Minutes 10/19/1992L04 VILLAGE OF CAYUGA HEIGHTS BOARD OF TRUSTEES Minutes of a public hearing, duly published and posted, held October 19, 1992 at 7:15 PM in the Village Hall. PRESENT: Mayor Anderson; Trustees Collyer, Fleming, Kira, Perry; Attorney Geldenhuys Treasurer Silber; Supt. of Public Works Rogers; Police Chief Wall; Fire Chief Leonha ABSENT: Trustees Janis, Pimentel. OTHERS: Robert Gibbs, several Ithaca High School students. Mayor Anderson opened the public hearing to consider proposed 1993 Water Rate Schedule explaining that Bolton Point has been losing $25,000 to $40,000 per year on water in- come and that the ultimate goal is to have a rate which will be uniform to all users. The proposed 1993 rate per 1,000 gallons is as follows: 0- 101)'000• - .$2.30; 10,001- 300,000 - $2.20..and over 300,000 gallons the proposed rate per 1,000 gallons is $2.00. There was some discussion and the hearing was declared closed at 7:30 PM. Minutes of a regular meeting ofrthe Board of Trustees held October 19, 1992 at 7:30 PM in the Village Hall. PRESENT: Mayor Anderson; Trustees Collyer, Fleming, Kira, Perry; Attorney Geldenhuys; Treasurer Silber; Supt. of Public Works Rogers; Police Chief Wall; Fire Chief Leonhardt. ABSENT:" Trustees Janis, Pimentel. OTHERS: Robert Gibbs, several Ithaca High School students. Mayor Anderson called the meeting to order, opening it to privilege of the floor. Mr.i Robert Gibbs, Village of Lansing resident, provided information to the Village Board relative to a sewer permit issued to him on April 15, 1987 by the Village of Cayuga Heights to inspect an extension of a sewer line to a lot owned by him at 3 Bush Lane, Village of Lansing (per direction of the Lansing Village Clerk). He stat that it was his belief that the permit issued by the VCH was for a sewer connection to the Cayuga Heights sewer system and took issue with the notation on the sewer permit filed in the Village Office which reads, "extended sewer line to this lot only - no bldg.," intimating it is an untrue statement. Discussion ensued during which Engineer Rogers offered a clear explanation and the Board took action as follows: RESOLUTION 4403 - SEWER PERMIT ISSUED TO GIBBS SPECIFICALLY FOR EXTENSION OF LINE VOTED that Mr. Robert Gibbs has in his possession a bona fide sewer permit issued by the Village of Cayuga Heights in April, 1987, allowing him to extend a sewer line from the main to his lot line at 3 Bush Lane, to be inspected by the Village of Cayuga Heights upon completion; and further, if he wishes to extend a lateral from a building on said lot, he must provide evidence to the Village of Cayuga Heights that he has been issued a building permit and a moratorium sewer unit by the Village of Lansing allowing him to connect into the VCH sewer system. The Engineer is instructed to inform Mr. Gibbs of this Board action. Trustees Collyer, Fleming, Kira, Perry voted YES. * ** Mot;.on by Trustee Kira, seconded by Trustee.Fleming: VOTED to approve the minutes of a regular meeting held September 21 and a special meeting held October 5, 1992 as previously furnished Trustees in copy form: Trustees Collyer, Fleming, Kira, Perry voted YES. The Mayor reported on the following: - Letter from T.G. Miller P.C., dated 10/16, indicating that, due to weather limita- tions, Orchard Earth 6 Pipe will not be able to place the stone and oil surface treatment on Remington Road this fall, but offers an alternative proposal for an additional cost of $35,578 to install a 4 inch thick asphalt concrete pavement Minutes of Regular Meeting - 10/19/92 2 105 this season. The Board decided against the alternative and Mayor Anderson is in- structed to so inform the engineering firm. The road will remain closed during the winter months. - Update on the Community Recreational Center - all five municipalities have agreed to participate. A complete EIS is required. -Mayor Anderson and Engineer Rogers met with Joe Ciaschi on 9/25 and an agreement was reached on the curbing and lighting at USGS offices. There will be 4 parking spaces along the new side, more trees will be planted and there will be no added lighting. - Raccoon study has been reactivated - October 19 through October 22. Fire Chief Leonhardt submitted his monthly report which is on file in the Village Office. Treasurer Silber reviewed financial reports which had been distributed earlier. Motion by Trustee Fleming, seconded by Trustee Trustee Kira: VOTED to approve. the Abstract.- of Warrants dated 10/19/92 in the following amounts: f.�•:' General Fund - $27,858.33; Water Fund - $1,822.06; Sewer Fund - $25,155.34; Capital Fund - $543.33 and to add the bill from OE &P for $44,962; to delete $23.00 from Bolton Point's bill of $69.00 for a payment amount of $46.00 and to add the overlooked voucher for $12.12 to Vantage Auto Stores on the A3410.42 account. Trustees Collyer, Fleming, Kira, Perry voted YES. In anticipation of concerns from Village residents which may arise at the upcoming public hearing on the proposed PUD relating to spot zoning, the Attorney distributed copies of a court case in the matter of Town of Bedford v. Village of Mt. Kisco. She stated she will prepare a memo on the siuyject giving greater detail and recommended formulating a comprehensive plan which could be what is reflected by the current zoning laws. She stressed the importance of thoroughly discussing the reason for any zoning change and have it clearly reflected in the minutes. She will distribute copies of the Draft PUD with inclusion of the new language after she has spoken to Tom Niederkorn. Police Chief Wall submitted his monthly report which has been placed on file. Supt, of Public Works Rogers reviewed his monthly report which has been filed. Supt. of Public Works Rogers questioned the advisability, from an economic standpoint, of continuing corrugated cardboard collection on the second and fourth Fridays of each month. It was agreed to wait on such policy change until other matters relating to !' trash collection are settled. I(G63 Minutes of Regular Meeting - 10/19/92 3 Motion by Trustee Fleming, seconded by Trustee Kira: RESOLUTION 4405 - AUTHORIZE TRANSFER OF LIST OF OVERDUE TAXES TO COUNTY VOTED to authorize the Tax Collector to transfer the List of Overdue Taxes and Certification to Tompkins County for relevy. Trustees Collyer, Fleming, Kira, Perry voted YES. Motion by Trustee Fleming, seconded by Trustee Kira: RESOLUTION 4406 - ADOPT PROPOSED 1993 WATER RATE SCHEDULE VOTED to approve the proposed 1993 Water Rate Schedule as recommended by SCLIWC. (bpy,to be inserted in Official Minute Book) Trustees Collyer, Fleming, Kira, Perry voted YES. The request of the Court Clerk for an additional phone line for the Modum DMV was presented by the Treasurer and it was the sense of the Board that permission be granted.
