MINUTES of a special meeting of the Board of Trustees of the Village of Cayuga
Heights held October 5, 1987 at 4:30 p.m. in the Village Hall.
PRESENT: Deputy Mayor Anderson; Trustees Bennett, Fleming, Kira, Pimentel;
Attorney Sovocool; Treasurer Walker; Engineer Rogers.
ABSENT: Mayor Marcham, Trustee Camp.
OTHERS PRESENT: Gary Gleason and Richard L. Elander, President OBG Operations, Inc.
Moved by Trustee Pimentel, seconded by Trustee Kira:
RESOLUTION 3854 - APPROVE AGREEMENT WITH OBG OPERATIONS, INC.
VOTED to approve the Agreement for Non - Professional Services Between the Village
of Cayuga Heights and OBG Operations, Inc., for the operation of the wastewater
treatment facility and for the execution of same by the Mayor, with the understand-
ing that O'Brien & Gere engineering contract with Borg - Warner Automotive is
finite. And to add, in paragraph 3, that the reference to the annual increases
due to the C.P.I. is for a 7% annual cap unless mutually adjusted. Unanimously
passed.

RESOLUTION 3855 - AUTHORIZE ATTORNEY AND TREASURER TO DRAFT RESOLUTION
FOR OBTAINING B.A.N.
VOTED to authorize the Attorney and Treasurer to draft the necessary resolution
for obtaining a Bond Anticipation Note in the amount of $95,000 for the
construction of sidewalks in the Village of Cayuga Heights. Unanimously passed.

RESOLUTION 3856 - AUTHORIZE CONSTRUCTION OF SIDEWALKS IN THE VILLAGE OF
CAYUGA HEIGHTS AT A MAXIMUM ESTIMATED COST OF $100,000
AND AUTHORIZE THE ISSUANCE OF $95,000 SERIAL BONDS OF
SAID VILLAGE TO PAY THE COST THEREOF

Tompkins County, New York, as follows:
Section 1. Construction of Sidewalks in the Village of Cayuga Heights,
Tompkins County, New York, are hereby authorized at a maximum estimated cost
of $100,000.00 for the fiscal year 1987 -88.
Section 2. The plan for the financing of the maximum estimated cost of
such specific object or purpose is by the payment of $5,000.00 (5 %) from the
current funds and by the issuance of serial bonds of said village in the
amount of $95,000.00 hereby authorized to be issued pursuant to the Local

Finance Law.
Section 3. It is hereby determined pursuant to subdivision 24 of
paragraph a of Section 11.00 of the Local Finance Law that the period of
probable usefulness of such specific object or purpose is ten years and that
the proposed maturity of the bonds herein authorized will not be in excess of
five years.
Section 4. The bonds will be paid from gereral taxation. Pursuant to
item (1) of subdivision 3 of paragraph d of Section 107.00 of the Local
Finance Law, a down payment of 5% or $5,000.00 is required in connection
with the issuance of the bonds herein authorized or bond anticipation notes.
Section 5. The faith and credit of the said Village of Cayuga Heights
are hereby irrevocably pledged to the payment of the principal of and interest
on such obligations as the same respectively become due and payable. An
annual appropriation shall be made in each year sufficient to pay the
principal of and interest on such obligations coming due and payable in such
year.
Section 6. Subject to the provisions of the Local Finance Law, the power
to authorize the issuance of and to sell bond anticipation notes in anticipation
of the issuance and sale of the serial bonds herein authorized, including
renewal of such notes, is hereby delegated to the Village Treasurer, the chief
fiscal officer. Such notes shall be of such terms, form and contents and
shall be sold in such manner as may be prescribed by said Village treasurer,
consistent with the provisions of the -Local Finance Law.
Section 7. The validity of such bonds may be contested only if:
(1) Such bonds are authorized for an object or purpose for which the Village
of Cayuga Heights, New York is not authorized to expend money, or
(2) The provisions of law which should be complied with at the date of
publication of this resolution are not substantially complied with, and an
action, suit or proceeding contesting validity is commenced within twenty
days after the date of such publication, or
(3) Such bonds are authorized in violation of the provisions of the Constitution.
Section 8. This resolution is not subject to a permissive referendum.

RESOLUTION 3856 - ADOPT LOCAL LAW NO. 2 OF THE YEAR 1987 - SIGNS
VOTED to adopt Local Law No. 2 of the Year 1987 entitled "Amendment to Article IX,
Section 17. SIGNS, of the Village of Cayuga Heights Zoning Ordinance. Unanimously
passed.

RESOLUTION 3857 - HIRE APPRAISER
VOTED to hire Richard Agard to appraise certain lands the Village is interested in
acquiring and if appropriate, to negotiate for its purchase. Unanimously passed.

RESOLUTION 3858 - APPROVE JOB DESCRIPTION FOR SUPT. OF PUBLIC WORKS
VOTED to approve the job description for Superintendent of Public Works as prepared
by the Tompkins County Personnel Department and to forward such copy to Hugh
Hurlbut, Commissioner of Personnel, for his prompt action. Unanimously passed.

MINUTES of a regular meeting of the Board of Trustees of the Village of Cayuga
Heights held October 26, 1987 at 7:30 p.m. in the Village Hall.
PRESENT: Mayor F.G. Marcham; Trustees Anderson, Camp, Fleming, Kira, Pimentel;
Attorney Sovocool; Treasurer Walker; Engineer, Rogers; Police Chief Wall; Fire
Chief Miller.
ABSENT: Trustee Bennett.
OTHERS PRESENT: S &W Engineers Armstrong and Swanson, John Barney, Alex Cima,
representative from Rupp Rentals, Ellen Harrison.
Engineers Armstrong and Swanson reviewed with the Board their preliminary report
on the expansion of wastewater treatment facilities, copies of which had been
distributed to Trustees the previous week. After a short question and answer
period, the Trustees agreed to relay their comments and suggestions to S &W by the
end of the week.
Ellen Harrison of 115 E. Upland Rd.,offered a comment on the traffic situation at
the Community Corners intersection, stating her opposition to the installation of
a center lane as an option to alleviating the problem because it will "move the
wrong people faster" and pedestrians will have greater difficulty in crossing
Hanshaw Road.
Attorney Barney, representing developer Cima, asked if the Board had made a
decision concerning the latter's request for 60 sewer hookups in the Town of
Lansing (see minutes 8/17/87). He was told that the Board's decision was still
on hold and probably would be for several months until the Stearns & Wheler
report had been studied.
