Minutes 9/19/199478 VILLAGE OF CAYUGA HEIGHTS BOARD OF TRUSTEES Minutes of a regular meeting of the Board of Trustees of the Village of Cayuga , Heights held September 19, 1994 at 7:30 PM in the Village Hall. PRESENT: Mayor Anderson; Trustees Bisogni, Collyer, Fleming, Kira, Kozen, Pimentel; Attorney Geldenhuys; Treasurer Silber; P.W. Supt. Cross; Police Chief Wall; Fire Supt. Leonhardt. OTHERS PRESENT: Page Webb, Kay Newman. Mayor Anderson called the meeting to order at 7:30 PM and opened it to privilege of the floor. Mrs. Page Webb gave a history of her numerous requests for fence variance and subse- quent ZBA determinations and questioned the procedure used for the hearing on 9/1/94. When told the Board of Trustees could not answer her questions, she waited for the arrival of the Attorney who seemingly gave her a satisfactory explanation. Mrs. Webb then withdrew from the meeting. Mr. Wilson Cohen, candidate for State Assembly, stopped by to introduce himself. Motion by Trustee Kira, seconded by Trustee Fleming: VOTED to approve the minutes of a regular meeting held August 15, 1994 as previously furnished Trustees in copy form. Trsutees Bisogni, Collyer, Fleming, Kira, Kozen, Pimentel voted YES. Motion by Trustee Pimentel, seconded by Trustee Kira: The Mayor reported on the following: - Letter from Vivian and Gary Fields requesting consideration of change of address from 417 Highland Road to 417 Parkway Place due to the fact there is no access from Highland Road. Question arose as to whether road signs at each end of the "T" on Parkway Place would be helpful and whether there are other nearby properties which should have address change to Parkway Place, as well. Since it is not clear whether this "lane" is Village - owned, action was delayed until this can be deter- mined. - Letter from Broome county Developmental Services expressing an interest and intent to establish a community residential facility for the developmentally disabled at 2229 N. Triphammer Road. Action on the proposal was deferred pending further in- formation. - Emergency Response Plan for Hazardous Materials Incidents has been mailed to vari- ous agencies. Response from Dept. of State - Fire Prevention and Control - indicating several necessary changes. - Ithaca- Tompkins County Transportation Council - information in Village Office. - Tompkins County Youth Bureau re 1993 Annual Report - available in Village Office. - Request from James Schug, Supervisor of Town of Dryden, for sewer hookups for a property which does not lie within the sewer district and a second property which ' lies partially within the sewer district as outlined. The Attorney stated that sewer agreements provide service to users within the particular district and recommended that the out -of- district property be denied and suggested finding out what percent- age of the second property lies within the sewer district boundaries. The Mayor will write to Mr. Schug for more information. RESOLUTION 4604 - AUTHORIZE MAYOR TO SIGN AGREEMENT WITH S &W VOTED to authorize the Mayor to sign an agreement with Stearns & Wheler, to be subsi- dized by Borg- Warner Auto, to review the Sewer Ordinance relative to iron. Trustees Bisogni, Collyer, Fleming, Kira, Kozen, Pimentel voted YES. Minutes of regular meeting - 9/19/94 2 -Re first draft of the revised Zoning Ordinance by Circuit Rider, Mayor reminded 79 Trustees to submit comments. - Meeting with Cornell personnel relative to the use of Cayuga Lake as a cooling ' source. Material may be perused in Village Office. -It was agreed, at the Police Chief's recommendation, not to stripe Remington Road at this time. - -Re joint VCH /Town of Ithaca bicycle /walkway on Pleasant Grove Road,the Mayor will investigate once again relative to bicyclists using sidewalk. - Complaints associated with the Kendal Project in connection with water drainage and noise - resolved for the time being. Trustee Pimentel expressed concern regard- ing potential soil erosion. -Memo from Dept. of Planning stating the Planimetric Maps for the Village are avail- able. - Letter from Leonard Weinstein of 608 Caygua Heights Road complaining of recent ditch modification by Village DPW crew causing waterflow problems. Supt. of P.W. Cross will write Dr. Weinstein informing him of plans to install a headwall structure on Cayuga Heights Road in an attempt to resolve this problem. - Letter from Dr. Horst Heinicke of 120 Highgate Road complaining of damage to his property at the corner of Remington and Highgate Roads (lot) by Village crew. He requests that the Village "restore the grassy shoulder." His request was denied and Supt. Cross will so inform him. -Mayor made mention of a recent Ithaca Journal article regarding the licensing of cats under the auspices of the SPCA - meeting to be held on 9/28. The Mayor stated that if the County is interested, the Village will go along, but will not start a program of its own. - Notice from Albany - Tentative Equalization Rate is 98.61%. -Copy of Tompkins County Local Law No. 3 of 1993 revising and updating the tag system for the collection of solid waste. (Copy available-in Village Office). Local Law states the requirement to sell individual tags "at one location or by mail." The Board agreed to take no action on this point at this time and also agreed to leave the tag cost as is, justifying any overage covers costs associated with pickup of yard waste, bulky items, and leaf pickup. There was no monthly report from the CHCA. Fire Supt. Leonhardt submitted his monthly report which has been placed on file. Supt. Leonhardt distributed copies of a follow -up memo to last month's report of the Apparatus Committee in which he provides additional information as reqested by Trustees. The Board approved the projected timetable for the replacement of the major firefighting and rescue vehicles of the Fire Department and allowed the Fire Supt. to proceed with discussions with other departments in connection with the potential sale of Rescue 241. He will report his findings at the October meeting. Treasurer Silber submitted his written reports which are on file. Treasurer Silber reported that he has scheduled audit fieldwork for the week of 10 /10. He recommended that the Court be audited this year for an additional cost of $1000. Health Insurance Update: The Treasurer has learned that due to the inclusion of re- tirees on the Village's current health plan, no other insurance companies will offer insurance. He recommended the BC /BS Community Rating Plan and will present a pro- posal at the October meeting. Motion by Trustee Fleming; seconded by Trustee Kira: RESOLUTION 4605 - APPROVE TRANSFERS VOTED to approve the List of Transfers as recommended by the Treasurer as follows and to add: FROM G1990.4 Sewer Plant Contingency Fund - TO G8130.4 Sewer Plant Insurance $400.00. Police Chief Wall presented his statistical report which is on file in the Village Office. ' Supt. of P.W. Cross presented his report which is on file in the Village Office. Supt. Cross mentioned that P.W. Foreman, Bob Tyrrell, plans to retire the end of the year with MEO Larry Marshall soon to follow. He suggested starting the application process from outside as well as within. He will draft a job description for Mr. Tyrrell's position. Wastewater Treatment Plant - August flow 2.971 MGD maximum 1.900 MGD average volume treated. Motion by Trustee Fleming, seconded by Trustee Pimentel to adjourn. Motion by Trustee Pimentel, seconded by Trustee Fleming: VOTED to approve the Abstract of Vouchers dated 9/19/94 in the following'amounts: General Fund - $57,528.42; Sewer Fund - $19,603.69; Water Fund - $580.83; Capital Fund - $35,630,00. Trustees Bisogni, Collyer, Fleming, Kira, Kozen, Pimentel voted YES. The Attorney reported on the following: Webb Case - Court appearance has been adjourned; ACC Franchise - she will try to negotiate for government educational access to Cayuga Heights Elementary School as part of the franchise agreement if school officials feel it is worthwhile; Ivey Case - Mr. Ivey has left the State - Court case has been ad- journed. The Attorney will attempt to pursue,this further. Police Chief Wall presented his statistical report which is on file in the Village Office. ' Supt. of P.W.
