TOWN BOARD MEETING
Town of Ulysses
June 24, 2025
The meeting was held in person at the Town Hall at 10 Elm St., Trumansburg NY as well as via Zoom
videoconference. Notice of Town Board meetings are posted on the Town’s website and Clerk’s board.

CALL TO ORDER:
Ms. Olson called the meeting to order at 7pm.

APPROVAL OF AGENDA:
Ms. Olson requested to pull the culvert item from Old Business.
Mr. Boggs moved to approve the agenda as amended. This was seconded by Ms. Bouchard and
passed unanimously.
PRIVILEGE OF THE FLOOR (3 minutes per person):
Ms. Marino suggested that Clean Energy Communities be added to the NYSERDA resolution. She
further noted that the Water Source Protection Plan will probably be available for the board in late
July or early August. She also asked that it be noted that the Department of Health folks who assisted
the committee with the well studies have lost their job due to federal cutbacks.
CONSENT AGENDA (Resolutions #97-99):
RESOLUTION # 97 OF 2025: ANNUAL ROAD CLOSURES FOR GRASSROOTS FESTIVAL

RESOLVED, the Ulysses Town Board authorizes the temporary closure of parking along Falls
Road between Cemetery Road and Cayuga View; Cemetery Road between Route 96 and Falls
Road; and Rabbit Run between South Street Ext. and Route 96 from Sunday, July 13, 2025
through Sunday, July 20, 2025; and be it
FURTHER RESOLVED, that the Ulysses Town Board directs the Highway Superintendent to post
the road closures.
RESOLUTION # 98 OF 2025: ANNUAL CANCELLATION OF SECOND AUGUST MEETING
RESOLVED, the Ulysses Town Board cancels its regular second meeting in August.
RESOLUTION #99 OF 2025: APPOINTMENT TO THE BOARD OF ZONING APPEALS
RESOLVED, the Ulysses Town Board appoints Jonathan Ferrari to the Ulysses Board of Zoning
Appeals for a term expiring December 31, 2027.

OLD BUSINESS:
NYSERDA CONTRACT FOR SOLAR PROJECT AT THE HIGHWAY BARN
Ms. Olson noted that this will be ground-mount solar rather than roof-top.
Ms. Marino gave a brief overview of the project, saying that we will be able to install up to 44kw at
that site which will help with town hall electricity and assist the town in producing independent
electricity.
RESOLUTION # 100 OF 2025: NYSERDA CONTRACT FOR SOLAR PROJECT AT THE HIGHWAY
BARN
RESOLVED, the Ulysses Town Board authorizes the Town Supervisor to sign the contract with
New York State Energy Research and Development Authority (NYSERDA) accepting up to
$100,000 for the installation of a solar project at the Highway Barn, pending legal approval
and alteration of the contract to name Teressa Naylor as the project director; and be it
FURTHER RESOLVED, that the Ulysses Town Board thanks Roxanne Marino for her steadfast
work on behalf of the Town on sustainability projects, and most particularly the NYSERDA
Clean Energy Community credits that make this solar project possible.

GATEKEEPER RESOLUTION FOR THE 2025 WATER QUALITY IMPROVEMENT PROJECT (WQUIP)–
NON-AGRICULTURAL NON-POINT SOURCE (NPS) ABATEMENT AND CONTROL
Ms. Olson noted that the town had previously authorized MRB to do a study of this culvert in
preparation for applying for grant funding.
RESOLUTION # 101 OF 2025: GATEKEEPER RESOLUTION FOR THE 2025 WATER QUALITY
IMPROVEMENT PROJECT – NON-AGRICULTURAL NONPOINT SOURCE ABATEMENT AND
CONTROL
WHEREAS, the Town of Ulysses has undertaken the necessary engineering studies to qualify
for the NYS Department of Environmental Conservation’s WQIP funding program; and
WHEREAS, funds are available for this program in the 2025 Consolidated Funding Application;
and
WHEREAS, the MRB Group has identified the Agard Culvert as a high priority culvert for
replacement or substantial repair;
NOW, THEREFORE, BE IT
RESOLVED, that the Ulysses Town Board authorizes the Town Supervisor to submit an
application for the 2025 Water Quality Improvement Project – Non-Agricultural Nonpoint
Source (NPS) Abatement and Control for the Agard Road Culvert.

SUPPORT & AUTHORIZATION FOR THE TOWN OF ULYSSES 2025 WATER QUALITY IMPROVEMENT

RESOLUTION #102 of 2025: SUPPORT & AUTHORIZATION FOR THE TOWN OF ULYSSES
2025 WATER QUALITY IMPROVEMENT PROJECT – NON-AGRICULTURAL NONPOINT SOURCE
ABATEMENT AND CONTROL

WHEREAS, the Town of Ulysses, Tompkins County, supports the submission of a 2025 New
York State Department of Environmental Conservation (NYS DEC) Water Quality Improvement
Project (WQIP) on behalf of the Town to construct improvements to the Agard Road culvert;
and
WHEREAS, the NYS DEC provides competitive statewide grant funding through the Non-
agricultural Nonpoint Source Abatement and Control project subcategory for the replacement
of culverts and the Town of Ulysses considers this project a priority; and
WHEREAS, if funding is received, it will allow the Town to replace this deficient culvert and
address erosion and aquatic connectivity in the area; and
NOW THEREFORE BE IT RESOLVED, the Town Board, on behalf of the Town, identifies the
Town Supervisor as the authorized representative for the project, able to execute necessary
documents relative to and as required for this application; and
BE IT FURTHER RESOLVED, the Town Board does hereby acknowledge the required 25%
match for all grant funding awarded as a local match in the form of in-kind services or cash
contributions, hereby appropriated and obligated; and
BE IT FURTHER RESOLVED, that the Town Board of the Town of Ulysses recognizes and fully
supports the submission of the WQIP for a Non-Agricultural Nonpoint Source Abatement and
Control grant by MRB Group on behalf of the Town, aligning with the June 2024 Engineering
Feasibility Study for a Culvert Replacement Project.

NEW BUSINESS:
SIGNING LETTER OF ENGAGEMENT FOR NDV LAW
RESOLUTION #103 of 2025: SIGNING LETTER OF ENGAGEMENT FOR NDV LAW
WHEREAS, Nathan VanWhy, of the firm Coughlin and Gerhart, has served as general legal
counsel to the Town of Ulysses since January 2022; and
WHEREAS, Nathan VanWhy is establishing his own private practice, NDV LAW, PLLC; and
WHEREAS, ongoing litigation in code and zoning enforcement are currently being handled by
other attorneys at Coughlin and Gerhart; and
WHEREAS, under NYS and the Town of Ulysses Procurement Policy, the Town Board can
authorize contracting for professional services as needed, and these services are reviewed
annually at the Town’s Organizational Meeting;

NOW, THEREFORE, BE IT
RESOLVED, that the Ulysses Town Board authorizes the Town Supervisor to sign a letter of
engagement with NDV LAW, PLLC for general municipal services; and be it
FURTHER RESOLVED, that the Ulysses Town Board authorizes the Town Supervisor to sign
paperwork that allows ongoing legal cases related to code and zoning enforcement to remain
with Coughlin and Gerhart.
