This Positive Declaration has been frepared in accordance with Article 8 of the New York State
.Environmental Conservation Law.
1. The Village of Cayr-rga Heilhts, 836 Hanshaw Road,Ithaca, New York 14850, is the lead
agency for the referenced mafter. Additional information poncerning this matter can be obtained from the'VillageClerk,NomaManning, attheVillagp Offices, 836 Hanshaw Road,Ithaca,NewYork 14850 ,(607)
257-1238" The proposed action consists of {he Village undertaking a deer population control program as
described in the Environmental Assessment Form ("EAF:') a copy of which is attached hereto and made
a part hereof. This proposed action has been classified as an Unlisted Action under the SEQR regulations.
'Ihis proposed action would occur at variou$ locations in nhe Village of Cayuga Heights, as described in
the attached EAF.
2. It is hereby determined by tfr{ Board of Trustees of the Village of Cayuga Heights, pursuant
to Section 617 .7 of the SEQR regulations, th,at the proposod action may have a significant effect upon the
environment (a) by causing a reduction in t$e population of deer within said Village of Cayuga Heights
by approximately 150 deer, and (b) as a result of the pulblic controversy related to this environmental
impact, and therefore requires the preparatidn of an Environmental Impact Statement. The details of this
proposed action, together with the analysi$ of relevant areas of environmental concern and reasoned
elaboration of this determination, are set forfh in the EAF bttached hereto, and the various attachments to
said'IiAL GivOn the extent of the review {nd detail provided in the EAF, and the results of the public
lrearirrg conducted by the Village on Octoberf 28,2009 in connection with such review, scoping, provided
as an option in accordance with Section 611.8 of the SEQR regulations, will not be conducted.
3. It is hereby firrther determided that the following agencies are or will be involved in the
proposed action:
a. New York State Department of Environmental Conservation.
b. Board of Trustees o{tne Village qf Cayuga Heights.

5. The Village of Cayuga Heigl-{,ts is hereby required to prepare a Draft Environmental Impact
fitatement pursuant to the provisions of Seclion 611 .7(a) . (c) of tlie SEQR regulations.

the Department of City and Regional P ing field fuorkshop program for the Spring 2010
semester. The Village will serve.as a cl t,eornmunigr for students in the.c.ourse to apply
specific land use planning and communi developmbnt analytical tools and policy approaches to
assist the Village in preparing a new co hensive plan.
In exchange for the assistance to be pro by the field workshop, the Village of Cayuga
Ileishts will contribute to the of City and Regional Planning the sum of $ 12,500 to
partially support the field workshop and pffset some pf the direct costs associated with the field
workshop. The above sum does not inclbde compendation to Comell University for any indirect

1. This Memorandum of Understanding shall become effective on the date hereof and

from a variety ofsources including federal, state and county-held statistical data
and analysis of population and other socioebonomic trends;
b. A set of GiS maps showing the existing lan]d use patterns, transportation systems,

sensitive or ecologically important assets;
c. A historical sketch of village dbvelopment pnd analysis of trends in land use and
