HomeMy WebLinkAbout2026-03-24-TB-FINAL-minutes-with app1 TOWN BOARD MEETING Town of Ulysses March 24, 2026 The meeting was held in person at the Town Hall at 10 Elm St., Trumansburg NY as well as via Zoom videoconference. Notice of Town Board meetings are posted on the Town’s website and Clerk’s board. Video recordings of meetings are available on Youtube at https://www.youtube.com/channel/UCWVIs--g9CpHIxdk9YxZyPw. CALL TO ORDER: Ms. Olson called the meeting to order at 7:06pm. ATTENDANCE: TOWN OFFICIALS: In person- Supervisor- Katelin Olson Board members- Michael Boggs, Steve Manley, Liz Weatherby Town Clerk- Carissa Parlato Highway Superintendent/DPW- Scott Stewart Roxanne Marino (Conservation & Sustainability Advisory Committee (CSAC); Comp Plan Steering Committee (CPSC)) Via Zoom- Linda Liddle (Planning Board) OTHERS: In person- Rich Goldman, Sigrid Pauen, Matt McKenna (MRB Group) Via Zoom- Sarah Adams, Mena APPROVAL OF AGENDA: Ms. Olson requested to add to the agenda a letter of support for a property owner who wants to put their land into an easement. Mr. Boggs moved to approve the agenda as amended. This was seconded by Mr. Manley and passed unanimously. PRIVILEGE OF THE FLOOR: (none) OLD BUSINESS: Ms. Olson said that the board reviews the Agreement for the Expenditure of Highway Monies in January but the projects can change after the winter season. 2 Mr. Stewart said that the total hasn’t changed; just the projects. He said that quotes for Agard Road are coming in higher than expected so that has been amended. He added that the projects on this list are only the ones that get reimbursed from the state. REVISED AUTHORIZATION TO SPEND HIGHWAY FUNDS RESOLUTION #68 OF 2026: REVISED AUTHORIZATION FOR HIGHWAY EXPENDITURES/284 AGREEMENT WHEREAS, the Town Board must approve expenditures annually for the maintenance of the roads, and WHEREAS by law, the Town Board must approve these expenditures for highway Maintenance, and NOW, THEREFORE, BE IT RESOLVED that the Ulysses Town Board approves the attached Agreement for the Expenditure of Highway Moneys as presented by the Ulysses Highway Superintendent at the March 24, 2026 Town Board meeting, superseding the version adopted by the Ulysses Town Board on January 7, 2026. Moved: Olson Seconded: Boggs Olson aye Boggs aye Manley aye Weatherby aye Vote: 4-0 Date Adopted: 3/24/26 FEEDBACK REQUESTED FROM PLANNING BOARD, BOARD OF ZONING APPEALS, AND STAFF FOR PROPOSED USE DEFINITIONS Ms. Olson reiterated that in the zoning law, any use that is defined (but not specifically permitted or allowed), is prohibited. RESOLUTION #69 OF 2026: FEEDBACK REQUEST FROM PLANNING BOARD, BOARD OF ZONING APPEALS, AND STAFF FOR PROPOSED DATA MINING DEFINITIONS WHEREAS, the Ulysses Town Board is interested in amending the Town Zoning Code to include definitions for data and cyber mining centers; and WHEREAS, the Planning Board, Board of Zoning Appeals, and staff have specialized knowledge related to zoning; NOW, THEREFORE, BE IT RESOLVED that the Ulysses Town Board requests that the Planning Board, Board of Zoning Appeals, and staff provide feedback on the definitions presented by the Town Supervisor on March 24, 2026. Moved: Olson Seconded: Boggs 3 Olson aye Boggs aye Manley aye Weatherby aye Vote: 4-0 Date Adopted: 3/24/26 NEW BUSINESS: PROCESS FOR FILLING TEMPORARY VACANCY ON THE TOWN BOARD Ms. Olson said that she spoke with the Town Attorney and he counseled on the following: • Making an appointment is a discretionary action by the Town Board (and they can appoint anyone that they like (who is at least 18 and a member of the electorate) • The appointment will last through the end of the year • Interviews of applicants by a quorum (or more) of the Town Board are subject to open meetings • The process is subject to the town’s DEI policy Ms. Weatherby said that she would like to cast a wider net. Mr. Boggs agreed but doesn’t want to wait too long. Ms. Olson also noted that there may be a primary election in June so that process could be factored in. LETTER OF SUPPORT FOR OECHSNER FARMS: This would designate the property as ag land in perpetuity but won’t remove it from tax roll. RESOLUTION # 70 OF 2026: LETTER OF SUPPORT FOR OECHSNER FARMS: RESOLVED, that the Ulysses Town Board authorizes the Town Supervisor to acquire maps that clearly specify the parcel and road names for Thor Oechsner's land in the Town of Ulysses that he intends to put in a conservation easement; and be it FURTHER RESOLVED, the Ulysses Town Board authorizes the Town Supervisor to sign a letter of support for the land conservation application for Thor Oechsner for the parcels identified in Easesments 2 and 3. Moved: Weatherby Seconded: Boggs Olson aye Boggs aye Manley aye Weatherby aye Vote: 4-0 Date Adopted: 3/24/26 BOARD NOTIFICATIONS: (none) PRIVILEGE OF THE FLOOR (3-min limit per person) Ms. Marino said that she can share information from the last time the Town Board filled a vacancy. Regarding the data center definitions- she wondered if “industrial” was appropriate with respect to the Light Industrial definition. ADJOURN: Ms. Olson made a motion to adjourn at 8:04pm. This was seconded by Mr. Manley and passed unanimously. Respectfully submitted by Carissa Parlato, Town Clerk, 4/2/26 5 APPENDIX: Included: Agreement (284) for the Expenditure of Highway Monies Zoning amendment draft (definitions) Proposed Definitions to Amend Ulysses Town Code March 19, 2026 ACCESSORY DATA CENTER – A building, or structure, or partial use of a building or structure, used to store, manage, process or transmit digital data for business uses, including computers, network equipment, systems, servers, and other associated components related to the digital data storage and operations that is secondary, subordinate and customarily incidental to and located on the same lot as the principal use of a property. Such a use cannot dominate the property or operate as an independent principal use. DATA CENTER – An industrial use facility that is primarily used for the storage, management, processing, and transmission of digital data, and which houses computer or network equipment, systems, servers, appliances, and other associated components related to the digital data storage and processing as a principal land use on a parcel. Equipment and accessories customary to data centers including but not limited to air handlers, power generators, water cooling and storage facilities, utility substations, and other associated utility infrastructure shall also be considered part of a data center. CRYPTOCURRENCY – A digitally generated currency secured in a manner making it difficult to counterfeit or double spend. CRYPTOCURRENCY DATA MINE – A specific type of data center using a facility or use of land, buildings, or structures where computing equipment is used to solve complex mathematical algorithms in connection with verifying and adding transactions to a blockchain or other distributed ledger, commonly known as cryptocurrency mining. For purposes of this law, a cryptocurrency data mining operation shall be considered a distinct land use, different from a “data center” as defined in this section
