The meeting was held in person at the Town Hall at 10 Elm St., Trumansburg NY as well as via Zoom
videoconference. Notice of Town Board meetings are posted on the Town’s website and Clerk’s board.

Ms. Olson called the meeting to order at 7:01pm.

Mr. Boggs moved to approve the agenda as presented. This was seconded by Mr. Manley and passed

Mr. Boggs moved to open the hearing at 7:03pm. This was seconded by Mr. Manley and passed

Public Comments:
Ms. Rose noted that she pays a lot of money for water in the village. She suggests that user fees be
very clear for budgeting purposes for single homeowners like herself .

unanimously.

Public Comments:
Ms. Rose doesn’t have a prob with overriding the tax cap but wonders what priorities are and what is
essential to daily life and what is not because local folks may not be able to support all of the things.

Ms. Zahler shared the following updates on the JCA’s recent and upcoming plans & activities:

Vivien Rose gave an update on the semiquincentennial and the 250 Years of Freedom. She reported
that she helped organize the following and shared a photo of the first NY reading of the declaration
as well as a photocopy of the document:

RESOLUTION #145 OF 2026: ADOPTING A LOCAL LAW AMENDING CHAPTER 200 OF THE
TOWN CODE AND ADDRESSING RELATED MATTERS
WHEREAS, the Town Board of the Town of Ulysses caused to be prepared and introduced a
proposed local law titled “A LOCAL LAW AMENDING CHAPTER 200 OF THE TOWN CODE” (the
“Local Law”); and
WHEREAS, the Town Board duly scheduled and held a public hearing on the Local Law on
September 8, 2026 at 7 p.m., at which time all persons desiring to be heard were heard; and
WHEREAS, the Town Board has reviewed the Local Law, considered the comments received at
the public hearing, and desires to adopt the Local Law; and
WHEREAS, the Town Board previously determined that adoption of the Local Law constitutes
a Type II Action under the New York State Environmental Quality Review Act and its
implementing regulations at 6 NYCRR Part 617, including 6 NYCRR §§ 617.5(c)(26) and
617.5(c)(33), and therefore no further environmental review is required.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Ulysses hereby
adopts Local Law #3 of 2026, “A LOCAL LAW AMENDING CHAPTER 200 OF THE TOWN CODE”;
and be it further
RESOLVED, that the Town Clerk is hereby authorized and directed to file the Local Law with
the New York State Secretary of State in accordance with the Municipal Home Rule Law; and
be it further
RESOLVED, that the Town Clerk, Town Attorney, and such other Town officers and employees
as may be necessary are hereby authorized and directed to take such additional steps as may
be necessary or appropriate to carry out the intent of this Resolution and effectuate the filing
and implementation of the Local Law.

ADOPTING A LOCAL LAW TO OVERRIDE THE TAX CAP LIMIT FOR 2027
Ms. Olson noted that the Village draft EMS budget is set to have a $100,000 increase to the town.
For perspective, the town could eliminate the Planning/Zoning department and it still wouldn’t cover
the cost.

WHEREAS, notice was given that the Town Board scheduled a public hearing for September 8,
2026 at 7:00 p.m. for Local Law No. 4 of the Year 2026 entitled “A LOCAL LAW TO OVERRIDE
THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW § 3-C”; and
WHEREAS, notice of said public hearing was duly advertised in the official newspaper of the
Town and posted on the Town Clerk’s signboard; and
WHEREAS, said public hearing was duly held on the 8th day of September, 2026 at 7:00 p.m.
and all parties in attendance were permitted an opportunity to speak on behalf of or in
opposition to said proposed Local Law, or any part thereof; and
WHEREAS, pursuant to the State Environmental Quality Review Act, it has been determined
by the Town Board that adoption of the proposed Local Law constitutes a Type II Action as
defined under 6 NYCRR 617.5(c)(26) and (33).
NOW, THEREFORE BE IT RESOLVED that the Town Board of the Town of Ulysses hereby adopts
said local law as Law No. 4 of the Year 2026 entitled “A LOCAL LAW TO OVERRIDE THE TAX
LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW § 3-C”; and it is further
RESOLVED that the Town Clerk be and hereby is directed to enter said Local Law in the
minutes of this meeting and give due notice of the adoption of said Local Law to the Secretary
of State; and it is further
RESOLVED that this resolution will take effect immediately upon filing with the Department of
State.

Vivien Rose pointed out that it is the 174th Anniversary of the Union Horticultural Society who host
the fair. She suggested that the town support the fair as an agricultural celebration and
encouragement of our food system, and offered to write a resolution saying as much.

TOWN OF ULYSSES
LOCAL LAW NO.3 FOR THE YEAR 2026
A LOCAL LAW AMENDING CHAPTER 200 OF THE TOWN CODE
Be it enacted by the Town Board of the Town of Ulysses as follows:
Section 1. Statutory Authority
The Town has authority to adopt this Local Law pursuant to Article IX, § 2(c) of the New York State Constitution;
Municipal Home Rule Law § 10, including but not limited to Municipal Home Rule Law § 10(1)(i) and §
10(1)(ii)(a); and the Town Law of the State of New York, including but not limited to Town Law §198.
Section 2. Amendment of Section 200-4(M)
Section 200-4(M) is amended by replacing said section entirely with the following:
Master meter required. When multiple living units exist on a single parcel, a single master meter shall be installed
measuring all water consumed on the parcel. Upon application by the owner(s) of a parcel, the Town Board may,
in its reasonable discretion and subject to approval by the Water District Operator, authorize at the sole cost and
expense of the owner(s) installation of water meters for each separate living unit in addition to the master meter.
In such event, the owner(s) shall remain directly responsible for payment of all water user fees, rates, rents and
charges as measured by the master meter, even when the Town of Ulysses sends a bill to the person(s) occupying
such living units.
Section 3. Amendment of Section 200-10(A)
Section 200-10(A) is amended by replacing said section entirely with the following:
User fees. User fees shall be assessed to each property within the service area for the purposes of retiring debt and
operation and maintenance. User fees and formulas for determining user fees shall be established in accordance
with New York State Town Law and may be modified from time to time by resolution of the Town Board after
following all procedures required by New York State Town Law. User fees may be included on the tax bills for
each property within the service area, and payment for same shall be made at the same time and at the same place
as specified for other Town charges.
Section 4. Amendment of Section 200-10(C)(1)
Section 200-10(C)(1) is amended by replacing said section entirely with the following:
If there shall be any payments which are due to the Town of Ulysses, or any Department or District thereof,
pursuant to any section of this article, which shall remain due and unpaid, in whole or in part, for a period of 30
calendar days from the date of payment due to the Town of Ulysses, the same shall constitute a default, and there
shall be added to the entire amount of the original bill, a penalty equal as set forth from time to time by resolution
of the Town Board.
Section 5. Remainder
Except as hereinabove amended, the remainder of the Code of the Town of Ulysses shall remain in full force and
effect.
Section 6. Effective Date
This Local Law shall take effect immediately upon filing with the New York Secretary of State in accordance
with Section 27 of the Municipal Home Rule Law.
TOWN OF ULYSSES
LOCAL LAW NO.4 OF THE YEAR 2026
A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL
MUNICIPAL LAW § 3-C
Be it enacted by the Town Board of the Town of Ulysses as follows:
Section 1. Legislative Intent
It is the intent of this local law to override the limit on the amount of real property taxes that may be levied
by the Town of Ulysses pursuant to General Municipal Law § 3-c, and to allow the Town of Ulysses to adopt a
budget for the fiscal year beginning January 1, 2027 and ending December 31, 2027 that requires a real property
tax levy in excess of the “tax levy limit” as defined by General Municipal Law § 3-c.
Section 2. Authority
This local law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly
authorizes the Town Board to override the tax levy limit by the adoption of a local law approved by vote of at
least sixty percent (60%) of the Town Board.
Section 3. Tax Levy Limit Override
The Town Board of the Town of Ulysses, County of Tompkins, is hereby authorized to adopt a budget for
the 2027 fiscal year that requires a real property tax levy in excess of the amount otherwise prescribed in General
Municipal Law § 3-c.
Section 4. Remainder
Except as hereinabove amended, the remainder of the Town Code of the Town of Ulysses shall remain in
full force and effect.
Section 5. Separability
The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, word or
part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstance, such illegality,
invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions,
clauses, sentences, subsections, words, or parts of this local law or their application to other persons or
circumstances. It is hereby declared to be the legislative intent that this local law would have been adopted if
such illegal, invalid, or unconstitutional provision, clause, sentence, subsection, word or part had not been
included therein, and as if such person or circumstance, to which the local law or part thereof is held inapplicable,
had been specifically exempt therefrom.
Section 6. Effective Date
This Local Law shall take effect immediately upon filing with the New York State Secretary of State in
accordance with Section 27 of the Municipal Home Rule Law.

Planning Board
The Planning Board held a meeting on August 4 to discuss the following items:
•The Board conducted final site plan review and approved a proposed accessory structure located at 1282
Taughannock Blvd.
•The Board discussed the proposed Smith Woods CEA and provided comments to the Town Board.

The BZA did not conduct any business this month.

•Ongoing research on code enforcement cases.
•Keith Dodge, 1942 Trumansburg Road (parcel 20.-3-9.22), plead guilty to all violations on July 28, 2026.
The plea deal stated that monthly inspections between the defendant and Code Enforcement would start
August 26, 2026. Staff scheduled monthly meetings in advance with the defendant through the duration of
the plea deal (April 2027). Neither the defendant nor their attorney attended the first monthly inspection.

Greetings Board Members: Below are financial highlights from the August 2026 financial statements.
Balance Sheet
As detailed in the Supervisor’s Report, total cash balances as of 8/31/2026 amounted to $480,164.10, a decrease
of 81,594.09 from the end of July. A few notable items to comment on for this month:
•We redeemed $100,000 from investments to cover expenditures.
•Sales tax payments are coming on a timely basis, having received payments through July as of the end of
August. Sales tax revenue is still running a little over 10% better than budget based on trends thus far in
2026.
•EMS Payments are also now current through July and ambulance charges are currently earned at 68.3%
of the budget. If revenues continue at a consistent pace through the rest of the year, we will be about 17%
over budget.
•We finally received our first Mortgage Tax payment from the County in the amount of $41,323.49 –
approximately 59% of our budget.
•Cash outlays reflect normal operations, with the exception of a large payment in the amount of about
$120,000 for road work. Also notable is the larger summer payroll due to summer camp and youth
employment.
In addition to cash balances, the Town had investments valued at a total of $3,571,463.85 as of August 31, 2026.
Of the total investments, $1,835,941.55 represents reserve funds, and $1,7,35,522.3 represents a combination of
fund balance and property tax revenue. As of August 31, a total of $78,749.24 was recorded in interest and
earnings from investments.
Income Statement
Revenues through August 2026 are mostly as expected. Below I have pointed out some highlights:
•Sales tax revenues through the end of July are running at about 12% over budget.
•EMS revenues as of July are almost 70% of the budgeted revenue.
•Court revenue is recorded through July, with the annual budget of $25,000 now fully earned.
•The first mortgage tax payment in early amounted to 59% of the annual budget.
•WD3 reflects the third quarter billing, with 78.6% of the budget earned.
Expenditures through August 2026 are also as expected, with some spending being front loaded (such as
payments for Fire and Ambulance services, community organizations, and some insurance costs). I don’t have
anything new to point out from my previous report other than the increase in summer payroll activity and the
spending for road improvements.

Bookkeeper/Budget Officer Activities
Below are some highlights of my activities for the Month:
• Personnel: I continue to support employees and retirees with benefit administration, employment, and
civil services functions. I have also been very busy with YEP and Camp employees, most of whom
started work in early July.
• Finance Committee: The Finance Committee has not met recently, and likely will not until after budget
adoption.
• Budget Modifications: There are a couple of accounts that will require budget modifications – but nothing
odd or unusual as of the end of August. I expect to review the September vouchers and determine prior to
the Board meeting whether additional adjustments will be necessary prior to presenting anything for
September Board review and approval.
• 2027 Budget Planning: I am deep into budget planning tasks for 2027. Budget request forms have been
submitted from budget managers and Committee Chairs. I have prepared and reviewed a draft budget for
the Youth Commission, along with the Youth and Recreation Department Heads. As discussed at the
June board meeting, our detailed budget review with the Board will take place on September 21st from
9:30am until 2:00pm. More details will be distributed as we approach that date.

This budget adjustment reflects anticipated health insurance spending through the remainder of the year. The increased
cost is due to incurring the cost of a family plan rather than the single plan that was budgeted for 2026.
