Trustees Camp, Fleming, Pimentel and Wheeler voting yes. Motion made by Trustee Camp, seconded by Trustee Fleming to adjourn. Unanimously passed. Meeting closed at 9:44 p.m. Submitted by Mayor Anderson Minutes of a Special Meeting of the Board of Trustees of the Village of Cayuga Heights held June 11, 1990 at 7:00 p.m. in the Village Hall. PRESENT: Mayor Anderson; Trustees Camp, Fleming, Pimentel, Weiss, Wheeler; Attorney Sovocool; Acting Attorney ".0esterle. ABSENT: Trustee Searle. OTHERS PRESENT: Jack Rogers, Ithaca Journal rep. Mayor Anderson opened the meeting which was called specifically for the purpose of discussing Remington Road. He summarized data and information gathered on the proposed reopening to date, including cost of guardrails, need for environmental review, cost of bidding documents and inspection service, and proposed re- assess- ment values. (See attachment for more detail). The Mayor mentioned that three public hearings had been held and much correspondence had been received on the subject - comments ranging from keeping the road closed forever to construction . of a two -lane asphalt road. The point was raised that the Town of Ithaca may not be willing to improve their portion of the road, but might be interested in install- ing a bikeway - walkway along the side of the road. This led to the statement by Attorney Sovocool that there would be value to changing the Village's boundary to iclude that portion of the road which lies within the Town, stating further that , it would also provide the opportunity to include the land adjacent to the Village's WWTP which was purchased last year. He stated that since there are no building lots involved, the procedure is a simple one - requiring only only an agreement between both parties; a public hearing is not required. The traffic issue was discussed and the pros and cons of having a through -road, An 3 MINUTES of a Special Meeting - 6/11/90 Discussion focused on the Village's moral obligation to reopen and what percentage of costs should be borne by the Village and landowners. Trustee Pimentel commented that there is no doubt in his mind that the Village Board in 1967 had intended to open and construct the road and agrees that since property owners, as well as the Village, have benefitted financially by having it kept closed, they should share in the expenses. He worked up figures based on a 34% owners /66% Village split on road cost. Attorney Sovocool, reading from Village Law, stated it is entirely at the discretion of the Board to set whatever percentages they choose. Trustee Camp suggested putting it on the basis that as soon as a lot had been sold, construction would begin. Attorney Oesterle responded that, most likely, landowners are not going to apply for a building permit until the road is in. There was agreement that those properties not benefitted would not be assessed any charges. Trustee Weiss reiterated his opposition to reopening the road disagreeing that the Village has a moral commitment to reopen in that property owners have waited 35 years to "exercise -what they think is their right" - he added it is an unreasonable expectation. He suggested that a "middle point" to the commitment can be met without heavy burden to Village. He commented further that the Village will face in the future some heavy expenses, citing the upcoming purchase of a fire truck, Savage Farm and other capital expenses. Trustee Camp suggested leaving the December motion intact with modification - specify 100% of drainage costs be borne by the Village and retain the 50/50% split on two phases of road - gravel and macadam, and to start action on the road, dependent upon the initiation by the Village of a utilities district. Trustee Wheeler believes the Village has a moral commitment to reopen and feels that a 34% contribution by landowners is too high. Motion by Trustee Pimentel, seconded by Trustee Fleming: RESOLUTION 416 6 - APPROVE CONCEPT TO REOPEN REMINGTON ROAD VOTED to reopen the lower portion of Remington Road as a through- street - 18 feet wide with shoulders - to be constructed through the first stage as hard pack gravel with 34% of the cost attributed to the abutting landowners on a front footage basis on the benefits received and 66% of the cost to be borne by the Village. A utilities district will be formed by the Village and necessary sewer and water will be installed. The Village will participate 100% in the cost of upgrading the drainage structures and ditching. The same percentage split (34% landowners, 66% Village) will be applicable when and if macadam surface is necessary. A detailed resolution, rescinding Resolution #4108 dated 12/18/89 will be drafted by the Village Attorney for approval at the July meeting. Trustees Pimentel and Fleming voted YES. Trustees Camp and Weiss voted AGAINST. Trustee Wheeler ABSTAINED. Mayor Anderson broke the tie vote voting YES. Trustee Wheeler reported that if two other munivipal in its efforts to turn over to SCLOWC the collection Board can proceed with its request that they do so. Commissioner Conneman re the matter.
