Call to Order: Mayor Supron called the meeting to order at 7:03 p.m. 1. Approval of Minutes: Resolution #7477 BE IT RESOLVED THAT: Minutes of the March 10, 2014 Village of Cayuga Heights Board of Trustees Meeting be approved as written in Exhibit FYE2014-74. Approval of Minutes: Resolution #7478 BE IT RESOLVED THAT: Minutes of the March 25, 2014 Village of Cayuga Heights Board of Trustees Meeting be approved as written in Exhibit FYE2014-75. Approval of Minutes: Resolution #7479 BE IT RESOLVED THAT: Minutes of the April 7, 2014 Village of Cayuga Heights Board of Trustees Organizational Meeting be approved as written in Exhibit FYE2015-01. Privilege of the Floor (PoF): Mark Mecenas wondered if the Board would provide feedback on a bulleted list that he emailed to the Mayor. It was determined that not all members of the current board received the list forwarded to the Trustee distribution. A Zoning Task Force has been formed and their initial meeting will be held on April 28th. Mr. Mecenas would appreciate having a structure upon which to develop a conceptual design. Mayor Supron expressed her impression that in the aforementioned email the height of his envisioned building is a significant departure from his initial conceptual plan. Superintendent of Public Works Cross recommended that an option may be to treat Mr. Mecenas’ proposal as a unique request under the Village’s Planned Unit Development guidelines. That would remove the onus for a zoning change which would apply to all structures in the Commercial District. Mr. Mecenas and Supt. Cross will meet and discuss that possibility. The topic may again be raised at the May 12th BOT Meeting. It was decided that the permitting question regarding JJ’s Café change of ownership would be addressed. Supt. Cross presented background on the issue at hand. Attorney Marcus and Supt. Cross determined that current applicable code falls under a section regarding permitting food service or gas station businesses which predates formation of the Planning Board. In these cases it falls to the BOT and not the Zoning Board or Planning Board to make a determination. Trustee Friend joined the meeting at this point. The question of an expiration date on this kind of permit was discussed. Although Supt. Cross has been aware that permit renewal should be undergone; he has not, due to time constraints, enforced this. Resolution #7480 BE IT RESOLVED THAT: A Public Hearing will be held at the May 12, 2014 Village of Cayuga Heights Board of Trustees Meeting for the purpose of permitting a continued food service business housed at the current JJ’s Café site. Motion: Trustee Crooker Second: Trustee Woodard Ayes: Crooker, Friend, Hamilton, Robinson, Salton, and Woodard Nays: none Abstentions: none Motion carried Chief Steinmetz extended his thanks to the current owners of JJ’s for their service to the community and for their support of the Cayuga Heights Police Department. 5. FYE2015 Budget (Exhibit FYE2015-02) Various topics related to the Tentative Budget were discussed. An exchange on the decision to raise the percentage of healthcare premium contribution to be made by non-bargaining unit employees took place. The BOT decided that keeping the tax levy within the tax cap, yet raising the tax rate sufficiently to keep fund balance steady was the best course of action. Resolution #7481 BE IT RESOLVED THAT: The Tax Levy for Fiscal Year June 1, 2014 – May 31, 2015 for the Village of Cayuga Heights will be set at $6.34 per $1,000 of property assessed value. The change is an increase of 1.9% in the Tax Levy Rate. Cross asked if the Sewer Rate had been established at the Organizational Meeting on April 7, 2014. It had not. Following a brief discussion and explanation the following was proposed: Resolution #7482 BE IT RESOLVED THAT: The Sewer rate for FYE2015 will remain unchanged for the Village of Cayuga Heights. Report of the Mayor: A resolution recognizing Mr. Martin Harms’ service as Chair of the Planning Board will be presented during the May12, 2014 Board of Trustees Meeting. 7. Report of the Trustees: No reports to be presented. 8. Report of Superintendent of Public Works Cross: (Exhibit FYE2015-03) a. Phosphorus level testing results were very good last month; one of our best. b. Soluble Reactive Phosphorus testing results were excellent as well. It measures how much phosphorus is usable by organisms in the lake. This testing is not required by the DEC or the Cayuga Lake Modeling Project. It was proposed that an article in Village Voices to share this good news would be appropriate. c. A project to improve drainage on Winthrop Drive has been submitted for grant funding from the Tompkins County Stream Corridor Restoration and Improvement Fund. d. Supt. Cross attended training that qualifies the Village to apply for funding under Safe Routes to School Grants. Although it is too late to apply for this year, work will be performed by a summer intern that will allow the Village to be more prepared for the next round of funding. 10. Report of Clerk & Treasurer Mangione (Exhibit FYE2015-04) Resolution #7483 BE IT RESOLVED THAT: The Village of Cayuga Heights/ Location code 40151 hereby establishes the following as reflected in Exhibit FYE2015-04 standard work days for elected and appointed officials and will report the following days worked to the New York State and Local Employees’ Retirement System based on the time keeping system records or the record of activities maintained and submitted by these officials to the clerk of this body. Motion: Trustee Salton Second: Trustee Woodard Discussion: none Ayes: Crooker, Friend, Hamilton, Robinson, Salton, and Woodard Nays or abstentions: none Motion carried Meeting of the Village of Cayuga Heights Board of Trustees was adjourned by Mayor Supron at 9:28 p.m. EXHIBIT 2015-006 May 12, 2014 Honorable Kate Supron Board of Trustees Village of Cayuga Heights Monthly Report – May, 2014 We had 46 total calls for the month of April. There were 21 calls in the Village of Cayuga Heights, 20 calls in the Town of Ithaca and 5 mutual aid requests. We had 29 EMS runs and 27 fire calls. Our EMTs had a busy month in April. We responded to three separate calls through the month for patients in cardiac arrest. In all three cases we performed CPR and advanced life support procedures and working with Bangs Ambulance and regained pulses prior to the patients arriving at the hospital. It was an amazing month for our EMS providers. April was a great month for training. Early in the month we did our annual SCBA recertification. All firefighters in the department must recertify annually with our self-contained breathing apparatus. Exterior firefighters are required to demonstrate their proficiency in donning the SBA. Interior firefighters must demonstrate that they can don the SCBA, perform full and partial escapes to get through confined areas, do a search in a dark room and then use the bail-out system to exit a second floor and rappel to the ground. All department firefighters must do this recertification to maintain membership. Late in the month we did a joint training with the FAST teams from the Dryden and Cortlandville Fire Departments. We did this training with these departments because we work closely with Dryden on scenes and Cortlandville is the primary mutual aid department from the north side of the Town of Dryden. This was a fantastic training and we are planning to do this again this summer. Bangs Ambulance came to the station in April for a training on ambulance operations. We try to do this training annually with Bangs. There was also a training on penetrating trauma offered through Cayuga Medical Center with Dr. Anthony Hsu. Several of our EMTs attended the training. With the approval of the Village budget we have started to schedule the projects that were budgeted for. In June we will have the driveway sealed and striped, the air conditioning unit replaced the in the radio room and the carpet replaced in the office area. We will order all of the budgeted equipment for delivery through the summer. We have two bunkers who have lived at the station for two years who are leaving in May. When we posted the rooms to the department we immediately had several members who applied for the bunking positions. Fire Council looked through the candidates and chose two firefighters to fill the rooms. We also had several members who have requested to bunk over the summer while taking fire and EMS classes in the area. We will be fully staffed at the station through the summer. We are very pleased with the staffing at the department at this time. Superintendent of Public Works PERIOD: April 2014 REPORT BY DEPARTMENT: 1. PUBLIC WORKS a. Street System: Potholes have been patched b. Storm Water System: i. Catch-basins undergo systematic cleaning ii. Creeks are monitored to keep them clear of debris. c. Water System: Water-main project on Triphammer Road has been completed jointly with the City of Ithaca. d. Sewer System: Continued flushing is planned. e. Buildings and Grounds: i. Reconstruction in the Police Department has been completed. ii. Arbor Day Celebration took place at CHES f. Personnel: Wayne Relyea has returned to full duty. g. Safety: i. The New York State Insurance Fund (NYSIF) conducted an annual safety survey of the DPW work and storage areas at 123 Sheldon Road. With the exception of two recommendations, which were acted on immediately, areas were found to meet OSHA standards. The department was praised for its diligence in development of an effective safety program. ii. A Safety Action Plan has been developed and is followed at the department with annual refresher training focused on areas which pose the greatest risk. The next training is scheduled on May 29, 2014; it will include Roadway Worker Safety, Back Safety, and General Safety Awareness. EXHIBIT 2015-008a RESOLUTION _____ BUSINESS ADVISORY COMMITTEE WHEREAS the Village’s Comprehensive Plan adopted January 13, 2014 stated as an objective to improve the business climate for property and business owners in the Village, and that the plan also recommended establishment of an advisory committee to facilitate communication and encourage collaboration between Village officials and commercial property and business owners, THEREFORE BE IT RESOLVED, That a Business Advisory Committee (BAC) be established to advise the Board of Trustees on policy matters pertaining to the business community in the Village of Cayuga Heights, and That the BAC will be comprised of no fewer than 5 (five) and no more than 7 (seven) volunteer members appointed by the Mayor for two year terms, one of whom will be named Chairperson by the Mayor and one of whom will be a member of the Village of Cayuga Heights Planning Board, and That the BAC will meet on a periodic basis as determined by its members and Chairperson, but not less than once every three months, and That the BAC will report to the Board of Trustees as needed , but not less than once every three months. EXHIBIT 2015-008b RESOLUTION ____ RESOLUTION OF APPRECIATION TO RECOGNIZE CHAIR MARTIN HARMS FOR HIS SERVICE TO THE PLANNING BOARD WHEREAS, Martin Harms was appointed by the Village Board of Trustees to serve as Chair of the Planning Board, and WHEREAS, Martin Harms served as chair from the first organizational meeting of the Planning Board in October 2009 until February 2014, and WHEREAS, Martin’s input in the development of the Planning Board and its direction was very valuable, and WHEREAS, Martin worked to guide the development and adoption of the Village’s first single document Comprehensive Plan during his tenure as Chair, THEREFORE BE IT RESOLVED, That Village of Cayuga Heights Board of Trustees recognizes and thanks Martin Harm’s for his commitment to the Village of Cayuga Heights Planning Board, and for his service to the Village. EXHIBIT 2015-009a May 7, 2014 To: The Honorable Mayor Supron Members of the Board of Trustees Village of Cayuga Heights Re: Report of the Police Department for April, 2014 In the month of March the police department received 331 calls for service. In addition to these calls, 118 uniform traffic tickets were issued and 12 parking violations were cited. A breakdown of the calls for service is as follows: 4 felony complaints of burglary were reported. Of these 4 incidents 2 were found to be forced entry. Residents stated that access had been gained to their home through damage to a locked door or window. In the 2 remaining incidents residents stated that their homes were either unlocked or a key was easily accessed. Reported Items including jewelry, computer related items, cash money, and prescription medicine. There is a suspect and the investigation is continuing. 8 misdemeanor incidents were handled including 2 for theft, 2 for fraud, and 4 for vehicle and traffic. Both of the theft complaints were of larceny from a motor vehicle. Residents reported that their unlocked vehicles had been entered and items including loose change, music cds and prescription medication had been taken. There are no suspects in these cases and the investigations are ongoing. The 2 complaints of fraud consisted of residents receiving suspicious phone calls requesting information regarding bank account and tax information. Officers attempted to make contact with the callers however the numbers shown on caller ID came back not in service. No exchange of money or personal information occurred. 4 traffic stops led to 3 misdemeanor charges of driving while intoxicated, 2 misdemeanor charges for DWI-Driving with blood alcohol .08 of 1% or higher, 1 misdemeanor charge of DWI-driving with blood alcohol .18 of 1% or higher, 3-aggravated unlicensed operation of a motor vehicle 3rd, and 1 driving while registration suspended or revoked. 1 penal law violation for Harassment was reported. The complainant stated that an acquaintance had sent him numerous threating text messages while he was at a location in the Village. The suspect was contacted and warned not to contact the complainant any further or harassment charges would be filed. 1 report local law violation Noise-Party/Social Event of Gathering occurred. A complaint of loud music was made. After investigation it was found that a local fraternity was having an unregistered party at their house. Contact was made with the house president and he was cited for charges of the Local Law Noise Violation. There were 5 Motor vehicle accidents investigated, none involving deer. No other incidents were reported involving deer. In summary, 6 persons were arrested and the following 10 charges were filed: 2-DWI 1st Offense, 2-Operating a Motor Vehicle with .08 of 1% of alcohol in the blood, 1-Aggravated DWI Operating a Motor Vehicle with .18 of 1% of alcohol in the blood, 3-Aggravated Unlicensed Operation of a MV 3rd, 1-Local Law-Noise/Party Social Event or Gathering and 1-Execution of a Bench Warrant. Over the course of this month police department members took part in the following trainings and events: The first week in April officers Chad Lansing and James Landon attended Basic Investigative Photography Training. On the 23rd part-time officers completed annual spring firearms qualifications while full time officers completed their qualifications on the 29th. On the 25th, Sergeant Jerry Wright completed the Translator/Interpreter Program facilitated by the Cornell University Public Service Center. The full time officers worked a total of 41.5 hours of overtime and the part time officers worked a total of 230 hours. EXHIBIT 2015-010 RESOLUTION ____ WHEREAS, the Village of Cayuga Heights Board of Trustees, in accordance with Zoning Ordinance Section 4.2(c), has conducted a public hearing concerning the operation of a restaurant business in the Village’s Commercial District Business; and WHEREAS, such business has been conducted at 903 Hanshaw Road under the name JJ’s Café; and WHEREAS, the Village Board of Trustees had, at some time in the past, granted a special approval in accordance with Section 4.2(c) for the operation of such business; and WHEREAS, the Village Board has been advised that the ownership of such business is to be transferred to R&M Hospitality, LLC, and the parties to such transaction have requested confirmation that operation of a restaurant business at the location of JJ’s Café at 903 Hanshaw Road can continue to be conducted in accordance with Section 4.2(c) with the special approval of the Board; THEREFORE BE IT RESOLVED, The Village of Cayuga Heights Board of Trustees has determined, in accordance with Zoning Ordinance Section 4.2(c), that , with respect to the operation of a restaurant business at the location of JJ’s Café at 903 Hanshaw Road, a need for such use exists for the convenience of the neighborhood and that the general welfare of the Village will be served by such use, and that there will be no excessive noise in connection with such use; and be it further resolved that The Village of Cayuga Heights Board of Trustees hereby grants special approval in accordance with Zoning Ordinance Section 4.2(c) for the operation of a restaurant business at the location of JJ’s Café at 903 Hanshaw Road, such grant of special approval subject to the following conditions: 1. The business will serve food and beverages [but will not serve alcoholic beverages]; 2. The business will be open to the public within the hours of 6 am to 10 pm, Monday through Saturday; 3. The business will provide indoor seating for no more than 36 persons total, including chairs at tables and stools at counters; 4. The business will provide outdoor seating for no more than 16 persons total, with chairs at tables, to be used between April 1 and September 31; 5. The business will arrange with the property owner for garbage/dumpster service in the existing dumpster enclosure location at the back of the property; and 6. There will be no use of equipment the use of which would be audible outside of the business’ indoor premises. 7. Parking for this business will remain available in the parking lot of the property owner, and this approval does not alter, impose or diminish any applicable parking requirements. EXHIBIT 2015-011a VILLAGE OF CAYUGA HEIGHTS CLERK’S REPORT May 12, 2014 1. New York State Insurance Fund (NYSIF) performed an annual site safety survey of Marcham Hall on April 17, 2014. A few recommendations were made; two (2) items were resolved in the Police Department when construction was completed. A long standing issue of extension cord use in the Court Room was discussed. It was agreed that they are to be moved to a position along the outside wall when not in use. 2. The Tompkins County Board of Assessment is in receipt of all information required to produce the tax statements for year 2014. Delinquent water payments of $17,594.15 and delinquent sewer payments of $4,906.29 have been relevied for collection onto the tax bills. 3. A Legal Notice informing Village residents of dates on and by which taxes will be received in the Village office and penalty rates to be assessed for late payment will appear on June 2nd and 3rd in the Ithaca Journal. 4. Water and sewer payments will be received up to and including May 22nd without penalty. Quarterly billing totals for this quarter are $118,472.64 for water and $34,942.54 for sewer. 5. Bank Balance: $2,418,297.21 as of April 30, 2014 2. Audit a. FYE2013 Audit field work was completed by CDLM the week of March 3 – 7. Written report should be available in the next few weeks. 3. Budget a. Constitutional Tax Limit reporting has been submitted and accepted by NYS OSC. b. Real Property Tax Cap reporting has been submitted and accepted by NYS OSC. c. The Village’s FYE2015 Adopted Budget and all required supporting schedules have been submitted and accepted by NYS OSC. d. List of Budget Journal adjustments to be distributed and discussed. 4. Bond and BAN Financing a. May 15, 2014 an interest only payment in the amount of $12,900 is due on the fire station. b. On May 22, 2014 the Water Improvement Bond Anticipation Note (BAN) of $775,000 will be paid with $75,000 from the Water Fund (F) and a BAN of $700,000. Tompkins Trust is the financing institution offering an interest rate of 1.65% 5. Transfers – $182,467.80 transferred from General Fund checking to Trust & Agency for payroll, 75% of the retiree healthcare premium, and payroll processing fees. 6. Revenues & Expenditures – April 2014 reporting 7. Current Expenses - Unaudited Abstract #12 dated May 12, 2013: as distributed Monday, May 12 2014. 8.
