Notice of Town Board meetings are posted on the Town’s website and Clerk’s board. Video recordings of meetings are available on Youtube Ms. Olson called the meeting to order at 7:02pm. TOWN OFFICIALS: In person- Supervisor- Katelin Olson Board members- Liz Weatherby, Michael Boggs Town Clerk- Carissa Parlato Second Deputy Supervisor- Teressa Naylor Attending remotely due to extenuating circumstances- Board member- Steve Manley OTHERS: In person- Rich Goldman, Sarah Adams, Linda Liddle, Vicki Romanov, Rachel Ostlund (County Legislator), Donna Blanton, Max Blanton, Dave Blanton Via Zoom- Michael Miller, Nancy’s iPad2, Linda Liddle (later in the evening) Ms. Olson said that the board could go into Executive Session later in the meeting to discuss employment of particular persons or corporations, if desired. Mr. Boggs moved to approve the agenda as presented. This was seconded by Ms. Weatherby and passed unanimously. Ms. Olson noted that this Public Hearing was originally scheduled for the July 28 meeting (which ended up getting cancelled). Mr. Boggs moved to open the hearing at 7:05pm. This was seconded by Ms. Weatherby and passed unanimously. Donna Blanton from Waterburg Road said that they moved here recently, love it, and don’t want it to change. She would like the board to appoint Rich Goldman to the vacant position. 2 Linda Liddle from Dubois Road spoke in favor of appointing Rich Goldman. She has experience working with him on the Planning Board and appreciates his prior experience. Lou Licari spoke in favor of appointing Rich Goldman. Kristy Licari spoke in favor of appointing Rich Goldman for the reasons previously mentioned. Sarah Adams spoke in favor of Rich Goldman for his knowledge and financial background. Dave Blanton said that he is new to town and has a special needs son. He appreciates the services in Tompkins County and supports the appointment of Rich Goldman to help keep things the same here. Closing the hearing: Mr. Boggs moved to close the hearing at 7:15pm. This was seconded by Ms. Weatherby and passed unanimously. PRIVILEGE OF THE FLOOR (3-min limit per person) Sarah Adams asked if the Town Board vacancy resolution could be moved up the agenda so that people in attendance could know the outcome of the appointment. `. Donna Blanton requested the same. The board agreed. MUNICIPAL BOARD & STAFF REPORTS & ANNOUNCEMENTS (written reports provided) Legislator Ostlund drew attention to the county’s budget series- designed to help people understand the budget process and how funds are spent. Although still early in the process, the county is projecting at least a 17% increase. OLD BUSINESS: APPOINTMENT TO FILL THE TOWN BOARD VACANCY RESOLUTION #131 OF 2026: APPOINTMENT TO FILL TOWN BOARD VACANCY Resolved, that the Ulysses Town Board appoints Rich Goldman to fill a temporary vacancy on the Town Board through December 31, 2026. Moved: Boggs Seconded: Weatherby Olson aye Boggs aye Manley absent Weatherby aye Vote: 3-0 Date adopted 8/11/26 MUNICIPAL BOARD & STAFF REPORTS & ANNOUNCEMENTS (written reports provided) 3 Ms. Weatherby shared that the Youth Commission will meet later this month and Three Falls LDC met and is working on website. Ms. Olson added that Three Falls is planning for 2027 in coordination with state parks. They will start seeking funding once the state completes the SEQR. On the county’s budget information, Ms. Olson noted that the example the county used does not apply to the Town of Ulysses as we distribute our sales tax differently. Ms. Olson shared TCCOG updates. OLD BUSINESS (Cont’d): RE-SCHEDULING A PUBLIC HEARING FOR A LOCAL LAW TO AMEND CHAPTER 200 OF THE TOWN CODE (WATER) RESOLUTION #132 OF 2026: INTRODUCING A PROPOSED LOCAL LAW AMENDING CHAPTER 200 OF THE TOWN CODE, SCHEDULING A PUBLIC HEARING AND ADDRESSING RELATED MATTERS WHEREAS, the Town Board of the Town of Ulysses has caused to be prepared a proposed local law titled “A LOCAL LAW AMENDING CHAPTER 200 OF THE TOWN CODE” (the “Proposed Local Law”); and WHEREAS, the Town Board already introduced the Proposed Local Law and to commence the required review processes prior to taking further action thereon; and NOW, THEREFORE, BE IT RESOLVED, that a public hearing on the question of adopting the Proposed Local Law is hereby scheduled for September 8, 2026 at 7:00 p.m.; RESOLVED, that the Town Clerk, and Town Attorney are hereby authorized and directed to take such additional steps as may be necessary or appropriate to carry out the intent of this Resolution. EXECUTIVE SESSION: 4 Ms. Olson moved to open Executive Session for the purpose of discussing the employment of a particular person or corporation at 7:39pm. This was seconded by Ms. Weatherby and passed unanimously. Ms. Olson moved to end Executive Session at 8:01pm. This was seconded by Mr. Boggs and passed unanimously. ENGINEERING FIRM SELECTION RESOLUTION #133 OF 2026: ENGINEERING FIRM SELECTION WHEREAS, the Town of Ulysses circulated a Request for Qualifications for Engineer Services and Grant Writing for bridges and culverts; and WHEREAS, the Town was fortunate to have several applicants, whose applications were reviewed and rated by an ad hoc group of elected officials and staff appointed by the Town Board, with references checked and interviews conducted; NOW, THEREFORE, BE IT RESOLVED, that in consideration of qualifications, experience, and rates, the Town of Ulysses selects Barton & Loguidice to provide engineering and grant writing services related to bridges and culverts; and be it further RESOLVED, that the Ulysses Town Supervisor is authorized, subject to Town Attorney approval, to enter into any necessary agreements to formalize the relationship. Moved: Olson Seconded: Boggs Olson aye Boggs aye Manley absent Weatherby aye Vote: 3-0 Date adopted 8/11/26 RE-SCHEDULE PUBLIC HEARING ON DESIGNATION OF SMITH WOODS AS A CRITICAL ENVIRONMENTAL AREA (CEA) Ms. Weatherby explained changes in NYS’s wetland delineation that have made it necessary for us to change our designation process. RESOLUTION #136 OF 2026: RE-SCHEDULING A PUBLIC HEARING REGARDING THE PROPOSED DESIGNATION OF SMITH WOODS AS A CRITICAL ENVIRONMENTAL AREA, ALONG WITH RELATED MATTERS WHEREAS, the Town Board of the Town of Ulysses is considering the designation of Smith Woods as a Critical Environmental Area (“CEA”) pursuant to the State Environmental Quality Review Act and its implementing regulations; and WHEREAS, at its meeting on April 14, 2026, the Town Board preliminarily classified the action as an Unlisted Action, directed the Town Planner to prepare a Part 1 Short Environmental Assessment Form (“SEAF”) relating to the proposed action along with a memo recommending particularized reasons for such designation, along with a narrative response to the Part 2 SEAF questions; and WHEREAS, the Town Planner on May 7, 2026 circulated a proposed Part 1 SEAF, memo and narrative response, which the Town Board reviewed at its meeting on May 26, 2026; and WHEREAS, the Town Board determined on May 26, 2026 that Smith Woods may possess one or more characteristics warranting designation as a CEA, including exceptional or unique natural setting, ecological sensitivity, and recreational and educational value, as outlined in the Town Planner’s memo; and WHEREAS, the Town Board also determined on May 26, 2026 that a public hearing regarding such designation was required, and scheduled such for its meeting on July 14, 2026; and 6 WHEREAS, at its meeting on June 9, 2026, the Town Board accepted the Part 1 SEAF as presented by the Town Planner, declared its intent to act as lead agency, and directed the Town Planner to circulate notice of intent to act as lead agency to all involved and interested agencies along with the owners of properties adjacent to the proposed Critical Environmental Area, along with all other persons and entities as otherwise required by law; and WHEREAS, the Town Planner has requested that the Town Board (1) re-review Part 1 of the SEAF presented by the Town Planner, considering a change in wetlands regulations, (2) officially designate involved and interested agencies for the Town Planner, (3) id entify the specific environmental characteristics that warrant the CEA designation, (4) direct re- notification of agencies and neighboring properties, and (5) re-schedule the public hearing; NOW, THEREFORE, BE IT RESOLVED, that Part 1 of the SEAF presented by the Town Planner is approved as originally presented, except that the response to Question #13 shall be changed to read “The Town’s official wetland map has identified local wetlands adjacent to the subject site”; and be it further RESOLVED, that the Town Planner is directed to sign said Part 1 as amended; and be it further RESOLVED, that the Town Planner’s recommendation of involved and interested agencies is approved as follows: • DEC Commissioner; • DEC regional office; • Tompkins County Highway Department; • Tompkins County Planning and Sustainability Department; • Village of Trumansburg’s Board of Village Trustees; • Both Planning Boards and BZAs for the Town and Village; • Town Bee Friendly Community Committee; • Town Conservation and Sustainability Committee; • Town Habitat Nature Preserve Advisory Committee; • Town Tree Advisory Council; • Town Youth Commission; • Village Events & Tourism Committee; • Ulysses Historical Society; and • Professional staff and/or retained professional services that administer environmental and developmental regulations for both the Town and the Village; and be it further RESOLVED, that the Town Planner is authorized to supplement the foregoing list of interested and involved agencies as he deems appropriate in light of new and/or additional information; and be it further RESOLVED, that the Town Board hereby adopts all of the particularized reasons set forth on pages 9 and 10 of the Town Planner’s memo dated May 7, 2026 justifying Smith Woods’ designation as a CEA; and be it further RESOLVED, that the Town Planner is directed to provide notice to all involved and interested agencies of the Town Board’s intent to act as lead agency concerning this matter; and be it further 7 RESOLVED, that a public hearing shall be held by the Town Board with respect to the proposed designation of Smith Woods as a Critical Environmental Area on September 22, 2026 at 7:00 p.m. at Town Hall, 10 Elm Street, Trumansburg, New York; and it is furthe r RESOLVED, that the Town Clerk is hereby authorized and directed to cause public notice of said hearing to be given as provided by law; and it is further RESOLVED, that the Town Clerk is also directed to provide notice of this public hearing to the owners of those properties immediately adjacent to Smith Woods by mailing said notice not less than 20 days prior to the public hearing; and be it further RESOLVED, that the Town Planner is directed to help the Town Clerk in identifying the neighboring owners of property, preparing the notice of public hearing, and in all other items as reasonably requested by the Town Clerk; and be it further RESOLVED, that this resolution shall take effect immediately. Moved: Weatherby Seconded: Boggs Olson aye Boggs aye Manley absent Weatherby aye Vote: 3-0 Date adopted 8/11/26 REVISION OF REQUEST FOR PROPOSALS (RFP) FOR SOLAR ARRAY AT HIGHWAY BARN Ms. Olson noted that we previously put out an RFP and got one bid and we would like to get more bids. Teressa worked with others to amend the RFP to make it more manageable and applicable as a minor solar array design & installation. RESOLUTION #137 of 2026: AUTHORIZING ISSUANCE OF RFP FOR GROUND-MOUNTED SOLAR ENERGY SYSTEM WHEREAS, the Town of Ulysses was awarded a NYSERDA Clean Energy Communities grant for the installation of a solar energy system; and WHEREAS, NYS Energy Law 9-103 exempts from the requirements of competitive bidding energy performance contracts, which include the installation of solar energy systems; NOW THEREFORE BE IT RESOLVED that the Town Supervisor is authorized to issue an RFP for a ground-mounted solar energy system in the form attached hereto, pending final legal approval. The Town Supervisor is also allowed to amend dates associated with the RFP as well. Moved: Olson Seconded: Boggs Olson aye Boggs aye 8 Manley absent Weatherby aye Vote: 3-0 Date adopted 8/11/26 NEW BUSINESS: LOCAL LAW TO OVERRIDE THE TAX CAP LIMIT FOR 2027: INTRODUCTION AND SCHEDULING A PUBLIC HEARING RESOLUTION #138 of 2026: INTRODUCING A PROPOSED LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT WHEREAS, a local law entitled “A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW § 3-C” was introduced at this meeting, and WHEREAS, the Town Board desires to hold a public hearing with respect to the adoption of said Local Law. NOW, THEREFORE, BE IT RESOLVED that a public hearing shall be held by the Town Board of the Town of Ulysses with respect to the adoption of the aforesaid Local Law on September 8, 2026 at 7:00 p.m. at Town Hall, 10 Elm Street, Trumansburg, New York; and it is further RESOLVED, that the Town Clerk is hereby authorized and directed to cause public notice of said hearing to be given as provided by law. Moved: Olson Seconded: Boggs Olson aye Boggs aye Manley absent Weatherby aye Vote: 3-0 Date adopted 7/28/26 AUTHORIZATION TO ALLOW VOLUNTARY DONATIONS TO ANIMAL SHELTER PER NYS REQUIREMENT RESOLUTION #139 OF 2026: ALLOWING VOLUNTARY SHELTER DONATION WHEREAS, the Town of Ulysses issues dog licenses pursuant to Article 7 of the New York State Agriculture and Markets Law; and WHEREAS, recent amendments to New York State Agriculture and Markets Law require municipalities issuing dog licenses to provide applicants with the opportunity to make voluntary contributions to an animal shelter selected by the municipality; and WHEREAS, the Bookkeeper recommends using budget line A615; NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Ulysses hereby designates the SPCA as the animal shelter utilized by the Town of Ulysses for dog control; and 9 BE IT FURTHER RESOLVED, that any voluntary contributions collected by the Town of Ulysses through its dog licensing program be deposited into Fund A615; and RESOLVED, that and funds collected shall be turned over annually during the month of March to the SPCA in accordance with applicable law and accounting procedures; and BE IT FURTHER RESOLVED, that the Town Clerk is hereby authorized and directed to take any actions necessary to implement this resolution and to update dog licensing forms and procedures accordingly. But why then just 2 names for consideration (the democrats). By that logic the town board could appoint anyone? But in any case if it's between 2 people and one won the primary is the person statistical most likely to win, it would,make sense for continuity for them to serve. This is not to mention that Hannon is temperamentally unfit for this position. He once told me I was stupid because I taught at ithaca college and not Cornell where he works Please do share with the town board as public input. Sent from my iPad TOWN OF ULYSSES LOCAL LAW NO. ___ FOR THE YEAR 2026 A LOCAL LAW AMENDING CHAPTER 200 OF THE TOWN CODE Be it enacted by the Town Board of the Town of Ulysses as follows: Section 1. Statutory Authority The Town has authority to adopt this Local Law pursuant to Article IX, § 2(c) of the New York State Constitution; Municipal Home Rule Law § 10, including but not limited to Municipal Home Rule Law § 10(1)(i) and § 10(1)(ii)(a); and the Town Law of the State of New York, including but not limited to Town Law §198. Section 2. Amendment of Section 200-4(M) Section 200-4(M) is amended by replacing said section entirely with the following: Master meter required. When multiple living units exist on a single parcel, a single master meter shall be installed measuring all water consumed on the parcel. Upon application by the owner(s) of a parcel, the Town Board may, in its reasonable discretion and subject to approval by the Water District Operator, authorize at the sole cost and expense of the owner(s) installation of water meters for each separate living unit in addition to the master meter. In such event, the owner(s) shall remain directly responsible for payment of all water user fees, rates, rents and charges as measured by the master meter, even when the Town of Ulysses sends a bill to the person(s) occupying such living units. Section 3. Amendment of Section 200-10(A) Section 200-10(A) is amended by replacing said section entirely with the following: User fees. User fees shall be assessed to each property within the service area for the purposes of retiring debt and operation and maintenance. User fees and formulas for determining user fees shall be established in accordance with New York State Town Law and may be modified from time to time by resolution of the Town Board after following all procedures required by New York State Town Law. User fees may be included on the tax bills for each property within the service area, and payment for same shall be made at the same time and at the same place as specified for other Town charges. Section 4. Amendment of Section 200-10(C)(1) Section 200-10(C)(1) is amended by replacing said section entirely with the following: If there shall be any payments which are due to the Town of Ulysses, or any Department or District thereof, pursuant to any section of this article, which shall remain due and unpaid, in whole or in part, for a period of 30 calendar days from the date of payment due to the Town of Ulysses, the same shall constitute a default, and there shall be added to the entire amount of the original bill, a penalty equal as set forth from time to time by resolution of the Town Board. Section 5. Remainder Except as hereinabove amended, the remainder of the Code of the Town of Ulysses shall remain in full force and effect. Section 6. Effective Date This Local Law shall take effect immediately upon filing with the New York Secretary of State in accordance with Section 27 of the Municipal Home Rule Law. TOWN OF ULYSSES LOCAL LAW NO. ___ OF THE YEAR 2026 A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW § 3-C Be it enacted by the Town Board of the Town of Ulysses as follows: Section 1. Legislative Intent It is the intent of this local law to override the limit on the amount of real property taxes that may be levied by the Town of Ulysses pursuant to General Municipal Law § 3-c, and to allow the Town of Ulysses to adopt a budget for the fiscal year beginning January 1, 2027 and ending December 31, 2027 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law § 3-c. Section 2. Authority This local law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes the Town Board to override the tax levy limit by the adoption of a local law approved by vote of at least sixty percent (60%) of the Town Board. Section 3. Tax Levy Limit Override The Town Board of the Town of Ulysses, County of Tompkins, is hereby authorized to adopt a budget for the 2027 fiscal year that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law § 3-c. Section 4. Remainder Except as hereinabove amended, the remainder of the Town Code of the Town of Ulysses shall remain in full force and effect. Section 5. Separability The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words, or parts of this local law or their application to other persons or circumstances. It is hereby declared to be the legislative intent that this local law would have been adopted if such illegal, invalid, or unconstitutional provision, clause, sentence, subsection, word or part had not been included therein, and as if such person or circumstance, to which the local law or part thereof is held inapplicable, had been specifically exempt therefrom. Section 6. Effective Date This Local Law shall take effect immediately upon filing with the New York State Secretary of State in accordance with Section 27 of the Municipal Home Rule Law. Next set Court date for review and potential dismissal is 12.20.2026. • Keith Dodge, 1942 Trumansburg Road (parcel 20.-3-9.22), plead guilty to all violations on July 28, 2026. The plea deal stated that should the defendant resolve all outstanding issues no later than 270 days, prosecution would petition the Court to dismiss all charges. Town of Ulysses July 2026 Bookkeeper Board Report August 11, 2026, Town Board Meeting Prepared by Blixy Taetzsch, 8/6/26 1 Greetings Board Members: Below are financial highlights from the July 2026 financial statements. Balance Sheet As detailed in the Supervisor’s Report, total cash balances as of 7/31/2026 amounted to $561,758.19, an increase of 19,574.62 from the end of June. A few notable items to comment on for this month: • We did not need to redeem and investments. • Sales tax payments are coming on a timely basis, having received payments through June as of the end of July. Sales tax revenue is currently running over 10% ahead of budget based on trends thus far in 2026. • EMS Payments are also now current through June and ambulance charges are currently earned at 60% of the budget. • We finally received our first Mortgage Tax payment from the County, however it was not deposited until August and is not reflected in the July financials. The amount is $41,323.49 – approximately 59% of our budget. • Cash outlays were as expected. Notable is the increase in payroll due to summer camp and youth employment. In addition to cash balances, the Town had investments valued at a total of $3,660,509.13 as of July 31, 2026. Of the total investments, $1,730,343.94 represents reserve funds, and $1,930,165.19 represents a combination of fund balance and property tax revenue. As of July 31, a total of $67,794.52 was recorded in interest and earnings from investments. Income Statement Revenues through June 2026 are mostly as expected. Below I have pointed out some highlights: • Sales tax revenues through the end of June are running at about 11% over budget. It is too early to know whether this trend will continue through the year. • EMS revenues as of June are just about 60% of the budgeted revenue. • Court revenue is recorded through June, with the annual budget of $25,000 almost fully earned. • As noted earlier, the Town finally received its first mortgage tax payment in early August. • WD3 reflects the second quarter billing, with slightly under 50% of the budget earned. Expenditures through July 2026 are also as expected, with some spending being front loaded (such as payments for Fire and Ambulance services, community organizations, and some insurance costs). I don’t have anything new to point out from my previous report other than the increase in summer payroll activity. Town of Ulysses July 2026 Bookkeeper Board Report August 11, 2026, Town Board Meeting Prepared by Blixy Taetzsch, 8/6/26 2 Bookkeeper/Budget Officer Activities Below are some highlights of my activities for the Month: • Personnel: I continue to support employees and retirees with benefit administration, employment, and civil services functions. I have also been very busy with YEP and Camp employees, most of whom started work in early July. • Finance Committee: The Finance Committee did not meet as originally scheduled on July 6th due to the change in the Board meeting date. The next meeting has not yet been scheduled. • Budget Modifications: I will be presenting a few budget modifications for the Boards review and approval at the August 11 meeting. • 2027 Budget Planning: I have begun work on budget planning tasks for 2027. Budget request forms have been distributed to budget managers and Committee Chairs – with a due date back to me of August 7th. As discussed at the June board meeting, our detailed budget review with the Board will take place on September 21st from 9:30am until 2:00pm. Additionally, it reflects work performed by the DPW at the Town Hall and Town Parks that exceeded the amount originally anticipated in the budget. Contractual funds are available to cover these costs in each functional area. To reflect additional truck maintenance costs, which are covered by savings in other contractual accounts, and to reflect the costs associated with engineering design for a water tank blower enclosure. Contingency funds are available to cover the unanticipated engineering costs. This adjustment reflects the closing costs related to the acceptance of donated land. This adjustment reflects the amount paid to the Encore Players for 1776 Production.
