ATTENDANCE: PRESENT: Supervisor- Liz Thomas 1St Deputy Supervisor- Nancy Zahler 2"d Deputy Supervisor- Michelle Wright Board members- Michael Boggs, Rich Goldman, John Hertzler Town Clerk- Carissa Parlato OTHERS PRESENT: Janice Johnson from Tompkins County Youth Services (7-7:40pm), Bill Davis & Matt McKenna from MRB CALL TO ORDER: Ms. Thomas called the meeting to order at 7 p.m. PRESENTATION: Tompkins County Recreation Partnership Ms. Johnson presented a Power Point on the Recreation Partnership. Board members asked questions. GENERAL BUSINESS: APPROVAL OF MEETING AGENDA RESOLUTION 2016-118: APPROVAL OF MEETING AGENDA BE IT RESOLVED that the Ulysses Town Board approve the agenda for June 28, 2016 with the addition of an executive session to discuss the promotion of a person and the purchase of real property. Moved: Ms. Thomas Seconded: Ms. Zahler Ms. Thomas aye Ms. Zahler aye Mr. Hertzler aye Mr. Boggs aye Mr. Goldman aye Vote: 5-0 Date Adopted: 6/28/16 PRIVILEGE OF THE FLOOR: (none) GENERAL ANNOUNCEMENTS: Ms. Zahler announced that there has been discussion among town residents regarding the proposed dock at Taughannock Park. She suggested that the town consider hosting a forum on the issue. Ms. Thomas gave an update on the meeting she recently attended regarding this issue and shared the options that the town board has for offering their input. OLD BUSINESS: Mr. McKenna and Mr. Davis answered questions about funding options for Water District 3. The group also discussed updates on trihalomethane remediation options. Mr. Davis gave an update on connecting to the village's water main on Falls Road. The next step is creation of a Map, Plan & Report to determine costs and a timeline. NEW BUSINESS: APPOINT PLANNING BOARD ALTERNATE RESOLUTION 2016-119: APPROVAL OF MEETING AGENDA RESOLVED that the Town of Ulysses Town Board appoints Ben LeWalter as the alternate for the Planning Board through Dec. 2016. Moved: Ms. Zahler Ms. Thomas aye Ms. Zahler aye Mr. Hertzler aye Mr. Boggs aye Mr. Goldman aye Vote: 5-0 Date Adopted: 6/28/16 Seconded: Mr. Goldman INTERMUNICIPAL AGREEMENT WITH TRUMANSBURG FOR SHARED EMPLOYEE RESOLUTION 2016-120: INTERMUNICIPAL AGREEMENT WITH TRUMANSBURG FOR SHARED EMPLOYEE RESOLVED the Town Board of the Town of Ulysses authorizes the Town Supervisor to sign the intermunicipal agreement with the Village of Trumansburg to share the cost of health insurance for a Shared Employee as defined in the Town of Ulysses Personnel Policy. Moved: Ms. Thomas Ms. Thomas aye Ms. Zahler aye Mr. Hertzler aye Mr. Boggs aye Seconded: Ms. Zahler 2 Mr. Goldman aye Vote: 5-0 Date Adopted: 6/28/16 ADOPTION OF LOCAL LAW #1 OF 2016: RESOLUTION 2016-121: ADOPTING LOCAL LAW #1 OF 2016- A LOCAL LAW TO AMEND CHAPTER 80 OF THE CODE OF THE TOWN OF ULYSSES ("THE CODE"), WHICH PROVIDES FOR THE ADMINISTRATION AND ENFORCEMENT OF THE NEW YORK STATE UNIFORM FIRE PREVENTION AND BUILDING CODE, THE NEW YORK STATE ENERGY CONSERVATION CONSTRUCTION CODE AND THE PROPERTY MAINTENANCE CODE OF NEW YORK. WHEREAS the Town of Ulysses previously adopted Local Law #1 of 2007 and Local Law # 5 of 2014 to enforce provisions of the New York State Uniform Fire Prevention and Building Code; and WHEREAS, the Town Board seeks to clarify all the codes that are subject to enforcement by the Town, and to modify the penalties for failure to comply; and WHEREAS the final version of this law was presented to the Ulysses Town Board on June 9, 2016 and introduced at a Town Board meeting on June 14, 2016; and WHEREAS the public hearing date was set by resolution of the Town Board on June 14, 2016 to be held on June 28, 2016; and WHEREAS notice of the public hearing was published in the Ithaca Journal on June 22, 2016 and posted as required by law; and WHEREAS a public hearing was held on June 28, 2016; NOW, THEREFORE, BE IT RESOLVED that the Ulysses Town Board hereby adopts Local Law #1 of 2016: A Local Law to Amend Chapter 80 of the Code of the Town of Ulysses ("the Code"), which provides for the Administration and Enforcement of the New York State Uniform Fire Prevention and Building Code, the New York State Energy Conservation Construction Code and the Property Maintenance Code of New York. PRIVILEGE OF THE FLOOR: (none) MONTHLY BUSINESS APPROVAL OF MINUTES RESOLUTION 2016-122: APPROVAL OF MINUTES: 6/14 BE IT RESOLVED that the Ulysses Town Board approve the minutes of 6/14 as amended by Ms. Zahler. Moved: Ms. Thomas Ms. Thomas aye Ms. Zahler aye Mr. Hertzler aye Mr. Boggs aye Mr. Goldman aye Vote: 5-0 Date Adopted: 6/28/16 Seconded: Mr. Goldman EXECUTIVE SESSION: Ms. Thomas made a motion to move into Executive Session at 9:37pm for the purpose of discussing the employment history and matters leading to the promotion, demotion, or suspension of a particular person; and discussing possible acquisition of real estate where a public discussion may affect the price or terms. This was seconded by Mr. Zahler and passed unanimously. RESOLUTION 2016-123: SALARY INCREASE FOR CODE ENFORCEMENT OFFICER Ms. Zahler made a motion to increase the salary of Code Enforcement Officer Tom Myers to $22.50/hour based on his performance from the date of hire on January 1, 2016. Moved: Ms. Zahler Ms. Thomas aye Ms. Zahler aye Mr. Hertzler aye Mr. Boggs aye Mr. Goldman aye Seconded: Mr. Goldman F1 Vote: 5-0 Date Adopted: 6/28/16 Ms. Zahler moved to end Executive Session at 10:15pm, seconded by Mr. Goldman and passed unanimously.
