Boyce, Supt. Cross, Attorney Tyler Absent: Treasurer Silber, Chief Lansing, Fire Supt. Tamborelle, Asst. Supt. Frisbie, Others: John Henderson, Yolanda Tovar, Sarah and Allen Hatcher, Lee Donner, Paul Bensadoun At 7:00 P.M. Mayor Lynn opened the August meeting of the Board of Trustees. The June and July minutes were presented and discussed. Minor corrections were noted. . Motion by Trustee Antil Seconded by Trustee Kaplan Move to approve the Minutes of June 18, 2007. Trustees Antil, Bisogni, Collyer, Kaplan, Mount and Staley voted YES. Motion by Trustee Mount Seconded by Trustee Antil Move to approve the Minutes of July 16, 2007. Trustees Antil, Bisogni, Collyer, Kaplan, Mount and Staley voted YES. *********************************************************************** Privilege of the Floor – Paul Bensadoun, a Village resident, addressed the Board regarding light glare control. He asked the Board to consider enacting a light control law similar to the law recently enacted in the City of Ithaca. The Mayor said that the Board will review local laws of neighboring municipalities on this issue and discuss it further at another meeting. *********************************************************************** Report of the Police Chief – Chief Lansing was absent, Sgt. Boyce presented the Police report. Trustee Bisogni discussed the dog ordinance with Sgt. Boyce as it pertained to a specific issue in last month’s report. *********************************************************************** Report of the Fire Supt. - Supt. Tamborelle was not in attendance but his report was presented and is on file. *********************************************************************** 2 Report of the Ass’t. Supt. of Public Works- Ass’t. Supt. Frisbie was not in attendance but his report was presented and is on file. Trustee Collyer asked about the painting of hydrant caps. Supt. Cross said that the Fire Dept. would do this if it was done in the Village. The Sheldon Road water tank has been out of commission for painting and refurbishment but is beginning to be refilled at this time. Some pressure gauges mounted on hydrants around the Village should be removed as the tank gets refilled and back on line. *********************************************************************** Report of the Supt. of Public Works – Supt. Cross explained the proposed changes in the D.P.W. to the Trustees - Jeff Frisbie is the Ass’t. Supt. of Public Works, moving from Village Mechanic, Jeff Ellis is a Sr. Motor Equipment Operator (MEO) with mechanic duties, and Tim Eighmey is moving to a Sr. MEO with safety duties. The Village has to add a position to its roster in able to accommodate these changes. Motion by Trustee Antil Seconded by Trustee Mount Move to pass Resolution 6276 approving the addition of a Senior Motor Equipment Operator position to the Village of Cayuga Heights roster of job titles. Trustees Antil, Bisogni, Collyer, Kaplan, Mount and Staley voted YES ************************** Motion by Trustee Bisogni Seconded by Trustee Antil Move to pass Resolution 6277 promoting Tim Eighmey to Sr. MEO as follows: Whereas, the Department of Public Works has a Senior Motor Equipment Operator (Sr. MEO) position open; and Whereas, Timothy Eighmey has been employed with the Village of Cayuga Heights as an MEO since November 2006, Whereas, Jeff Frisbie, Ass’t. Supt. Of Public Works has recommended Timothy Eighmey for this position; Therefore, be it resolved that Timothy Eighmey be promoted to the position of Senior MEO effective August 21, 2007 at the rate of $19.28/hour. Trustees Antil, Bisogni, Collyer, Kaplan, Mount and Staley voted YES Supt. Cross presented an update on the road projects – Since June 1, paving has been done on Tyler and Simsbury Roads. Work began this date on Northway and E. Upland Roads, and Highland Park Lane. Other paving projects will be discussed after these projects are finished. It would be ideal to have money left in the spring for projects. *********************************************************************** Report of the Mayor – As promised in the recent issue of the Courier, Mayor Lynn presented a draft plan of a proposed change to Section 9 of the Village of Cayuga Heights 3 Fence Ordinance. Attorney Tyler had submitted an alternative draft for consideration. After the proposed changes are discussed, a public hearing will be scheduled. There was much and long discussion among the Trustees about this proposed change and the language of the proposed law. Based on the discussion, the Mayor requested Trustee Mount and Attorney Tyler draft another proposal to be distributed at the September Trustee meeting. At that time, if all the Trustees agree to the wording, a public hearing will be scheduled. Lee Donner, a Village resident, expressed her appreciation with the time and effort that the Village is putting forth in trying to accommodate fences to keep the deer out of yards, however, the deer issue is not going to go away and the Village needs to keep vigilant in trying to attack the problem. Mayor Lynn reiterated that the Village really can not do much in the way of getting rid of the deer, although much time and effort have been devoted to the problem in recent years. Mayor Lynn presented a resolution thanking David Call for his time as the Village forester. Motion by Trustee Antil Seconded by Trustee Kaplan Move to pass Resolution 6278 expressing the gratitude and appreciation of the Village of Cayuga Heights to David Lincoln Call for his contributions as Forester for the Village of Cayuga Heights. In performing this responsibility, he not only responded to questions and concerns of Village residents, but helped to initiate a more dynamic role for the Village in establishing a program for replacement of trees lost to storms, disease and age. Trustees Antil, Bisogni, Collyer, Kaplan, Mount and Staley voted YES The Mayor also reported that Andre Bensadoun will replace David Call as Forester. *********************************************************************** Report of the Treasurer – Treasurer Silber was absent, but his report was presented and is on file. There were no transfers this month. Motion by Trustee Bisogni Seconded by Trustee Antil Motion to pass Resolution 6279 approving the Abstract of Audited Vouchers dated 8/20/07 in the amount of $241,991.72, and instruct that the Treasurer make payments thereon. Trustees Antil, Bisogni, Collyer, Kaplan, Mount and Staley voted YES *********************************************************************** Report of the Attorney – Attorney Tyler reported on the following: 4 The consent order for the Phosphorous Treatment System installation at the WWTP has been received by the Village of Cayuga Heights and signed by the Mayor. Regarding the nuisance situation at the property at 518 Wyckoff Road, a letter was written to the homeowner by Attorney Tyler. The nuisance situation is logs that were placed in the stream behind the homeowner’s house. The pile has continued to grow, creating a dam in the stream and potential risk to downstream residents and village infrastructure. Supt. Cross tried to get the DEC involved, to no avail. Attorney Tyler’s letter gave an August 10 deadline for the homeowner to remove the logs, or the Village would remove them at the homeowner’s expense. The Village will need to get permission from the fraternity next door to the homeowner for access to the stream. A discussion ensued about the matter of trespassing on the homeowner’s property. Supt. Cross will send a final letter to the homeowner confirming legal authorization of the Village to enter the property and an estimate of the cost of the removal of the logs. Motion by Trustee Antil Seconded by Trustee Mount Motion to pass Resolution 6280 authorizing the D.P.W. to remove debris from 518 Wyckoff Road as per the July 20 letter to the homeowner from Attorney David Tyler. Trustees Antil, Bisogni, Collyer, Kaplan, Mount and Staley voted YES The Village has received a complaint by Betty Muka regarding a court matter. The Clerk will send the document letter to Olver Insurance, the Village’s insurance company. The Wadach project on drainage is approaching a final conclusion. Trustee Bisogni will confirm with the landowner her preferred solution of the alternatives offered.. *********************************************************************** Report of the Clerk – The Clerk will be attending the NYCOM Conference in Saratoga Springs September 18-20. The bid for the 2004 Chevrolet, ID# 2G1WF52K449266422 was accepted for $4575.00 *********************************************************************** Mayor Lynn commented that residents are needed to fill committee spots. If you know of anyone who would like to serve on a committee, let him know. Trustee Mount commented that the last newsletter with color photos was well received. There has been no news on the ongoing Verizon issue. Motion by Trustee Antil Seconded by Trustee Bisogni Move to adjourn meeting at 9:12 PM.
