Mayor Supron called the meeting to order at 7:04 PM
Privilege of the Floor
Mayor Supron - we have a time limit during the privilege of the floor of two minutes per person with a
total of 30 minutes – there is a new timer that will be used, we ask that the Village of Cayuga Heights
residents be allowed to speak first with any extra time going to the general public.
E. Kuniholm – in support of the culling the deer and the giving the meat to a food bank.
M. Tabacchi – not in support of culling. This will open the area for other deer to move in. The
Tompkins County Health dept does not show any higher level of Lyme disease.
G. Tabacchi – still waiting for an answer to questions asked prior, such as how many deer are in the
Village? Is this a permanent solution to reducing the population? Is this a guarantee? Is this a reliable
and repeatable solution? Would these monies be better spent on the construction of speed bumps
instead?
D. Naydich – Has been a resident for 10 years and believes fencing is the best way to control the deer.
Asked the question why not try using other means then netting and bolting.
S. Grubb – along with Elizabeth Mount and other concerned Village residents have been working to
provide the Trustees with a proposal to amend the current Fencing ordinance (see handout at end of
minutes and a statement).
R. Bors – is in support of the culling. He has spoken with many people in the Village who are also in
agreement.
E. Mount – along with Sally Grubb and other concerned Village residents have been working to provide
the Trustees with a proposal to amend the current Fencing ordinance. She would like to see fencing
allowed in protecting people’s gardens in their front yard.
B. Eden - recently appointed to the Tompkins County Environmental Management Council and is
available for consultation. Stream set back is important related to storm water management.
M. Mindlin – Thanked the Village of Cayuga Heights for working with Mr. Ciaschi and repairing the
pedestrian sidewalk. Also would like to see a forum set up for the upcoming Village elections.
I. Naydich – has been a resident for 20 years and believes fencing is the best way to handle the
destruction from the deer. The net and bolt method is an inhuman way to kill deer.

C. Temple – does not want to see the deer killed, but doesn’t share the point of view supporting culling.
There has to be a way for humans and deer to interact with each other – create a structure or system
whether it is by updating fencing and zoning.
S. Teel – he used to be a Cayuga Heights resident. He has spoken to people both in and outside of
Cayuga Heights and they are all against the proposed deer control. He spoke about using the PZP
vaccine for deer population control. There needs to be a compromise. (see statement at end of minutes)
J. LaVeck – Read from statement from Dr. Richard Ostfeld, Senior Scientist at the Cary Institute of
Ecosystem Studies, Millbrook, NY. (see attached statement at end of minutes)
L. Garner – is a Village of Lansing resident and has read the DEIS report. There has to be something
else other than deer remediation. He made reference to President Bush and his search for weapons of
mass destruction.
Mayor Supron closed Privilege of the Floor approximately 7:37pm.
Report of the Fire Chief – currently has no pictures of the new truck. Also, has no other comment
from what was submitted in writing to the Board.
Report of the Asst. Supt. of Public Works – salt usage is currently at 200 ton, will be ordering another
200 ton shortly, however will be under budget.

A resolution #6776 to approve the minutes of December 13, 2010 as submitted, with amendments
made prior to tonight’s meeting by Attorney Marcus, Mayor Supron, and Trustee Szekely.

Report of the Mayor
There is a proposed Local Law amendment to the Senior Citizens Exemption limits and a need to
schedule a public hearing for the February 14th meeting.
Motion: Trustee Andolina
Second: Trustee Hamilton
To pass resolution #6777 to schedule a Public Hearing for proposed Local Law “C” at the next
Board of Trustee meeting, February 14th, to begin at 7:00 pm.

The next proposed Local Law is to establish a tax exemption for Disabled Persons with Limited
Incomes and a need to schedule a public hearing for the February 14th meeting.

To pass a resolution #6778 to schedule a Public Hearing for proposed Local Law “D” at the next
Board of Trustee meeting, February 14th, the time to begin will follow the previous Public
Hearing.
Discussion: the limits for the Disability exemption will be consistent with the limits noted for the Senior
Citizen exemption.

Next Item: Completion of the EIS study. The Tim Miller Associates group is working with the
comments collected on the draft EIS. They have indicated they are about one month away from
completion. If they do not finish by the Feb 14th Board of Trustee meeting, it will be shortly there after.
Next Item: It is noted that the Deputy Clerk position is still vacant and no decision will be made at this
meeting.
Next Item: TCAT –Mayor Supron and Trustee Riesman were part of a mediation meeting with dispute
resolution center – currently the proceedings are not available for public discussion but the session was
successful and updates will be made available.
Next Item: Proposed Local Law “A” amending Section 9 of the Village of Cayuga Heights Zoning
Ordinance to permit deer fences.
Discussion: Mayor Supron it was important to have all the Trustees review this proposal. There was a
suggestion to remove the word “Deer” from the document and instead make it just “Fences” in general.

Another item discussed were “exclosure fencing”, fencing surrounding specific plantings to
serve as protection. These types of fencing are used to protect the growth of the planting over several
years.
There was a suggestion to change or eliminate the “temporary” fencing from the original
proposed document in August 2010.
The Board discussed including some of the same wording as seen in the Town of Ithaca
document provided by S. Grubb and E. Mount.
Trustee Riesman continues to favor “temporary” versus “permanence” of fencing.
Trustee Andolina indicated the document should guard against the use of the florescent orange
and green fencing that is available. Perhaps adding a limitation of colors to the document would be best.
It was agreed to have the attorney redraft the proposed local to incorporate the Board’s
comments, and then to discuss the revised draft of this proposed Local Law “A” at the February 14th
meeting.
Report of the Police Chief
The mini 14’s have been sold and the check as been deposited into the Village’s General Fund.
The part-time police clerk has resigned and Chief Boyce would like a resolution to allow the hiring of a
replacement by the next Board meeting.

To pass a resolution #6779 authorize a canvas of prior applicants or if needed; to open a new
search to replace the part-time police clerk.
Discussion: Chief Boyce would like to have the new part-time police clerk by February.

Report of the Superintendent of Public Works
The SPW would like to discuss the proposed Local Law “E” Amending Article 12, Sewer Rents,
of the Village of Cayuga Heights Articles and to schedule a Public Hearing at the February 14th Board of
Trustee meeting.
The term “Sewer Rents’ is used by municipalities as a way to recover expenses incurred from the
users of the system. The outside (of the Village) client contracts are being reviewed and rewritten.

To pass a resolution #6780 to schedule a Public Hearing for proposed Local Law “E” at the next
Board of Trustee meeting, February 14th, the time to begin will follow the previous Public
Hearing.
Discussion – this proposed local law is SEQR exempt as indicated by Attorney Marcus.

Trustee Riesman has indicated that the Zoning Board of Appeals has a hearing on an interpretation
requested concerning the permitted location of sheds scheduled for January 24th and she would like to
schedule a Public Hearing and a vote at a Special Board of Trustee meeting on January 20th at 9:00 am
for the Local Law “B” Establishing an exemption for portable sheds from the Zoning Permit
Requirements of Section 20 of the Village of Cayuga Heights Zoning Ordinance.

Next Item: the property at 825 Hanshaw Rd is in need of roof repairs. SPW Cross has received a quote
of $1050 labor for building the roof extension; $1200 labor to create a sloped roof over the porch area
and $825 for materials for a total of $3075.

Discussion – the question was asked when this was to take place because of the inclement weather; SPW
Cross indicated this would could take place at any time, weather permitting. It was discussed that a time
frame would have to be given.
To pass a resolution #6783 authorizing roof construction and repairs to 825 Hanshaw Rd to begin
work as weather permits and completed within deadline determined by Superintendent Cross and
not to exceed $3,075 in cost.

Next Item: Village Forrester, Andre Bensadoun’s action plan regarding the emerald ash borer.
Mr. Bensadoun has indicated there are approximately 108 trees owned by the Village of Cayuga
Heights susceptible to the beetle. He advises identification of the 2/3 of the Village’s ash trees in the
best condition for injection and girdling the other third in an effort to attract the beetles to these weaker
trees. He has indicated that the sooner the injections are started the better for the health of the trees.
Trustee Szekely offered to work with Sarah Hatcher, editor of the Courier, to provide an article and
pictures of a large tree being recently taken down on a private property in the Village as a prophylactic
measure.

To pass a resolution #6784 authorizing expenditures be used from Contingency Funds for 2/3rd of
the 108 trees not to exceed $5,000.

Trustee Riesman will contact the City of Ithaca and the Town of Ithaca to see what measures they are
taking with the emerald ash borer.
Next Item: as a note of interest, Superintendent Cross indicated the Tompkins County Hanshaw Rd
project will be holding a meeting on January 19th to provide an update on the County’s planned changes
to Hanshaw Road..
Report of the Clerk
Bids for the Durango have been opened and a dealer in Chicago, Asia Motors Inc won the bid for
$6379. They have been notified and given information on how to proceed.
The Board of Elections needs a resolution from this Board to relocate the Village Polling place
from Marcham Hall to Kendal for the March 2011 elections.

beginning with the March 15th 2011 election.

Treasurer Silber announced receiving a gift of 33 shares of Johnson & Johnson stock in
December 2010 in support of activities for the Cayuga Heights Fire Department.
The Budget season has begun and Treasurer Silber has sent the Department heads the annual
paperwork to be returned to Treasurer Silber; as well as any suggestions.
Treasurer Silber is working on catching up the monthly billings, and asked if there were any
questions regarding the Abstract or Supplemental Abstract.

Report of the Village Attorney – nothing to report
Mayor Supron opened the meeting to Trustee Privilege of the Floor. Having no response Mayor Supron
closed Privilege of the Floor at 9:45 PM.
Mayor Supron called a five minute break with notice that the Board for a motion to enter into executive
session to discuss personnel issues afterward.
