Minutes of a regular meeting of the Board of Trustees of the Village of Cayuga
Heights held January 15, 1996 at 7:30 PM in the Village Hall.
PRESENT: Mayor Anderson; Trustees Bisogni, Collyer, Kira, Kozen, Pimentel;
Attorney Tyler; Supt. of P.W. Cross; Police Chief Wall; Fire Supt. Day.
ABSENT: Trustee Fleming, Treasurer Silber.
OTHERS: David Yeater, Kay Newman, three Ithaca High School Students.
Mayor Anderson called the meeting to order at 7:30 PM opening it to comments
from the floor. He called to the Board's attention the special meeting scheduled
for Friday, January 19 at 4:30 PM for the purpose of paying bills.
Motion by Trustee Kira, seconded by Trustee Collyer:
VOTED to approve the minutes of a regular meeting held December 18, 1995 as
previously furnished Trustees in copy form. Trustees Bisogni, Collyer, Kira,
Kozen, Pimentel voted YES.
Mayor Anderson appointed Katherine Newman to serve on the Local Advisory Board of
Review to be held Tuesday, February 13, 1996 from 3 to 6 PM in the Village Hall.
It was the consensus of the Board to cancel the Annual Residents' Meeting this
year due to lack of attendance by Villagers in the past.
The Mayor's report is as follows:
- Letter from Gregory Rosati, resident of 100 Ridgewood Road, expressing his con-
cern regarding the hazardous conditions that exist along the portion of Ridgewood
Road that lies within the Village of Cayuga Heights. Chief Wall commented that
one solution would be to install "No Parking" signs on both sides of this stretch
from the intersection of Wyckoff to the City line. The possibility of one -way
traffic south was discussed and it was noted this would have to be coordinated
with the City. The matter will be acted upon later in the.meeting.
- Letter from Dr. Eric Patterson of 168 Pleasant Grove Road who complains about
snow removal service "where his driveway enters Pleasant Grove Road" and a
second concern about the water main access road which the Village opened north
of his property. Supt. Cross commented that the DPW crew is aware of the snow
removal problem and is making a special effort to keep his driveway clear, and
in reference to the latter, he recommended a chain.gate.
- Number of responses from Villagers of the fine work the DPW has done in clearing
snow from streets and sidewalks and Supt. Cross, in turn, relayed to the Board
the men's appreciation for the recognition.
-Re Transmission Master Meter Agreement - on hold.
No monthly report from the CHCA.
Fire Supt. Day presented his monthly report which is on file.
Supt. Day announced the bid prices for the Rescue Pumper, stating the low bidder
is Seagraves.
Motion by Trustee Collyer, seconded by Trustee Kira:
RESOLUTION 4718 - AUTHORIZE THE ISSUANCE OF $260,000 IN SERIAL BONDS
OF THE VILLAGE OF CAYUGA HEIGHTS, NEW YORK, TO PAY
COSTS IN CONNECTION WITH THE CONSTRUCTION OF A
CUSTOM RESCUE PUMPER
RESOLVED, by the Board of Trustees of the Village of Cayuga Heights, New York
as follows:
Section I. There are hereby authorized to be issued $260,000 serial bonds of
the Village of Cayuga Heights, New York to pay for the following village
purpose,'which is hereby authorized:

To pay the costs associated with the acquisition of a new, Class
A, Custom Rescue Pumper for the Fire Department at an estimated .
cost of $277,000. It is hereby determined that the plan for the
financing 'of such class of 'objects or purposes is by the issuance
of not exceeding $260,000 serial bonds of said Village; that the
period of probable usefulness thereof is twenty years, pursuant to
subdivision 27 of paragraph a of Section 11.00 of the Local
Finance Law; that said bonds will mature over a period not to
exceed ten years, and that a down payment is required thereof
pursuant to Section 107.00 of the Local Finance Law.
The aforesaid serial bonds to be sold at private sale and all
further powers in connection with the details and sale thereof are
hereby delegated to the Village Treasurer of said Village in
accordance with the Local Finance Law.

Section 2. The faith and credit of said Village of Cayuga Heights, New York,
are hereby irrevocably pledged for the payment of the principal of and
interest on said bonds as the same respectively become due and payable. An
annual appropriation shall be-made in each year sufficient to pay the
principal of and interest on such bonds becoming due and payable in such year.
There shall annually be levied on all the taxable real property of such
Village, a tax sufficient to pay the principal of and interest on such bonds
as the same become due and payable.
Section 3. Subject to the provisions of the Local Finance Law, the power to
authorize the issuance of and to sell bond anticipation notes in anticipation
of the issuance and sale of the serial bonds herein authorized, including
renewals of such notes, is hereby delegated to the Village Treasurer, the
chief fiscal officer. Such notes shall be of such terms, form and contents,
and shall be sold in such manner, as may be prescribed by said Village
Treasurer, consistent with the provisions of the Local Finance Law.
Section 4. The validity of such bonds may be contested only if:
1) Such obligations are authorized for an object or purpose for
which said Village is not authorized to expend money, or
2) The provisions of law which should be complied with at the'
date of publication of this resolution are not substantially
complied with, and an action, suit or proceeding contesting
such validity is commenced within twenty days after the date
of such publication, or

Such obligations are authorized in violations of the
provisions of the Constitution.
This resolution, which takes effect immediately, shall published
the Ithaca Journal, the official newspaper of such Village,
ith a notice of the Village Clerk in substantially the form provided
81.00 of the Local Finance Law..
Section 6. This resolution is subject to permissive referendum,as required by
subsection 36.00 of the Local Finance Law.

Mayor Anderson presented the Treasurer's report in his absence and it has
been placed on file.
Police Chief Wall submitted his statistical report which is on file.
Attorney Tyler reported on the following:

The Fire Protection - Contract with the Town of Ithaca was approved by the Town
Board on December 11, 1995 and Attorney Tyler recommended its approval by'the
Village Board.
Motion by Trustee Pimentel, seconded by Trustee Kira:
RESOLUTION 4719 - AUTHORIZE EXECUTION OF FIRE PROTECTION
CONTRACT WITH TOWN OF ITHACA
VOTED to approve the renewal of the Contract for Fire Protection with the Town of
Ithaca (see also minutes of 12/18/95 - Resolution 4717) in the northeast sector
of the Town which is defined in the Contract dated December 29, 1995, to run for
five years and to authorize the Mayor to execute same in the form received from
the Town of Ithaca on or about December 22, 1995. Trustee Bisogni, Collyer,
Kira, Kozen, Pimentel voted YES.
The Attorney made reference to the letter from Gregory Rosati of 100 Ridgewood
Road regarding the dangerous road conditions and expressed a need for immediate
action.
Motion by Trustee Kira, seconded by Trustee Pimentel:
RESOLUTION 4720 - SCHEDULE PUBLIC HEARING FOR CONSIDERATION
OF,LOCAL LAW U1 OF 1996
VOTED to schedule a Public Hearing for February 19, 1996 at 7:15 PM to consider
adoption of proposed Local Law O1 of 1996 entitled, "Amend and Supersede Local
Law #3 of 1993 - Traffic Control." Trustees Bisogni, Collyer, Kira, Kozen,
Pimentel voted YES.
The Police Chief is authorized to install NO PARKING signs on the north side of
Ridgewood Road as soon as weather /conditions permit.
Re the Franchise Agreement with Time Warner Cable, the Attorney was advised to
continue working through the Intermunicipal Cable Commission toward finalizing
an Intermunicipal Cable Franchise Agreement and the Board recommended that the
Village of Cayuga Heights take the lead for same. The question of cost sharing
arose without discussion.
Motion by Trustee Bisogni, seconded by Trustee Pimentel:
RESOLUTION 4721 - AUTHORIZE INTERMUNICIPAL CABLE TELEVISION COMMISSION
TO NEGOTIATE WITH TIME WARNER FOR RENEWAL OF FRANCHISE
WHEREAS, the Village of Cayuga Heights ( "the Municipality ") is provided
cable service by Time Warner Cable; and
WHEREAS, the Municipality recognizes the advantage of )cooperation with
other municipalities with regard to cable franchise issues; and
WHEREAS, the Tompkins County Intermunicipal Cable Television Commission
has been formed pursuant to Article 5 -G of the New York General Municipal Law
for the purpose of advising municipalities on matters pertaining to cable
television franchising and service, and holding.public hearings when and where
appropriate, all in order to promote the provision of good cable television
service at reasonable rates to the residents of Tompkins County; and
WHEREAS, the Municipality is a member of the Tompkins County Intermunicipal
Cable Television .Commission;
NOW THEREFORE, it is:

RESOLVED that the Municipality does hereby authorize the Tompkins County
Intermunicipal Cable Television Commission ( "the Commission ") to negotiate
with Time Warner Cable the renewal of the Municipality's cable franchise,
including conducting such public hearings as the Commission deems appropriate,
RESERVING however to the Municipality the ultimate approval, disapproval or
amendment of the franchise agreement so negotiated; and it-is further
RESOLVED that the Commission is hereby authorized to obtain from Time%
Warner on behalf of the Municipality such information as the Commission deems
appropriate, and this resolution shall be deemed the specific instruction and
direction of the Municipality to Time Warner to provide such information as
the Commission, as agent of the Municipality, may request. Trustees Bisogni,
Collyer, Kira, Kozen, Pimentel voted YES.
Supt. of P.W. Cross submitted his monthly report which is on file in the
Village Office.
Supt. Cross presented a modification of'the previously- approved Yeater Sub-
division, 520 Cayuga Heights Road parcel, on Mr. Yeater's behalf, (see
minutes of October 16, 1995 - Res. 4697), transferring an additional 0.10
acre strip of land from the back of the original lot to the new lot - 522
Cayuga Heights Road. After some discussion, the Board agreed to delay
action until the special meeting scheduled for January 19, 1996.
Notice received from T.C. Solid Waste that the tipping fee of $60 /ton will be
held through 1996.
Discussion arose concerning:the legality of homeow ners plowing snow off their
driveways into sidewalks, the question of whether there is greater salt
application,to roads than had been done in previous years, stake removal at
the Norberg and Teichthesen properties (Supt. Cross was instructed to write
them.again).
Supt. Cross was authorized to hire someone to update the fire and smoke
detection alarm system in the Village Hall, and also to pursue the problem
with the heating system above the Sutton Conference Room and to do whatever
is necessary to correct it.
