurer of said Village in accordance with the Local Finance Law. Section 2• The faith and credit of said Village of Cayuga Heights, New York, are hereby irrevocably pledged for the payment of the principal of and interest on said bonds as the same respectively become due and payable: An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. There shall annually be levied on all the taxable real property of such Village, a tax sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 3 . Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Village Treasurer, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Village Tieasurer, consistent with the provisions of the Local Finance Law. Section 4. The validity of such bonds may be contested only if: 1) Such obligations are authorized for an objector purpose for which said Village is not authorized to expend money, or 2) The provisions of law which should be, complied with at the date of publication of this resolution arc not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violations of the provisions of the Constitution. t L 1 Minutes of regular meeting - 9/15/97 4.`47 Section 5. This resolution, which takes effect immediately, shall published in full in the Ithaca Journal, the official newspaper of such Village, together with a notice of the Village Clerk in substantially the form provided in section 81.00 of the Local Finance Law. ® Section 6. This resolution is subject to percussive referendum as required by subsection 36.00 of the Local Finance Law. Trustees Collyer, Kira, Kusse, Meinhardt voted YES. Trustee Silber explained the permissive referendum process. Motion by Trustee Collyer, seconded by Trustee Kira: VOTED to approve the Abstract of :Warrants dated 9/15/97 in the following amounts: General 'Fund - $30;594.41;'Sewer Fund - $20,15538; Water Fund - $64,384.53. Add: Best Western Golden Arrow - A3620.4 in the amount of $184.00. Trustees Collyer, Kira, Kusse, Meinhardt voted YES. In.response to Trustee Collyer's query relative to sales tax revenue, Treasurer Silber stated he does not anticipate a shortfall at this time. .Police Chief Wall submitted his monthly report which is on file in the Village Office. Motion by Trustee Kira, seconded by Trustee Collyer: RESOLUTION 4857 - FILL VACANT POSITION FOR PART -TIME POLICE CLERK VOTED to authorize Chief Wall to hire Luann Norman to fill the vacancy created by the resignation of Pat Stone for part -time Police Clerk at an hourly rate of $8.50. per hour - not to exceed $7500 for the year - with a potential.for an increase in ® hourly rate after a six -month period. Trustees Collyer, Kira, Kusse, Meinhardt voted YES. Chief Wall spoke of a recent complaint from Dr. Patterson of 168 Pleasant'Grove Rd. tb�;t bicyclists should not be permitted-to ride on sidewalks. Chief Wall will dis- cuss the issue with Ward Hungerford of the T.C.-Highway Dept. as to the te=ns under which the Pleasant Grove Road sidewalk was built. Chief Wall expressed great praise for the DPW crews in their cooperation and quick response in connection with numerous Police Department requests and the prompt; sub- sequent notice of .a. job's completion. Supt. Cross will.convey the Chief's sentiment to the workforce and also that Chief Wall brought it to the Board's attention. Trustee Kira moved and Trustee Collyer seconded to adjourn'the meeting.
