RESOLUTION 2025-(2-6): HIGHWAY/DPW ITEMS
RESOLUTION 2025-2: HIGHWAY- SHARED SERVICE AGREEMENTS
WHEREAS, Highway Law #142-d allows co-operative agreements for highway services and sharing of labor,
equipment and supplies; and
WHEREAS, General Municipal Law Article 5-G allows and encourages municipal co-operations, by joint or
contract basis, performance of powers and duties among themselves; and
WHEREAS, it is deemed beneficial to the Town of Ulysses to allow for shared highway agreements of
equipment and services with other nearby municipal highway departments;
WHEREAS the Agreement for the Expenditure and Repair and Improvement of Highway Moneys is
authorized by Highway Law #284, and an agreement to cover Custody of Highway Moneys is authorized by
Highway Law #283.

NOW THEREFORE BE IT RESOLVED that the Ulysses Town Board authorizes the Town Town’s Highway
Superintendent pursuant to Highway Law #284 to take such action to implement said agreements consistent
with Town highway needs and availability, and Supervisor pursuant to Highway Law #283 to enter into
agreements for shared services and equipment with other municipalities and authorize, within existing budget
constraints, the maintain sufficient liability coverage to protect the town in such joint efforts.
RESOLUTION 2025-3: AUTHORIZING SPENDING OF HIGHWAY FUNDS
WHEREAS, the Town Board must approve expenditures annually for the maintenance of the roads, and
WHEREAS by law, the Town Board must approve these expenditures for highway maintenance, Therefore, be

RESOLVED that the Ulysses Town Board approves the attached Agreement for the Expenditure of Highway
Moneys as presented by the Ulysses Highway Superintendent at the January 9, 2025 Town Board
Organizational meeting.
RESOLUTION 2025-4: SOLE SOURCE REPAIR VENDORS FOR HIGHWAY EQUIPMENT
WHEREAS, the timely repairs of Highway equipment are vital to safe roads and Town operations, and
WHEREAS, equipment repair services are considered sole-source vendors due to the nature of the repairs,
which can be both highly specialized for a specific piece of equipment and/or under warranty through a
specific vendor; therefore
BE IT RESOLVED that the Ulysses Town Board recognizes that the Town Highway Superintendent is in
adherence with the procurement policy to procure repair services as required from the following sole source
vendors: Beam Mack, Caskey’s Garage, and Regional International Corp.
RESOLUTION 2025-5: TOWN DEPARTMENT OF PUBLIC WORKS HOURS OF
OPERATION
BE IT RESOLVED that the hours for the Town Dept. of Public Works (DPW) will be set by the Town
Highway Superintendent/Department of Public Works at his discretion, and he will communicate these details
to the Town Clerk and the Department of Public Works employees.
RESOLUTION 2025-6: VEHICLE BENEFIT
RESOLVED, that because the Highway Superintendent is on call 24 hours a day, seven days a week, the
Ulysses Town Board authorizes the use of a town vehicle for travel to and from work, provided it is not used
for more than incidental personal use. Mileage should be recorded and submitted to the Town Clerk annually
by January 15th for the preceding year.

RESOLUTION 2025-11-14: REIMBURSEMENT, PETTY CASH, and GIFT ITEMS
RESOLUTION 2025-11: MILEAGE FOR PERSONAL VEHICLE USE FOR TOWN BUSINESS
BE IT RESOLVED mileage at a rate of $.70 cents per mile, based on the 2025 IRS standard mileage rate,
shall be paid to Town Officials and employees for use of their personal vehicles for Town Business and that
such mileage shall be reported at least quarterly on the official town form (available from the Town Clerk).
RESOLUTION 2025-12: CELL PHONE REIMBURSEMENT GUIDELINES
WHEREAS carrying a cell phone is an important part of efficient communications and emergency response
for Building/Code & Zoning Enforcement Officer, Highway Superintendent and Deputy Highway
Superintendent, and
WHEREAS this benefit must be claimed on the employees’ personal tax return as a taxable fringe benefit
unless the employee provides bill documentation showing work use versus personal use;
THEREFORE, BE IT RESOLVED that the Town of Ulysses hereby allows the positions of Code/Zoning
Enforcement Officer, Highway Superintendent, and Deputy Highway Superintendent to be reimbursed for part
of the cost of their personal cell phone at the rate of $40/month; and
RESOLVED that the Town Clerk will provide a copy of this resolution to each person holding a position to
which this resolution refers.
RESOLUTION 2025-13: PETTY CASH
BE IT RESOLVED that the petty cash amount for the Town Clerk/Tax Collector is $300 and the amount for
the Court Clerk is $150.
RESOLUTION 2025-14: GIFTS FROM TOWN TO OTHER PARTIES
BE IT RESOLVED that in accordance with the New York State Constitutional prohibition against gifts by
municipalities as described in Article III, Section 1, the Town of Ulysses will not give donations, or other gifts
of recognition for service (retirement, annual appreciation, or otherwise) to any organizations, volunteers, or
other individuals in the employment of the Town or otherwise providing service to the Town or the
community. The Town may, however, hold recognition events, issue proclamations of appreciation, and
provide refreshments.

RESOLUTION 2025-17: MANDATORY REVIEW OF ALL ACCIDENTS INVOLVING TOWN PROPERTY
WHEREAS the Town’s insurance carrier has requested that a procedure be put in place to review all accidents
involving Town-owned property; and
WHEREAS the purpose of the purpose of this process is to document any health and safety events, including
‘near misses’, in order to better understand how the Town might improve health and safety conditions for its
employees; therefore
BE IT RESOLVED that any employee involved in an accident involving Town property will complete the
incident report form provided by the Town Bookkeeper; and
FURTHER RESOLVED that the Town Board delegates the procedural review of any accident involving
Town property to the Town’s Safety Committee.

RESOLUTION 2025-(18-22): FINANCIAL ITEMS
RESOLUTION 2025-18: FINANCIAL REPORTING: ANNUAL FINANCIAL REPORT (AFR)
BE IT RESOLVED that an annual financial report must be presented to the Town Clerk within 30 days of the
end of the fiscal year as required by Town Law Section 29(10), and further
RESOLVED, in lieu of the financial report, the Supervisor is hereby required and authorized to submit an
annual financial report (AFR) to the state comptroller and Town Clerk within 60 days after the close of the
fiscal year, and further,
RESOLVED, that the Town Clerk shall cause a summary thereof to be published in accordance with the law
(Town Law Section 29(10-a)), and further
RESOLVED that if the state comptroller approves a 60-day extension of the AUD, the Supervisor’s time for
filing a copy of the AUD with the Town Clerk is also extended.
RESOLUTION 2025-19: FINANCIAL RECONCILIATIONS
BE IT RESOLVED the Town follow the 2013 recommendations of auditor Insero and Company to have the
Supervisor or Bookkeeper review the reconciliation of the Town Clerk’s bank statements and the Town
Clerk’s office review the reconciliation of the Supervisor’s bank statements to safeguard the town’s finances.
This shall be done at least quarterly and reported to the Town Board.
RESOLUTION 2025-20: FINANCIAL INSTITUTIONS
BE IT RESOLVED that Tompkins Community Bank is designated as depository, in which the Supervisor,
Town Clerk, Justices, and other employees by virtue of their offices, shall deposit all monies coming into their
hands and,
FURTHER RESOLVED the Town investments can be made at other banks and institutions as outlined in the
Town’s investment policy. The Town investment policy shall be reviewed and approved by the Town Board
periodically and revised as necessary.
RESOLUTION 2025-21: COLLECTION OF BUILDING FEES
WHEREAS building and zoning officers are prohibited from collecting cash payments when outside the
office, and
RESOLVED that the Town Clerk’s office will process fees associated with building, planning, and zoning
applications.
RESOLUTION 2025-22: TOWN BANK ACCOUNT SIGNATORIES, COUNTERSIGNING AND MAILING OF
CHECKS
RESOLVED that the signatories for Town-wide bank accounts (i.e. not Clerk or Court accounts) are as

town’s fiscal year;

WHEREAS the Town Board is the Executive body charged with speaking and acting on behalf of the Town
(Town Law Section 64), unless such powers are specifically delegated by resolution to the Supervisor, as per
Town Law Section 29(16), or to another individual,

BE IT RESOLVED that any application (full or partial, new or revised) for grant funding or financing above
$1000, or request for evaluation of funding potential, or any request for review or approval of any project
proposed by the Town of Ulysses to any government agency or other entity external Ulysses Town
government be approved by Town Board resolution before it is submitted to the appropriate agency, or any
request that commits or obligates the Town in any way to an established timeline or schedule, or any request
that commits the Town’s time or financial resources; and be it
FURTHER RESOLVED that all applications of any amount shall be evaluated for future impact on Town
staff time and resources by the Town Supervisor and any applicable staff before being submitted to the Town
Board for approval and that feedback on these matters shall be considered by the Town Board in their
deliberation process, and;
FURTHER RESOLVED that all funding applications for capital or infrastructure projects will be evaluated
for how they advance the goals of the Town, and;
FURTHER RESOLVED that unless otherwise authorized, the Town Supervisor must also be given authority
by the Town Board to accept grant funds on any successful grant applications, and;
FURTHER RESOLVED that unless authorized in the Town of Ulysses Procurement Policy (or otherwise), the
Town Supervisor and Highway Superintendent must also be authorized by the Town Board to make
contractual commitments on behalf of the town, and;
FURTHER RESOLVED, all Town Board members including the Supervisor shall identify whether they are
speaking by authority of the Board or as an individual when talking with granting agencies, and
FURTHER RESOLVED, that this resolution hereby supersedes all previous Town Board resolutions which
may be interpreted as giving the Supervisor, any other member of the Town Board, Highway Superintendent,
or any professional contracted with by the Town of Ulysses the authority to make applications (full or partial)
for grants, loans, or any other type of project financing, make contractual commitments (verbal or written) on

RESOLUTION 2025-40: APPROVAL OF THE FIRE PROTECTION DISTRICT AGREEMENT FOR 2025
WHEREAS, a fire protection district known as the “Fire Protection District of the Towns of Ulysses, Hector
and Covert” (hereafter referred to as “the Fire Protection District”) has been duly established in the said towns;
and
WHEREAS, the Fire Protection District encompasses the following territory in the Town of Ulysses: All of
the Town of Ulysses, excepting the area within the limits of the incorporated Village of Trumansburg; and
WHEREAS, the Village of Trumansburg (hereafter referred to as “the Village”) maintains a volunteer fire
department, with adequate and suitable apparatus, equipment and training for the furnishing of fire protection
services within the Fire Protection District; and
WHEREAS, Town Law §184 permits a town to contract with a village which maintains adequate and
suitable apparatus and appliances for the furnishing of fire protection services in such fire protection district;
and
WHEREAS, the Town wishes to contract with the Village to provide fire protection services in the Fire
Protection District; and

WHEREAS, a public hearing as required by §184 of the Town Law was duly advertised on December 14,
2024; and
WHEREAS, the Public Hearing was held on January 14, 2025 at 7:00 p.m. and all members of the public
wishing to share their opinions in person or in writing had the opportunity to do so;

RESOLVED that the Town Board of the Town of Ulysses hereby approves and authorizes execution of the

WHEREAS, the NY Department of Environmental (NYDEC) determined on November 19, 2024 that Cargill,
Inc. has submitted a complete Mined Land Reclamation permit application to amend the water storage
location within Cayuga Salt Mine’s currently permitted Life-of-Mine area; and
WHEREAS, the Town of Ulysses passed a resolution on November 12, 2024 requesting a thorough
environmental review of the project and submitted a letter to the NY DEC to that effect; and
WHEREAS, the Town of Ulysses passed a resolution on December 10, 2024 requesting an extension to the
public comment period, which was granted, thereby extending the comment period to January 15, 2025; and
WHEREAS, the Conservation and Sustainability Advisory Committee prepared written recommendations for
the Town Board to consider, and these comments were shared with the public in the agenda materials posted
on January 10, 2025;

WHEREAS, the Town of Ulysses is a Participant in the Greater Tompkins County Municipal Health
Insurance Consortium (the "Consortium"), a municipal cooperative organized under Article 47 of the New
York Insurance Law, and
WHEREAS, the municipal participants in the Consortium, including this body, have approved and executed a
certain Municipal Cooperation Agreement (the "Agreement"; effective date of October 1, 2010), and
WHEREAS, Article 47 of the New York Insurance Law (the "Insurance Law") and the rules and regulations
of the New York State Department of Financial Services set forth certain requirements for governance of
municipal cooperatives that offer self-insured municipal cooperative health insurance plans, and
WHEREAS, the Agreement sets forth in Section Q2 that continuation of the Consortium under the terms and
conditions of the Agreement, or any amendments or restatements thereto, shall be subject to Board review and
upon acceptance of any new Participant hereafter, and
WHEREAS, the Municipal Cooperative Agreement requires that amendments to the agreement be presented
to each participant for review and adopted by a majority vote by its municipal board, and
WHEREAS, the Town of Ulysses is in receipt of the proposed amended Agreement and has determined that it
is in the best interest of its constituents who are served by the Consortium to amend the Agreement as set forth
in the Amended Municipal Cooperative Agreement, now therefore be it

RESOLUTION 2025-58: INITIAL SEQRA CLASSIFICATION AND INTENT TO DECLARE LEAD AGENCY STATUS
WHEREAS, Marvin and Allison Pritts intend to donate approximately 15.234 acres of land to the Town
of Ulysses, at their property located at 5150 Cold Springs Road, Trumansburg, NY, as described in a
survey by Williams & Edsall Land Surveyors, P.C., dated November 26, 2024, for the purpose of
establishing the first Town of Ulysses park; and
WHEREAS, the Town Board of the Town of Ulysses is interested in accepting such generous donation
and establishing a park, to be used initially for general recreational activities such as walking and
daytime athletic practice/contests on a mowed grass field, with future improvements dependent
upon the establishment of community needs, wants, and funding; and
WHEREAS, such donation would require subdivision/creation of a flaglot and either the grant of an
area variance providing 12 feet of relief from the required 50 feet of frontage or a determination by
the Town Board that this action is immune from zoning; and
WHEREAS, donation of this land, subdivision/creation of a flaglot, grant of an area variance, and
establishment of a town park requires review under the State Environmental Quality Review Act
(“SEQRA”);
NOW THEREFORE, the Town Board of the Town of Ulysses hereby resolves as follows:
1. The action is subject to SEQRA; and
2. The action’s preliminary classification is “unlisted action”;
3. A full Environmental Assessment Form shall be used to assist in determining whether
such preliminary classification is accurate; and

4. The Town Board intends to serve as Lead Agency with respect to SEQRA review and, in
that capacity, will determine if the proposed action will have a significant adverse
impact on the environment; and
5. The Town Supervisor is directed to sign the draft FEAF in the form attached hereto;
and
6. A copy of this Resolution and the Environmental Assessment Form will be sent to
Involved Agencies and Interested Agencies, as applicable; and
7. Involved Agencies shall be given an opportunity to challenge the Town Board’s Lead
Agency designation and to provide written comments on the full Environmental

WHEREAS, the Cornell Cooperative Extension Tompkins County (CCETC) is applying to the New York
State Department of Environmental Conservation (DEC) for a grant under the Community Reforestation
(CoRe) program for a reforestation project to be located on the Salo Habitat Nature Preserve (23 Salo Drive), a
site located within the territorial jurisdiction of the Ulysses Town Board; and
WHEREAS, CCE will organize volunteers to identify and remove invasive species and plant native trees; and
WHEREAS, the CCE will fund the activities and get reimbursed by NYS so that there will be no cost to the
town; and
WHEREAS, the DPW Director and Chair of the Habitat Nature Preserve Committee are in support of the
project; and
WHEREAS, as a requirement under the rules of this program, said not-for-profit organization must obtain "a
municipal endorsement, or an agreement or letter giving permission for the project to be conducted by the
bidder and signed by the owner";
NOW, THEREFORE, be it resolved by this august body that the Board of Town of Ulysses hereby does
approve and endorse the application of CCETC for a grant under DEC’s CoRe grant for a community
reforestation project to be located on the Habitat Nature Preserve and allow CCETC and its contractors to
access the site for this purpose; and be it

WHEREAS, the Town has received grant awards to repair or replace the Maplewood Drive and Garrett Road
culverts; and

WHEREAS, Earth Day was first celebrated nationally on April 22, 1970, marking the beginning of the
modern environmental movement; and
WHEREAS, the Town of Ulysses recognizes the critical importance of environmental stewardship,
conservation, and sustainable practices for the wellbeing of current and future generations; and
WHEREAS, the Town of Ulysses is blessed with abundant natural resources including pristine waterways,
fertile agricultural lands, diverse wildlife habitats, and scenic landscapes that contribute significantly to our
community's identity and quality of life; and
WHEREAS, protecting these natural resources requires ongoing commitment, education, and action from all
members of our community; and
WHEREAS, climate change and environmental degradation present growing challenges that require local
solutions and community engagement; and
WHEREAS, the Town of Ulysses has demonstrated leadership in environmental protection through
sustainable land use planning, conservation initiatives, and renewable energy projects; and
WHEREAS, a dedicated Earth Day celebration, scheduled for May 4, 2025, provides an opportunity for
residents to come together, learn about environmental issues, and participate in activities that benefit our local

RESOLUTION 2025-85: AUTHORIZING THE IMPLEMENTATION AND FUNDING OF 10% OF
THE COSTS OF A TRANSPORTATION PROJECT, OF WHICH QUALIFIED COSTS MAY BE
REIMBURSED FROM BRIDGE NY FUNDS
WHEREAS, a project for the MAPLEWOOD DR OVER TRIB TO CAYUGA LAKE CULVERT REHAB,
TOWN OF ULYSSES, TOMPKINS COUNTY, BRIDGE NY 2023, P.I.N. 3757.66 (the "Project") is
eligible for reimbursement of qualified costs from Bridge NY funding that calls for the postreimbursement
apportionment of the qualified costs to be borne at the ratio of 100% Bridge
NY funds and 0% non-Bridge NY funds; and
WHEREAS, the Town of Ulysses will design, let, and administer all phases of the Project; and
WHEREAS, the Town of Ulysses desires to advance the Project by making a commitment of
100% of the costs of Engineering, ROW and Construction work for the Project or portions
thereof;
NOW, THEREFORE, the Town of Ulysses Board, duly convened, does hereby
RESOLVED, that the Town of Ulysses Board hereby approves the Project; and it is hereby
further
RESOLVED, that the Town of Ulysses Board hereby authorizes the Town of Ulysses to pay
100% of the cost of Engineering, ROW and Construction work for the Project or portions
thereof, with the understanding that qualified costs will be reimbursed from Bridge NY
funding; and it is further
RESOLVED, that the sum of $895,500 is made available to cover the cost of participation in the
above phase of the Project;
RESOLVED, that the Town of Ulysses Board hereby agrees that the Town of Ulysses shall be
responsible for all costs of the Project, including costs which exceed the amount of

reimbursement available from the NY Bridge Funding awarded to the Town of Ulysses; and it
is further
RESOLVED, that in the event the costs of the Project exceed the amount appropriated above,
the Town of Ulysses Board shall convene as soon as possible to appropriate said excess
amount immediately upon notification; and it is further

RESOLVED, that the Town of Ulysses BOARD hereby agrees that Town of Ulysses hereby
commits that construction of the Project shall begin no later than twenty-four (24) months
after award and the construction phase of the Project shall be completed within thirty (30)

al necessary agreements, certifications or reimbursement requests with NYSDOT for State Aid

REPEALING AND REPLACING CHAPTER 89 ENTITLED ‘FLOOD DAMAGE PREVENTION
WHEREAS, a local law entitled “A LOCAL LAW REPEALING AND REPLACING CHAPTER 89
ENTITLED ‘FLOOD DAMAGE PREVENTION’” was introduced at this meeting, and
WHEREAS, the Town Board desires to hold a public hearing with respect to the adoption of
said Local Law.
NOW, THEREFORE, BE IT RESOLVED that a public hearing shall be held by the Town Board of
the Town of Ulysses with respect to the adoption of the aforesaid Local Law on May 27, 2025

RESOLUTION 2025-87: APPROVING REMOVAL OF TOWN ASPHALT FROM NEIGHBORING
PROPERTY
Whereas, the Town of Ulysses is the owner of an asphalt parking lot located on a portion of
that property located in the Village of Trumansburg commonly known as 38 East Main Street,
Trumansburg, New York and identified by tax map number 6.-1-22.2, as set forth in an
Encroachment Agreement dated March 24, 2021 by and between the Town of Ulysses and 38

E. Main Street., recorded with the Tompkins County Clerk on March 31, 2021 as instrument
number 2021-03461; and
Whereas, the Encroachment Agreement states that if the Town ever removes or reconstructs
the parking lot, it shall ensure that the parking lot is constructed solely on the Town’s
property; and
Whereas, the Town was advised in 2023/2024 by its insurance carrier that its asphalt parking
lot was at the end of its useful life and required replacement or removal; and
Whereas, the Town began planning to reconstruct its parking lot in September 2024, and as
part of such planning contacted 38 E. Main Street. to discuss impacts and cost-sharing
associated with the Town’s reconstruction of its parking lot on 38 E. Main Street property; and
Whereas, the Town and 38 E. Main Street were unable to come to an agreement concerning
the impacts and cost-sharing associated with said reconstruction; and
Whereas, in December 2024 the Town awarded a contract that included within its scope
removal of the parking lot located on the property of 38 E. Main Street., to comply with its
obligations pursuant to the Encroachment Agreement; and
Whereas, 38 E. Main Street representative, Scott Hoffman, has raised objections to said
action; and
Whereas, the Town has reached out numerous times to negotiate with 38 E. Main Street to
resolve said objections;
NOW THEREFORE BE IT RESOLVED, that the Attorney for the Town is authorized to make a
final notification to Scott Hoffman/Hoffman's attorney of the Town’s intention to remove the
asphalt parking lot located on 38 E. Main Street property on or after May 15, 2025, unless an
offer to purchase said parking lot acceptable to the Town Supervisor is tendered no later than
11:00 a.m. on May 15, 2025; and be it
FURTHER RESOLVED, that if the Attorney for the Town notifies the Highway Superintendent
that an offer to purchase said asphalt parking lot has not been timely tendered, then the
Highway Superintendent is authorized to remove the Town’s parking lot on the property of 38
E. Main Street and to restore and reseed the land to grade level on or after May 15, 2025.

RESOLUTION 2025-89: SEQR DETERMINATION FOR A PROPOSED LOCAL LAW TO REPEAL
AND REPLACE CHAPTER 89 OF THE CODE OF THE TOWN OF ULYSSES ENTITLED “FLOOD
DAMAGE PREVENTION”
WHEREAS, the proposed action is in consideration of a proposal to adopt a Local Law that
would repeal and replace Chapter 89 of the Code of the Town of Ulysses entitled “Flood
Damage Prevention”; and
WHEREAS, the proposed action is an Unlisted action under the New York Codes, Rules, and
Regulations (NYCRR) Title 6, Part 617 State Environmental Quality Review (SEQR), for which
the Town of Ulysses Town Board is acting as Lead Agency in respect to the proposed local law;
and
WHEREAS, the Town Board, at a public meeting held on May 27, 2025, has reviewed and
accepted as adequate the Short Environmental Assessment Form (SEAF), Part 1 for the
proposed action; and

WHEREAS, the proposal should not create a material conflict with the 2009 land use plan or

with the current zoning regulations; and
WHEREAS, the proposal should not result in a significant change in the use or intensity of use
of land; and
WHEREAS, the proposal should not impair the character or quality of the existing community;

caused the establishment of a Critical Environmental Area; and
WHEREAS, the proposal should not result in an adverse change to the existing level of traffic
or affect existing infrastructure for mass transit, biking, or walkways; and
WHEREAS, the proposal should not cause a significant increase in the use of energy; and
WHEREAS, the proposal should not significantly impact existing water supplies or wastewater
treatment utilities; and
WHEREAS, the proposal should not impair the character or quality of important historic,
archaeological, architectural or aesthetic resources; and
WHEREAS, the proposal should not result in an adverse change to natural resources; and
WHEREAS, the proposal should not result in a significant increase in the potential for erosion,
flooding or drainage problems; and
WHEREAS, the proposal should not create a hazard to environmental resources or human
health.
NOW, THEREFORE BE IT RESOLVED that the Town Board of the Town of Ulysses hereby makes
a negative determination of environmental significance in accordance with the Consolidated
Laws of New York Article 8 of the Environmental Conservation Law and NYCRR SEQR for the
above referenced action as proposed, based on the information in the SEAF Part 1 and for the
reasons set forth above and in SEAF Parts 2 and 3, and therefore, an Environmental Impact
Statement will not be required.

RESOLUTION 2025-90: ADOPTING LOCAL LAW 2 OF 2025- REPEALING AND REPLACING
CHAPTER 89 ENTITLED “FLOOD DAMAGE PREVENTION”
WHEREAS, the Town Board finds the following:
1. The Town of Ulysses has several areas within the Town that are subject to periodic
flooding or have the potential to experience damages from flood waters during storm
events.

2. The potential and/or actual damages from flooding and erosion may be a problem to
the residents of the Town of Ulysses and that such damages may include: destruction
or loss of private and public housing, damage to public facilities, both publicly and
privately owned, and injury to and loss of human life.
3. The Town of Ulysses participates in the National Flood Insurance Program (NFIP) so
properties in Ulysses remain eligible for flood insurance.
4. The Federal Emergency Management Agency (FEMA) periodically updates the Flood
Insurance Study for Tompkins County, to provide more accurate information
concerning flood risks and impact, including properties located in Ulysses.
5. FEMA has established a deadline of June 18, 2025, for local jurisdictions to adopt
revised flood damage prevention regulations to minimize the potential for damages
from flood events.
6. FEMA has adopted new Flood Insurance Rate Maps that change the areas in Ulysses
that are expected to be vulnerable to damages from flood events.
7. A new set of Flood Damage Prevention regulations have been proposed by FEMA for
local jurisdictions to use to implement that will regulate uses which are dangerous to
health, safety and property due to water or erosion hazards, or which result in
damaging increases in erosion or in flood heights or velocities; require that uses
vulnerable to floods, including facilities which serve such uses, be protected against
flood damage at the time of initial construction; control the alteration of natural
floodplains, stream channels, and natural protective barriers which are involved in the
accommodation of flood waters; control filling, grading, dredging and other
development which may increase erosion or flood damages; regulate the construction
of flood barriers which will unnaturally divert flood waters or which may increase flood
hazards to other lands; and qualify and maintain for participation in the National Flood
Insurance Program.
8. The objectives of the new set of Flood Damage Prevention regulations are to protect
human life and health; to minimize expenditure of public money for costly flood
control projects; to minimize the need for rescue and relief efforts associated with
flooding and generally undertaken at the expense of the general public; to minimize
prolonged business interruptions; to minimize damage to public facilities and utilities
such as water and gas mains, electric, tele-phone, sewer lines, streets and bridges
located in areas of special flood hazard; to help maintain a stable tax base by providing
for the sound use and development of areas of special flood hazard so as to minimize

future flood blight areas; to provide that developers are notified that property is in an
area of special flood hazard; and to ensure that those who occupy the areas of special
flood hazard assume responsibility for their actions.
9. The Town' s current flood hazard local law became effective on March 11, 1987.
10. To minimize the threat of damages, and to achieve the purposes and objectives noted
above, the amended local law for Flood Damage Prevention as drafted is warranted.
11. The Town Board finds that it is in the public interest to adopt this local law, and that
such local law is necessary to promote the public health, safety, and general welfare,

and to minimize public and private losses due to flood conditions in specific areas.
NOW, THEREFORE, THE TOWN OF ULYSSES RESOLVES THE FOLLOWING:
Section 1. FINDINGS OF FACT.
The Recitals set forth above are adopted as the Findings of Fact in support of adoption of this
local law.
Section 2. REPEALER AND REPLACEMENT.
Local Law No. 2 of 2025 entitled “A Local Law Repealing and Replacing Chapter 89 of the Town
Code entitled “Flood Damage Prevention” is hereby adopted.
Section 3. EFFECTIVE DATE.
This resolution will take effect upon the filing of Local Law No. 2 of 2025 with the Department
of State.

2025 WATER QUALITY IMPROVEMENT PROJECT – NON-AGRICULTURAL NONPOINT SOURCE ABATEMENT
AND CONTROL
WHEREAS, the Town of Ulysses, Tompkins County, supports the submission of a 2025 New York State
Department of Environmental Conservation (NYS DEC) Water Quality Improvement Project (WQIP) on
behalf of the Town to construct improvements to the Agard Road culvert; and
WHEREAS, the NYS DEC provides competitive statewide grant funding through the Non-agricultural
Nonpoint Source Abatement and Control project subcategory for the replacement of culverts and the Town of
Ulysses considers this project a priority; and
WHEREAS, if funding is received, it will allow the Town to replace this deficient culvert and address erosion
and aquatic connectivity in the area; and
NOW THEREFORE BE IT RESOLVED, the Town Board, on behalf of the Town, identifies the Town
Supervisor as the authorized representative for the project, able to execute necessary documents relative to and
as required for this application; and
BE IT FURTHER RESOLVED, the Town Board does hereby acknowledge the required 25% match for all
grant funding awarded as a local match in the form of in-kind services or cash contributions, hereby
appropriated and obligated; and
BE IT FURTHER RESOLVED, that the Town Board of the Town of Ulysses recognizes and fully supports
the submission of the WQIP for a Non-Agricultural Nonpoint Source Abatement and Control grant by MRB
Group on behalf of the Town, aligning with the June 2024 Engineering Feasibility Study for a Culvert
Replacement Project.

WHEREAS, Nathan VanWhy, of the firm Coughlin and Gerhart, has served as general legal counsel to the
Town of Ulysses since January 2022; and
WHEREAS, Nathan VanWhy is establishing his own private practice, NDV LAW, PLLC; and
WHEREAS, ongoing litigation in code and zoning enforcement are currently being handled by other attorneys
at Coughlin and Gerhart; and
WHEREAS, under NYS and the Town of Ulysses Procurement Policy, the Town Board can authorize
contracting for professional services as needed, and these services are reviewed annually at the Town’s
Organizational Meeting;

for Krums Corners due to resident concerns about safety and excessive speed; and
WHEREAS, Assemblymember Anna Kelles’ office has made the Town aware that the NYS Department of
Transportation (NYS DOT) is undertaking another speed study, and residents remain concerned about safety;
THEREFORE, BE IT RESOLVED, that the Ulysses Town Board authorizes the Town Supervisor to submit a
letter on behalf of the Town of Ulysses to the NYS DOT for the Town Board’s continuing support of a speed

WHEREAS, new New York State permitting requirements necessitate the Storm Water Coalition to provide
public education; and
WHEREAS, the coalition is sharing the costs of this new expenditure, and it has been approved by nearly all

WHEREAS, Gorge Road does not have a suitable shoulder for safely allowing routine parking in the right of
way; and
WHEREAS, the Highway Superintendent is in favor of temporarily closing parking along a portion of Gorge
Road to determine if it helps improve public safety;

RESOLUTION 2025-115: AUTHORIZING DRAFTING OF REZONING LOCAL LAW AND
RELATED MATTERS
WHEREAS, Chad Doolittle previously submitted an application to the Town of Ulysses to
rezone the western portion of property located at 2012 Trumansburg Rd., Trumansburg, NY
14886, tax parcel no. 20.-3-1, from Development District 3 to Residential, and the eastern
portion of said property from Development District 3 to Business; and
WHEREAS, the Town Board has received and reviewed the recommendation from the Town of
Ulysses Planning Board to rezone the entire property as Residential; and
WHEREAS, Mr. Doolittle has submitted an amended application to the Town of Ulysses to
rezone only the western portion of property located at 2012 Trumansburg Rd., Trumansburg,
NY 14886, tax parcel no. 20.-3-1, from Development District 3 to Residential, leaving the
eastern portion of said property as Development District 3; and
WHEREAS, said application includes a draft plan showing an intent to subdivide such western
portion of property into three separate lots, but does not include a legal description of the
area proposed for rezoning; and
WHEREAS, the Town Board wishes to consider the proposed rezoning and intends to draft a
local law implementing such rezoning for further Town Board consideration and public review,
after submission by the applicant of an updated survey and legal description for the area to be
rezoned; and
WHEREAS, the Town Board further deems it necessary to ensure the costs and expenses of
the Town’s professional consultants engaged for the drafting, review, and implementation of
the rezoning local law are reimbursed through an escrow agreement; and
WHEREAS, the Town Board intends to act as lead agency for the purposes of environmental
review of the proposed rezoning and related subdivision under the New York State
Environmental Quality Review Act (SEQRA), and to preliminarily classify this action as an
Unlisted Action; and
WHEREAS, the Town Board, as an interested agency, has identified the following additional
involved and interested agencies for which Lead Agency coordination must be conducted:

• US Federal Emergency Management Agency
• New York State Department of Environmental Conservation
• New York State Department of Transportation
• New York State Department of Agriculture and Markets

RESOLVED, that the Town Board shall continue to consider the recommendations of the
Planning Board and Tompkins County, and shall undertake any and all actions necessary to
further consider the proposed rezoning in accordance with applicable law; and be it further
RESOLVED, upon submission of the updated survey and legal description and drafting of the
related local law, the Town Supervisor shall cause a notice of intent to act as lead agency be
submitted to all identified involved and interested agencies; and be it further

with NY DEC staff to prepare this robust draft; and

RESOLUTION 2025-122: AUTHORIZING TOWN SUPERVISOR TO ENTER INTO DONATION
AGREEMENT AND PURSUE NECESSARY APPROVALS FOR THE ESTABLISHMENT OF THE FIRST
PUBLICLY OWNED TOWN OF ULYSSES PARK
WHEREAS, Marvin and Allison Pritts, owners of property located at 5150 Cold Springs Rd.,
Trumansburg, NY, have offered to donate approximately 15.234 acres of land to the Town of
Ulysses for the purpose of establishing the first publicly owned Town of Ulysses park; and
WHEREAS, the Town Board is grateful for this generous offer, which provides the opportunity
for substantial recreational and environmental benefits to the community and future
generations; and
WHEREAS, the proposed donation requires approval from the Town of Ulysses Board of
Zoning Appeals for an area variance, specifically 12 feet of relief from the required 50 feet of
frontage, and approval from the Town Planning Department for a minor subdivision in order
to create a flag lot, or in either case a determination by the Town Board that this action is
immune from zoning and subdivision review; and
WHEREAS, the Town Board of the Town of Ulysses has reviewed the environmental
significance of this action pursuant to the New York State Environmental Quality Review Act
(SEQRA) and has determined that the action will have no significant adverse environmental
impacts;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Ulysses hereby
authorizes the Town Supervisor, Katelin Olson, to execute a donation agreement with Marvin
and Allison Pritts for the donation of approximately 15.234 acres of land located at 5150 Cold
Springs Rd., Trumansburg, NY, for the express purpose of establishing the first park owned by

the Town of Ulysses, in the form attached hereto and incorporated herein as Exhibit A; and be
it further
RESOLVED, that the Town Board expressly reserves its right to review and make a
determination regarding the Town’s immunity from its zoning and subdivision regulations, if in
the best interests of the Town of Ulysses, and otherwise authorizes and directs the Town

ROAD
WHEREAS, Waterburg Road is a Tompkins County road within the Town of Ulysses and
WHEREAS, residents have requested a speed study, and
WHEREAS, the Ulysses Highway Superintendent has reviewed the road conditions and supports a speed
study and a speed reduction, contingent on enforcement, and
WHEREAS, §1622 of the New York State Vehicle and Traffic Law establishes the law regarding speed
limits on town highways, and
WHEREAS, this law states that the Department of Transportation, upon the request of the county
superintendent of highways of a county, and the town board of the town affected with respect to town
highways in such town outside of cities or villages, may, by order, rule or regulation: (1) Establish maximum
speed limits at which vehicles may proceed on or along such highways higher or lower than the fifty-five
miles per hour statutory maximum speed limit. No such limit shall be established at less than twenty-five
miles per hour, except that school speed limits may be established at not
less than fifteen miles per hour, (2) Establish maximum speed limits at which vehicles may proceed on or
along all such highways lying within an area as designated by a description of the boundaries of such area
submitted by the county superintendent of highways of a county and the town board of the town affected
lower than fifty-five miles per hour statutory maximum speed limit. No such limit shall be established at less
than thirty miles per hour,

RESOLUTION 2025-138: CREATION OF CLEANER POSITION FOR THE TOWN
WHEREAS, the Town of Ulysses currently utilizes an outside contractor to perform cleaning services at the
Town Hall, and
WHEREAS, obtaining competitive vendor quotes from time to time is a best practice; and
WHEREAS, it has been difficult to obtain multiple acceptable vendor quotes for cleaning services due to
prevailing wage requirements for contractors; and
WHEREAS, after internal conversations, it has been determined that it will be better to employ someone
rather than seek competitive quotes for the cleaning contract at this time; and
WHEREAS, the Town Board must establish a position and pay rate to hire a Cleaner; and
WERREAS, it has been determined that the estimated total cost of such a position will not exceed the funds
available for contracted cleaning services;
NOW THEREFORE BE IT RESOLVED that the Ulysses Town Board approves the position of Cleaner as
listed in Tompkins County Personnel job descriptions; and be it
FURTHER RESOLVED that the pay rate will be approved at $22 per hour in the 2025 budget; and be it

regulation: (1) Establish maximum speed limits at which vehicles may proceed on or along
such highways higher or lower than the fifty-five miles per hour statutory maximum speed
limit. No such limit shall be established at less than twenty-five miles per hour, except that
school speed limits may be established at not less than fifteen miles per hour, (2) Establish
maximum speed limits at which vehicles may proceed on or along all such highways lying
within an area as designated by a description of the boundaries of such area submitted by the

RESOLVED, that the Ulysses Town Board approves and authorizes Mary Bouchard, Rich Goldman, Katelin
Olson, and Elizabeth Weatherby to seek independent legal counsel of their choice concerning the referenced
action, subject to compliance with the terms and conditions set forth in Chapter 14 of the Town Code, to be
paid for by the Town of Ulysses; and be it
FURTHER RESOLVED, that the Town of Ulysses will cover any litigation costs not covered by the insurance
company through the duration of the lawsuit and any future appeals.
