Proposed Local Law A of the year 2014
A LOCAL LAW AMENDII.{(} ARTICLE I,
FIREARMS AND OTHER DANGIIROUS WEAPONS,
OF THE VILLAGE OF CAYUGA HEIGHTS ARTICLES,
AS PREVIOUSLY AMENDED BY LOCAL LAW 1 OF 2OI2
Be it enacted by the Board of Trustees of the Village of Cayuga Heights as follows:
SECTION I PURPOSE AND INTENT
The purpose of this local law is to amend Article I, Firearms and other Dangerous weapons, of theVillage of Cayuga Heights Articles, as previously amended by Local Law 1 of 20I2.The intention of thisLocal Larl is to provide additional aetait and tirms to the exeeption to Article I, section 2 for actionstaken in fuitherance of the village's deer management program , and to include actions taken bylandowners in connection with -unug.-.nt of deer on their pfoperty.
SECTION II AUTHORITY
This Local Law is enacted pursuant to the gr ocal go

affairs, government or other subjects provided for in n 10 of
SECTION III AMENDMENT OF' ARTICLE I.
As of the effective date of this Local Law, Article I, Firearms and other Dangerous weapons, of theVillage's Articles, as previously amended by Local Law 7 of 2}l2,shall be amended by deleting Section2 in its entirety and replacing it with the following language:
SECTION 2
It is prohibited within_in the village of cayuga Heights for any person to carry a frearm,shotgun, rifle,air gun, any bow or other instrumetrt that can dischaige a projectile, when loaded, except in the course of
Cayuga Heights for any person to discharge, or cause
any bow or other instrument that can discharse a
1f-defense.
The provisions of this Article I, Section 2 shallnot apply to actions taken in furtherancewith or to achieve the_ goals of the Village's deer management program, provided that
aken in accordance with the following terms:
A' Such actions may be taken by any agent or contractor of the Village of Cayuga Heights, providedthat the agent or contractor takes such actions in accordanee with:i' a cunently valid contract executed by the Village and such agent or contractor; andii' a currently valid New York State Department of Environmlntal Conservation permit for
such actions; and

iii' all applicable New York State laws and reguJations, including the requirements of NewYork State Environmental Conservation Law Section 11-0931, including as such Sectionmay be amended hereafter,
B' Such actionu^.?y be taken by a landowner or group of landowners, or the agents, contractors oremployees of a landowner or group of landownirs, provided that the such p.iron or persons takesuch actions in accordance with the followins terms:i' Such actions are taken on the laidowner'r; property or the group of landowners,properties.
ii' Prior to taking such actions, the landowner has, or group of landowners have, delivered tothe Village of Cayuga Heights Police Department a ropy of each of the following items:a' a curently valid New York State Department of Environmental Coiservation( to Take or Harass Nuisance or Destructive Wildlife (sometimesr Damage Permit", the "Permit") for taking the intended actions, orS 3s NYSDEC may issue in the future for such purposes;b' written confirmation, in form satisfactory to the Village, of the agreement of anylandowner necessary to comply with the discharge requiements of New york StateEnvironmental Conservation Law Section 1 1_0931;
such actions are to be taken, indicating the location(s) atwhic , and showing the location of any structure referenced in

statement of the dates and times at which such action is to be taken.iii' Such actions are taken in accordance with the NYSDEC permit and all applicable NewYork State laws and regulations, including the requirements of New york StateEnvironmental Conservation Law Section tf-Og:l, including as such Section may be
amended hereafter.iv' The person(s) authorized by the Permit to take such actions shall use only compound bowor crossbow equipment, shall discharge such bow only in a downward direction from atree stand, platform or other sttucture the floor of which is not less than twelve (12) feet
above the grade below such floor, and such person shall retrieve any arrow discharged.v' In the event that suoh discharge results in the wounding of a deer, and that deer m6ves offof the Permit holder's property, the person(s) authorized to take such actions shalla. prior to entering _such other property obtain permission from the other property
owner to do so. If unable to obtain such permission, the person(s) authorized to
take such actions must notify the cayuga Heights police Department; andb. relocate the carcass of the deer onto- the Pirmit holder's property, unless such
person has received permission from the other properly owner to process the deer
carcass on the other property owner,s property.vi' Notwithstanding the foregoing terms of this subsection B, in the event that New york
State Environmental Conservation Law Section 11-0931 is hereafter.amended to reducethe 500 foot setback requirements of said Section 11-0931, then the 500 foot setback
requirements of said Section 11-093i as of the date of this Local Law will continue togovern any action taken under this subsection B.
The terms of these exceptions shall not amend, modifu, alter or change any term or provision of thisLocal Law other than as expressly set forth in these .*r*ptionr.

. SECTION IV SUPERSEDING EFFECT
A11 Local Laws, resolutions, tl19l, regulations and other enactments of the village of Cayuga Heights inconflict with the provisions of this Local Law are hereby superseded to the extent necessary to give thisLocal Law fullforce and effect.
SECTION V VALIDITY
The invalidity of any provision of this Local Law shall not affect the validity of any other provision ofthis Local Law that can be given effect without such invalid provision.
SECTION VI EFF'ECTIVE DATE
This Local Law shall be effective as of the date of filing with the New york secretary of State, exceptthat it shall be effective from the date of service as again"st a person served with a copy thereof certifiedby the village clerk, and showing the date orits passli.
