Minutes 6/20/1994VILLAGE OF CAYUGA HEIGHTS 61 BOARD OF TRUSTEES Minutes of a Public Hearing, duly published and posted, held June 20, 1994 at 7:15 PM in the Village Hall to consider revision of bonding as per Resolution 4544, for costs associated with the construction of a new Central Garage Facility. PRESENT: Mayor Anderson; Trustees Bisogni, Collyer, Fleming, Kira; Attorney Geldenhuys; Treasurer Silber; Supt. of P.W. Cross; Police Chief Wall; Fire Supt. Leonhardt. ABSENT: Trustee Pimentel. OTHERS PRESENT: Page Webb, Kay Newman, Dexter Koze.n. Mayor Anderson opened the Public Hearing to consider the revised bonding and the Trea- surer explained that the reason for the proposed revision of the previous bond resolu- tion for construction of the Central Garage Facility is that, after closer examination of construction costs in connection with heating, plumbing, tank removal, etc., it was determined that an additional $55,000 would be needed to cover those items. Kay Newman, Villager, asked if there is a way to improve upon the process and the Treasurer stated this-situation-will not be repeated.--The-Hearing-was-declared-closed at 7:30 PM. Minutes of a regular meeting of the Board of Trustees of the Village of Cayuga Heights held at 7:30 PM in the Village Hall. 1. PRESENT: Mayor Anderson; Trustees Bisogni, Collyer, Fleming, Kira; Attorney Geldenhuys; Treasurer Silber; Supt. of P.W. Cross; Police Chief Wall; Fire Supt. Leonhardt. ABSENT: Trustee Pimentel. OTHERS PRESENT: Page Webb, Kay Newman, Dexter Kozen. Mayor Anderson called the meeting to order opening it to privilege of the floor. ' Page Webb appeared to bring to the Board's attention the serious problem with deer and urged the Board to come up with ideas to control the deer damage to property. Motion by Trustee Kira, seconded by Trustee Fleming: VOTED to approve the minutes of a regular meeting held May 16, 1994 and a special meeting held May 31, 1994 as previously furnished Trustees in copy form. Trustees Bisogni, Collyer, Fleming, Kira voted YES. Motion by Trustee Kira, seconded by Trustee Bisogni: RESOLUTION 4587 - AUTHORIZE ISSUANCE OF $120,000 SERIAL BONDS OF THE VILLAGE OF CAYUGA HEIGHTS, NEW YORK, TO PAY COSTS IN CONNECTION WITH THE CONSTRUCTION OF A CENTRAL GARAGE FACILITY RESOLVED, by the Board of Trustees of the Village of Cayuga Heights, New York as follows: Section 1. There are hereby authorized to be issued $120,000 serial bonds of the Village of Cayuga Heights, New York to pay for the following village purpose, which is hereby authorized: To pay the costs associated with the construction and furnishing of a new Central Garage Facility, located at the site of the current Central Garage on Sheldon Road, at a total estimated cost of $175,000. It is hereby determined that the plan for the financing of such class of objects or purposes is by the issuance of not exceeding $120,000 serial bonds of said Village; that the period of probable usefulness thereof is twenty years, pursuant to subdivision 11(b) of paragraph a of Section 11.00 of the Local Finance Law; that said bonds will mature over a period not to exceed ten years, and that a down payment is required thereof pursuant to Section 107.00 of the Local Firance Law. Minutes of Regular N._eting - 6/20/94 The aforesaid serial bonds to be sold at private sale, at a rate of interest not to exceed 5.5% per annum, and all further powers in connection with the details and sale thereof are hereby delegated to the Village Treasurer of said Village in accordance with the Local Finance Law. Section 2. The faith and credit of said Village of Cayuga Heights, New York, are hereby irrevocably pledged for the payment of the principal of and interest on said bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. There shall annually be levied on all the taxable real property of such Village, a tax sufficient to pay the principal of and interest on such bonds as the same-become due and payable. Section 3. Subject to-the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond, anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Village Treasurer, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by'said Village Treasurer, consistent with the provisions of the Local Finance Law. Section 4. The validity of such bonds may be contested only if: , 1) Such obligations are authorized for an object or purpose for which said Village is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violations of the provisions of the Constitution. Section S. This resolution, which takes effect immediately, shall published in full in the Ithaca Journal, the official newspaper of such Village, together with a notice of the Village Clerk in substantially the form provided in section 81.00 of the Local Finance Law. Section 6. This resolution is subject to permissive referendum as required by subsection 36.00 of the Local Finance Law. Section 7. This resolution supercedes the resolution dated December 20, 1993 entitled: "A RESOLUTION AUTHORIZING THE ISSUANCE OF $80,000 SERIAL BONDS OF THE VILLAGE OF CAYUGA HEIGHTS, NEW YORK, TO PAY COSTS IN CONNECTION WITH THE CONSTRUCTION OF A CENTRAL GARAGE FACILITY," if enacted. Trustees Bisogni, Collyer, Fleming, Kira voted YES. Trustees Bisogni, Collyer, Fleming, Kira voted YES. 64 Minutes of Regular Meeting - 6/21/94 The Mayor reported on the following: - Appointments as follows: 3 DPW Committee: Trustee Pimentel, Chair; Trustees Bisogni and Fleming. Public Safety Committee: Kira, Chair; Trustees Collyer and the designee for vacant Trustee position. Ground Water Committee: Trustees Fleming and Bisogni. Dexter Kozen was appointed to fill the unexpired term vacated by Trustee Perry to run to April, 1995. He will join the Board on 9/19/94. - Accept resignation of Officer Mark Vann from the Cayuga Heights Police Force and Marc Kaplan from the Intermunicipal Youth Commission. Mayor Anderson will ask Jeff Weiss if he will be willing to serve on the Ithaca Youth Commission. Also, a candi- date is needed for the County Youth Board. - Relative to the repair of the fence along Rt. 13 in the VCH, the Mayor is still trying to find out if this will be included as part of Rt. 13 road work. - Letter from Fran Kozen, CHCA, thanking the Mayor for his help in the recent Fun Run. $1,000 of the proceeds was donated to the DARE Program and also for work on the "nature trail," - 25 -foot strip behind the CHES. Brent Cross was asked to investigate the exact location. -N.E. Senior Citizens - letter thanking the Board for the $1,000 annual donation which is included in the 1994 -95 Budget. A check for this amount will be sent to them. - Gilovich - letter commending the DPW for work they did on his property. - Patterson - letter of complaint of behavior of rugby team using Pleasant Grove property owned by Cornell University. Mayor Anderson has spoken to Laing Kennedy and hopefully the remedy is forthcoming. - Mutkowski - letter complaining about the increase in taxes, citing her 1986 tax amount as a comparison with her current tax bill. - Banfield - 505 Wyckoff Rd. - Mayor and Trustee Pimentel met with Mr. Banfield and p� gress is being made to clean the property. Note: Detailed information on above items is available in the Village Office. Fire Supt. Leonhardt presented his monthly report and later filed it with the Clerk. Supt. Leonhardt distributed copies of a Memorandum to the Board in which he details the problems with Engine 203 and the reasons favoring its repair. There was discussion con- cerning necessity for bidding, sources for funding for repairs and the need for three quotes. Motion by Trustee Kira, seconded by Trustee Collyer: RESOLUTION 4588 - AUTHORIZE REPAIR OF ENGINE 203 VOTED to authorize the repair of Engine 203 to a state of "good operational condition" on the basis that it is a public works contract, for an amount not to exceed $17,500 with the first $5,000 to be funded from the Fire Department Equipment Acct. and the balance to come from Contingency. Trustees Bisogni, Collyer, Fleming, Kira voted, YES. Attorney Geldenhuys reported on the following: l/ re ownership of unopen portion of Brook Lane, she is still waiting to hear from the Abstract Company, 2/ Police Contract - re accounting detail in connection with the dental and eye benefits which the Union has chosen to administer, she is still waiting to hear IRS ruling concerning deduct- ibles, 3/ parking fees - language in the Local-Law No. 2 of 1994 is broad enough to be able to establish fees by resolution,4 /ie guiderail damage on Highgate Rd. and failure of Mr. Ivy to pay the outstanding bill for same, she will draft a plan to take to Small Claims Court. Treasurer Silber presented his monthly report which is on file in the Village Office. The Treasurer reported that the Industrial Appraisal Co. will prepare the Village inventory for Fixed Assets accounts and insurance coverage, tagging moveable equipment. Treasurer Silber commented that his efforts to get competitive quotes for the Village's full insurance package did not yield anything exciting. He found that other insurance Minutes of Regular Meeting - 6/20/94 65 companies refused toservice the entire plan. lie did manage, he said, to have the Ithaca Agency reduce its costs for a savings of approximately $25,000. He recommended switching to a different type of Workers' Compensation which would result in a savings of $10,000. Motion by Trustee Kira, seconded by Trustee Fleming: RESOLUTION 4589 - PERMA TO CARRY VILLAGE WORKERS' COMP VOTED to authorize the Treasurer to change the Village's Workers' Compensation coverage to a plan offered by Public Employer Risk Management Association (PERMA), effective immediately. Trustees Bisogni, Collyer, Fleming, Kira voted YES.- Motion by Trustee Collyer, seconded by Trustee Kira: VOTED to approve the Abstract of Warrants dated June 20, 1994 in the following amounts: General Fund - $79,321.80; Sewer Fund - $19,525.25; Water Fund - $1,227.73; Capital Fund - $32,029.36. Trustees Bisogni, Collyer, Fleming, Kira voted YES. Police Chief Wall submitted his monthly report which is on file. Chief Wall reviewed the schedule of proposed parking fees. Motion by Trustee Fleming,.seconded by Trustee Kira: RESOLUTION 4590 - APPROVE PARKING FEE SCHEDULE VOTED to approve the Parking Fees Schedule, effective August 1, 1994, as presented by Chief Wall for violations committed within the Village of Cayuga Heights to read as follows: No Parking Zone $10.00 ' Wrong Side to Curb Or Edge 10.00 Overnight Parking (2 AM -6AM) 5.00 On Sidewalk 15.00 Fire Hydrant (15 ft.) 25.00 Abandoned Vehicle 10.00 Uninspected Vehicle 15.00 Other 5.00 Handicapped Zone - As per NYS Vehicle and Traffic Law. Trustee Collyer raised the question of the Village's health insurance plan and asked the Treasurer to explore, with neighboring municipalities, the plans they are currently using. Sept. of P.W. Cross presented his monthly report which is on file in the Village Office. Sept. Cross reviewed his report with the Board and reported that Solid Waste pick -up for May -June was 28.6 tons of garbage and 1.62 tons of bulky. He reported that the 1 -ton truck has been ordered and the final price on the package will be $21,091 due to the necessity to equip the truck with the plow package which was not originally included. The flow at the WWTP for the month of May was 2.059 MGD max., and 1.761 MGD average volume treated. He noted that John Yaw and Jerry Smith were awarded "Waste Water Treatment Plant Operators of the Year" by the New York Rural Water,Supply Association. He extended his thanks to both men for their "good work for the Village." He reviewed the proposed schedule of fees for various permits, striking out the proposed Water Service Permit item. Cross was given permission to purchase an air conditioner for his office at a price not to exceed $300.00. Motion by Trustee Kira, seconded by Trustee Fleming: RESOLUTION 4592 - AUTHORIZE REFUND TO TCTC VOTED to authorize a refund of $301.33 to TCTC which had been erroneously itemized on their tax bill for water use delinquent charge. Trustees Bisogni, Collyer, Fleming, Kira voted YES. Mayor Anderson reported that the Emergency Response Plan for Hazardous Materials is being reworked to conform to the Village of Cayuga Heights. This will be the official response for the Public Works, Fire, and Police; and although the WWTP is a contract operation, it is owned by the Village and will have to be addressed in the Response in some way. The Mayor named.Trustee Kira as stand -in Acting Mayor in his absence from June 28 to July 15, since Acting Mayor Fleming will be away during that time also. The Board gave unanimous approval.
