HomeMy WebLinkAboutProposed Local Law H - 2011 - Minimum Attendance Requirements PB and ZBA. v2 5.19.11wpd.pdfV2 5.19.11 VILLAGE OF CAYUGA HEIGHTS PROPOSED LOCAL LAW “H” OF THE YEAR 2011 A LOCAL LAW ESTABLISHING MINIMUM MEETING ATTENDANCE REQUIREMENTS FOR REGULAR PLANNING BOARD AND ZONING BOARD OF APPEALS MEMBERS Be it enacted by the Board of Trustees of the Village of Cayuga Heights as follows: Section I. PURPOSE AND INTENT. The purpose of this Local Law is to establish minimum meeting attendance requirements for Regular Planning Board and Zoning Board of Appeals members. The intention of this Local Law is to ensure a quorum at as many Planning Board and Zoning Board of Appeals meetings as possible and to facilitate the timely review of applications received by the Planning Board and Zoning Board of Appeals. Section II. AUTHORITY. This Local Law is enacted pursuant to the grant of powers to local governments provided for in (i) Section 10 of the Municipal Home Rule Law to adopt and amend local laws not inconsistent with the provisions of the New York State Constitution or not inconsistent with any general law relating to its property, affairs, government or other subjects provided for in said Section 10 of the Municipal Home Rule Law, (ii) Village Law § 7-712 (9) , and (iii) Village Law § 7-718 (9). Section III. ESTABLISHMENT OF MINIMUM MEETING ATTENDANCE REQUIREMENTS. As of the effective date of this law, all Regular Planning Board Members and Regular Zoning Board of Appeals Members shall be required to attend a minimum of 65% of all regularly scheduled meetings within any consecutive 12 month period. Any Regular Member of the Planning Board and Zoning Board of Appeals may be removed by the Mayor, after a public hearing, for non-compliance with these minimum requirements. Section IV. SUPERSEDING EFFECT. All Local Laws, resolutions, rules, regulations and other enactments of the Village of Cayuga Heights in conflict with the provisions of this Local Law are hereby superseded to the extent necessary to give this Local Law full force and effect. Section V. VALIDITY. The invalidity of any provision of this Local Law shall not affect the validity of any other provision of this Local Law that can be given effect without such invalid provision. V2 5.19.11 Section VI. EFFECTIVE DATE. This Local Law shall be effective as of the date of filing with the New York Secretary of State.
