Item 1 – Meeting called to order
· Chair M. Harms opened the meeting at 7:02 pm.
Item 2- October 28, 2013 Minutes

RESOLUTION No. 121
APPROVING MINUTES OF OCTOBER 28, 2013
RESOLVE, that the written, reviewed and revised minutes of the October 28, 2013 meeting
are hereby approved.

Opposed- None
Item 3- Public Comment
· No members of the general public wished to comment.
Item 4- 207 Kelvin Place addition site plan review
· Code Enforcement Officer B. Cross discussed his research findings regarding the
Cornell Historical District. He determined that neither the Board nor the property
owner was under any obligation to obtain approval from another agency unless State
or Federal funds are being used on the project. Mr. Cross also confirmed that no
local law is in place that provides for review of a project in a historic district, as is the
case in the City of Ithaca.

· The project seeks to renovate a current garage into an apartment and to add a second
story.
· The property owner and project designer provided a power point presentation.
· Code Enforcement Officer B. Cross provided his thoughts from a Zoning Officer
perspective.
· Board members asked the property owner questions regarding the project.
· Attorney R. Marcus informed the Board the project could be categorized as an
unlisted SEQR action and the property owner should complete Part 1 of the Short
Environmental Assessment Form.

RESOLUTION No. 122
ACCEPT PROJECT AT 207 KELVIN PLACE AS AN UNLISTED SEQR ACTION
RESOLVE, that the project proposal at 207 Kelvin Place is categorized as an unlisted SEQR
action and the property owner is to complete Part 1 of the Short Environmental Assessment
Form.

RESOLUTION No. 123
TO HOLD A PUBLIC HEARING ON THE PROJECT AT 207 KELVIN PLACE
RESOLVE, that a public hearing will be held on January 27, 2013 at 7:10pm regarding the
site plan review for the proposed project at 207 Kelvin Place.
Aye votes – Chair M. Harms, S. Cunningham, F. Cowett, G. Gillespie, and R. Segelken
Opposed- None
· Code Enforcement Officer B. Cross will forward the project proposal to Tompkins
County for their 239 review.
Item 5- Cornell Child Care Center site plan review modification
· Tami Johnson, Patty Sinclair, and Michelle Artibee spoke to the Board regarding their
request to increase the center’s occupancy from 158 to 180 children.

· Attorney R. Marcus informed the Board the project could be categorized as an
unlisted SEQR action or a Type 2 Action and would be exempt from SEQR review
referencing section 617.5(c)(7)

RESOLUTION No. 124
TO CATEGORIZE THE CORNELL CHILD CARE CENTER CHANGE IN OCCUPANCY
RESOLVE, that the change in occupancy at the Cornell Child Care Center is categorized as a
Type 2 Action and is exempt from SEQR review under section 617.5(c)(7)

RESOLUTION No. 125
TO SCHEDULE A PUBLIC HEARING FOR THE CORNELL CHILD CARE CENTER
CHANGE IN OCCUPANCY
RESOLVE, that a public hearing will be held on January 27, 2013 at 7:15pm regarding the
Cornell Child Care Center’s change in occupancy site plan review.
Aye votes – Chair M. Harms, S. Cunningham, F. Cowett, G. Gillespie, and R. Segelken
Opposed- None
Item 6- 219 Kelvin Place change of occupancy consideration
· Code Enforcement Officer B. Cross gave an overview of the property and current
occupancy.
· Attorney R. Marcus disclosed he previously represented the property owner on
unrelated matters.
· The property owner requests a change in occupancy from a 2 family residence to a 3
family.
· The property originally was built as a 3 family residence. The owner proposes to add
a stairway to provide a separate means of access to the third unit.
· Attorney R. Marcus gave the Board his opinion that the proposal would be
categorized as a change of use that requires a site plan review under the Village’s
Zoning Law.
· Code Enforcement Officer B. Cross explained that from a Zoning Officer perspective,
a site plan review is not required for the change in occupancy.

RESOLUTION No. 126
A SITE PLAN REVIEW IS NOT REQUIRED FOR A CHANGE IN OCCUPANCY AT 219
KELVIN PLACE
RESOLVE, that a site plan review is not required for a change in occupancy from a 2 family
residence to a 3 family residence at 219 Kelvin Place.
Aye votes – Chair M. Harms, F. Cowett, G. Gillespie, and R. Segelken

Item 7- Comprehensive Planà SEQR Full Environmental Assessment Form
· The Board reviewed and completed Part 1 of the SEQR Full Environmental
Assessment Form.

Second: G. Gillespie
RESOLUTION No. 127
TO RECOMMEND THE RESPONSES ON THE SEQR FULL ENVIORNMENTAL
ASSESSMENT FORM TO THE BOARD OF TRUSTEES.
RESOLVE, that the Planning Board recommends the responses as entered on Part 1 of the
SEQR Full Environmental Assessment Form to the Board of Trustees.
