The intent of thisproposed local law is to provide additional terms to the exception to Article 1, Section 2 of theVillage's Articles, entitled, "Firearms and other Dangerous Weapons,,, The existing exception toArticle 1, section 2 was added by Local Law 1 of 2012. This exception provides that agents orcontractors of the Village are permitted to carry and to discharge firearms, bows or otherinstruments if such actions are taken in connection with the Village's deer management planand are taken in accordance with the stated conditions. The additional terms to be added byProposed Local Law A of 2074 would provide that landowners in the Village would have theability to manage deer on their property provided that they comply with the stated conditionsfor taking such actions. The ability for landowners to manage deer on their property would affect environmental resources in the Village as follows. Reference should be made to the Draft Environmentallmpact statement (the "DEls"), the Final Environmental lmpact statement (the .FEls") and theFindings Statement (the "FS") prepared by the Village of Cayuga Heights for the Village,s DeerManagement Plan (the "DMP"), which materials are incorporated herein by reference. Thepossibility that landowners would take action under the proposed terms would have the directeffect of reducing the deer population in the Village, This result would provide benefits toenvironmental resources in the Village by, among other benefits, promoting biodiversity andwoodland regeneration' As stated in the DEls, high densities of deer negatively affect trees,shrubs, herbaceous plans, birds and small mammals, largely as a consequ"n." of foraging bydeer that results in certain species no longer being able io ,"g.n.r.te. As detailed in the DEls,overpopulation of deer causes the destruction of the forest understory and results in theecosystem being substantially compromised. As noted therein, a deer population above 10 per square mile has been cited as undesirable for the foregoing reasons. The Village,s recent deerpopulation study indicates a population of approximately 125 deer per square mile. TheVillage's adoption of the proposed amendment to the Village's laws, enabling the possibility thatlandowners may manage deer on their property, would assist in addressing these environmental concerns.
