Minutes 1/15/1990MINUTES of a Public Hearing - 1/15/90 Minutes of a Public Hearing held January 15, 1990 at 7:00 p.m. in the Village Hall to consider Resolution 4108 - Reopen Remington Road. PRESENT: Mayor Anderson; Trustees Camp, Fleming, Searle, Weiss, Wheeler; Att. Oesterle; Police Chief Wall; Fire Chief Millier. c U MINUTES of a Public Hearing - 1.15.90 ABSENT: Trustee Pimentel, Treasurer Silber. OTHERS: M/M Dennis Shepherd, Att. Holmberg, Jack Rogers, Att. Berman, Charles Brodhead, Erik thorbecke, Art Mosher, Mary Call, Tom McCarthy, Pat Mutkoski, Carol Schmitt, serveral other Villagers. Mayor Anderson Called the Public Hearing to order, commented brieflyon the history of Remington Road and made reference to Resolution 4108 to reopen the Road. Attorney Holmberg, representing M/M Dennis Shepherd read a statement (attached). Attorney Claire Berman, representing landowner JackRogers, raised two points: on the procedural matter, she requested that the public hearing be iether adjourned or continued until such time as those concerned could discuss it together and present a proposal for Board consideration; and regarding what she referred to as a legal issue, she stated that the landowners relied on the promise that the Board would re -open the Road with no conditions attached. The Mayor referred to a letter from Verlee Wood and comments were heard from Charles Brodhead and Erik Thorbecke in opposition to reopen. Jack Rogers stressed the point that landowners are taxpayers and that taxes they have paid through the years were used for repair of other roads and further; that if the Board adopts a new policy, to be fair theywill have to apply that same policy for future repair thereby assessing abutting property owners. Mrs. Mutkoski wondered who would pay for installation of a pumping station and also what the total Village price tag would be. Mrs. Schmitt felt that the Board should honor its commitment to reopen the Road. Mayor Anderson closed the Public Hearing at 8:05 p.m. ---------------------------------------------------------------------------------- MINUTES of a Regular Meeting 1/15/90 Minutes of a regular meeting of the Board of Trustees of the Village of Cayuga Heights'held immediately following the Public Hearing. PRESENT: As above including Supt. of Public Works Rogers. ABSENT: As above. OTHERS: Mary Call, Pat Mutkoski, Carol Schmitt. Mayor Anderson called the regular meeting to order at 8:10 p.m. Motion by Trustee Camp, seconded by Trustee Fleming: VOTED to approve the minutes of a regular meeting held December 18, 1989 as furnished Trustees with an amendment as follows: Resolution 4108 - #6 - delete "grading (including drainage)" and insert "drainage improvement." Correct typo error - 4th WHEREAS - "or" and correct the spelling of "Shepherd. Unanimously passed. Trustees Camp, Fleming, Searle, Weiss and Wheeler voting yes. Moved byTrustee Fleming, seconded by Trustee Camp: VOTED to approve the Abstract of Audited Vouchers dated 1/15/90 in the following amounts: General Fund - $20, 673.19; Sewer Fund - $26, 601.77. Unanimously passed. Trustees Camp, Fleming, Searle, Weiss and Wheeler voting yes. Motion by Trustee Camp, seconded byTrustee Fleming: MINUTES of a Regular Meeting - 1/15/90 W RESOLUTION 4112 - APPROVE APPOINTMENTS VOTED to approve appointments as follows: (a) Katherine Newman to serve on Local Advisory Board of Review on February 13, 1990 from 3 p.m. to 6 p.m. in the Village Hall; (b) Ann Antil to serve as Chairperson of Inspectors of Election with Lucille Minotti as Inspector. Unanimously passed. Trustees Camp, Fleming, Searle, Weiss and Wheeler voting yes. Moved by Trustee CampL seconded by Trustee Fleming: RESOLUTION 4113 - SET DATES FOR VILLAGE ELECTION VOTED that Registration Day shall be Saturday, March 10, 1990 between the hours of 12:00 noon and 9 :00 p.m. in the Villag hall and Election Day shall be March 20, 1990 between the hours of 12:00 noon and 9:00 p.m. in the Village Hall. Unanimously passed. Trustees Camp, Fleming, Searle, Weiss and Wheeler voting yes. The Annual Residents' Meeting was set for February 20, 1990 at 7:30 p.m. Mayor Anderson have his report as follows: - Letter to Census Bureau re Corrections to "Housing Unit and Special Place Counts." - Letter to Town of Ithaca Supervisor Raffensperger re improvements to Remington Road. The,-Mayor will press the issue that 1/4 of the road is their responsibility. -Claim filed with the Village by Ann Burness of 106 Iroquois Place in connection with water line. (Jointly with Bolton). -Human Services Coalition - Annual meeting - 1/26/90 on "Housing the Homeless." -Labor negotiations are moving ahead in the Police Dept. - Traffic Count report has been received fron the County. -1st Annual Recycling Conference - March 22, 23, 1990 - Sheraton Inn, Liverpool, NY. There was no monthly report for CHCA. Fire Chief Millier presented his written report which is on file. Chief Millier reported that the Fire Dept. has 10 -12 new members. Attorney Oesterle reported that the Village has been sued by Rocco Lucente - similar to the suit by the Town of Ithaca. She is in the process of reviewing the lawsuit to see what the differences between the two might be. Police Chief Wall presented his statistical report which is on file. Moved by Trustee Camp, seconded by Trustee Fleming: RESOLUTION 4114 - AUTHORIZE CHIEF WALL TO PURCHASE COPY MACHINE IF NEED SHOULD ARISE VOTED to authorize Chief Wall to purchase a copy machine should the need arise before the first of June and to turn in the used one. Unanimously passed. Trustees Camp, Fleming, Searle, Weiss and Wheeler voting yes. 37 MINUTES of a Regular Meeting - 1/15/90 Moved by Trustee Camp, seconded by Trustee Weiss: RESOLUTION 4115 - AUTHORIZE POLICE CHIEF TO PURCHASE NEW POLICE CAR VOTED to authorize Chief Wall to purchase a 1990 Ford LTD police car as per State bids. Unanimously passed. Trustees Camp, Fleming, Searle, Weiss and Wheeler voting yes. Supt. of Public Works presented his report which is on file. Supt. Rogers reported that the flow at the Sewer Plant was extremely low for December. Two samples of Borg - Warner effluent did not meet requirements. He re- ported also that there have been problems with sludge removal at the Plant. He reviewed the new trash policy as formulated by the Public Works Committee. Moved by Trustee Searle, seconded by Trustee Wheeler: RESOLUTION 4116 - ACCEPT NEW TRASH PICKUP POLICY VOTED to accept, as Board policy, between now and June 1, the procedure for trash pickup as outlined in VILLAGE VOICES and to authorize the D.P.W. to follow such schedule. Unanimously passed. Trustees Camp, Fleming, Searle, Weiss and Wheeler voting yes. Motion by Trustee Camp, seconded by Trustee Searle: RESOLUTION 4117 - APPROVE REFUND OF WATER BILL VOTED to authorize a refund in the amount of $135.56 to Walter Schlaepfer for water meter reading error on his bill. Unanimously passed. Trustees Camp, Fleming, Searle, Weiss and Wheeler voting yes. Treasurer Silber appeared at the meeting at 9:25 p.m. He had no monthly report and in response to his question regarding updating the Fire Protection Contract with the•Town of Ithaca, he was instructed to proceed. Trustee Wheeler reported that the Sheldon Road water tank is on line. Discussion resumed relative to the issue of reopening Remington Road. Motion by Trustee fleming, seconded by Trustee Camp: RESOLUTION' 4118 - CONTINUE PUBLIC HEARING RE REMINGTON ROAD , VOTED to continue the Public Hearing relative to the reopening of Remington Road at the Organizational Meeting on April 2, immediately following the Public Hearing on the Budget. Unanimously passed. MINUTES of Regular Meeting - 2/19/90 Minutes of a regular meeting of the Board of Trustees of the Village of Cayuga Heights held February 19, 1990 at 7:30 p.m. in the Village Hall. PRESENT: Mayor Anderson; Trustees Camp, Weiss, Wheeler; Attorney Oesterle; Treasurer Silber; Supt. of Public Works Rogers; Police Chief Wall; Fire Chief Millier. ABSENT: Trustees Fleming, Pimentel, Searle. OTHERS PRESENT: M/M Rothaus, Dooley Kiefer, Kay Newman, Carol Schmitt, Charla Thorbecke, Blanche Maynes. Mayor Anderson called the meeting to order at 7:30 p.m. Moved by Trustee Wheeler, seconded by Trustee Camp: VOTED to approve the minutes of the regular meeting held January 15, 1990 as pre- viously furnished Trustees in photocopy form. Unanimously passed. Trustees Camp, Weiss and Wheeler voting yes. Moved by Trustee Camp, seconded by Trustee Weiss: VOTED to approve the Abstract of Audited vouchers dated 1/15/90 in the following amounts: General Fund - $31,601.00; Sewer Fund - $25,552.41 and to add to the list the bill from Phil Rodda for the installation of a boiler at the Fire Department in the amount of $575.90. Unanimously passed. Trustees Camp, Weiss and Wheeler voting yes. Mayor Anderson reported on the following: I ; - Letter from resident on N. Triphammer Road relative to the condition of the road edges and sidewalk resulting in NYTel's recent installation of ducts.
