Minutes of a Public Hearing, duly published and posted, held April 19, 1993 at
7:30 PM in the Village Hall to consider a proposal from Michael Pinnisi to
subdivide the five -acre parcel off Tyler Road.
PRESENT: Mayor Anderson; Trustees Collyer, Janis, Kira, Perry, Pimentel; Attorney
Geldenhuys; Supt. of P.W. Rogers; Police Chief Wall; Fire Supt. Leonhardt.
ABSENT: Trustee Fleming, Treasurer Silber.
OTHERS PRESENT: Michael Pinnisi, Paul Lewis, Tom Niederkorn, Barbara Blanchard,
Peter Trowbridge, James Miller.
Michael Pinnisi presented once again a preliminary site plan for subdivision of
the five -acre parcel off Tyler Road owned by William Wilcox. He provided an
Engineer's Report prepared by T.G. Miller Associates PC and there.was some dis-
cussion concerning the language under "Site Description; ".'specifically, "... and
of no concern..." Trustee Pimentel requested that the words.be deleted from the
report. It was agreed that since the roadway will remain private, only those
services available to other privately -owned Village streets will be provided to
residents in this subdivision. There was no further discussion and the Public
Hearing was declared closed.

Mayor Anderson called the Special Meeting to order.
Part II of the Short Environmental Assessment Form in connection with the Pinnisi
request for subdivision was completed by Trustees with the recommendation that
Raymond DiPasquale's letter be attached to it. Copies will be sent, along with
the T.G. Miller Engineer's Report to the Tompkins County Department of Planning
and Town of Ithaca.
Motion by Trustee Pimentel, seconded by Trustee Janis:
RESOLUTION 4469 - ACCEPT NEGATIVE DECLARATION
VOTED to accept the State Environmental Quality Review Short Environmental Assess-
ment Form as a Negative Declaration for Pinnisi Subdivision with attached letter
from Raymond DiPasquale dated March 29, 1984. Trustees Collyer, Janis, Kira,
Perry, Pimentel voted YES.
Motion by,Trustee Kiia, seconded by Trustee Pimentel:
RESOLUTION 4470 - APPROVE PRELIMINARY PLAT SUBMITTED BY MICHAEL PINNISI
VOTED to approve the Preliminary Plat - Pinnisi Subdivision for Tyler.Drive pre-
pared by T.G. Miller Associates P.C., Engineers dated April 16, 1993 subject to
approval'from Tompkins County Department of Planning and Town of Ithaca, with the
following conditions: to delete the words "of no concern" from T.G. Miller Engi-
neer's Report, and further, that potential purchasers of the properties will be
' notified of 1 /condition of the soil and will be provided information from the
Engineer's study, 2 /problems relative to excavation and loosened rocks rolling
beyond proposed boundaries and 3 /services provided by the Village forces will be
only those that are normally provided on other private roads and no more. Trustees
Collyer, Janis, Kira, Perry, Pimentel voted YES.

Mr. Pinnisi withdrew from the meeting.
Representatives from Kendal were present to hear comments and answer questions
relative to the Preliminary Application for a Planned Unit Development and Draft
Environmental Impact Statement which had been submitted on 3/22/93. Mr. Niederkort
explained that what they hoped to acheive at the meeting was an agreement that the
Draft EIS can be made available to the public for comment. This will be followed,
he said, by a Final EIS which is intended to respond to all concerns, questions,
etc., which might exist with regard to the Draft EIS. Trustees and the Engineer
raised questions on specific items relating to economic impact relative to taxable
status, traffic safety on N. Triphammer Road, water retention in the dams, erosion,
possible relocation of a manhole (drawing indicates the top would be below if a
retainage, basin filled), North /South pedestrian sidewalk on the west side of North
Triphammer Road from Lansing line to Hanshaw Road, services which will be required
and those not required. Tom Niederkorn was asked to provide a list of the con-
cerns raised at the meeting as a supplement to the minutes (copy attached hereto).
Motion by Trustee Perry, seconded by Trustee Pimentel:
RESOLUTION 4471 - APPROVE PRELIMINARY APPLICATION FOR PUD AND DRAFT EIS
VOTED, resolved that the Preliminary Application for a Planned Unit Development
and Draft Environmental Impact Statement as submitted by Kendal Communities
Development Company on March 22, 1993, is adequate to present to the public for
comment. Trustees Collyer, Janis, Kira, Perry, Pimentel voted YES.

VOTED to approve the Abstract of Warrants'dated 4/19/93 in the following amounts:
General Fund - $6,257.48; Sewer Fund - $7,061.94; Capital Fund - $30.00; Water
Fund - $2,066.53 - with the inclusion of the bill from Solid Waste for $1,716.65
for Tipping Fees A8160.46. Trustees Collyer, Janis, Kira, Perry, Pimentel voted
YES.

Questions, Concerns, Issues raised at 19 April Village Board Meeting
1. oils Need to acknowledge the importance of organisms
such as earthworms, anthropods and microbes in the
site's ecology. These components of the biota will be
adversely affected by the development.
2. Real Estate Need to completely understand the project's potential
ripple effects on the real estate market and property
assessments. How will the Village react if serious
devaluation occurs? What will the impacts be on other
property owners?
3. Taxes Need to emphasize that the Minimum Yield analysis
on p. 81 is a bare bones minimum that includes only
taxes from the residential components of the project.
Some portion of the other components such as the
Community Center are expected to be taxable. Deter-
mination to be made by County Assessment Office.
4.
Municipal Costs
Need to rework the Functional Unit exclusion analysis
to include some portion of the excluded municipal
costs. Consider eliminating this section entirely.
5.
Erosion
Expand description of erosion control measures;
cross - reference this section to the PUD Application
document description of erosion control.

Traffic
Evaluate difficulty of left turn out of Kendal drive onto
North Triphammer Road. Investigate potential mitigat-
ing measures.
7.
Stormwater Runoff
Provide additional assurances vis a vis stormwater
runoff calculations /methodology,
Consider how potential culvert blockages could be
handled and where drainage swale overflow would be
directed.
a. Emergency Calls Indicate how fire calls will be handled; first alert at
Kendal or into Fire Station.
9. Employment Clarify that most job opportunities will benefit Tomp-
kins County residents outside Cayuga Heights.
10. Utilities Consult with Village Supt. of Public Works on location
on manholes on south side of property.
11. Pedestrian Traffic Address issues related to pedestrian movement from
site to other destinations in the Village; particular
reference to potential connections with other pedestri-
an systems /greenways and bicycle travel paths.
