Old Business Items SPR2409-01: Lex New Detached Dwelling Unit, Site Plan Review & Public Hearing 1332 Taughannock Blvd, Parcel Number: 27.-4-2.21 The applicant and property owner, Eran Lex, proposes to construct a new detached dwelling unit and associated infrastructure on the undeveloped parcel noted above. Per the Code of the Town of Ulysses (CTU) 212-51.B, single-family residences are permitted in the CZ zone but require site plan review when Planning Board Meeting Minutes Page 2 of 4 December 3, 2024 within a unique natural area or slope overlay area, pursuant to the provisions listed under CTU 212-19. An unidentified resident spoke about the site plan review process and questioned how compliance with approved plans is enforced, referencing a neighboring home that was permitted in 2016 that he believes was not built as approved. Klein responded that both the Planning Board members and Town staff have changed since 2016, but the issue will be looked into. No comments pertaining to the proposed dwelling unit were received. Motion: Klein motioned to approve Planning Board Resolution No. 2024-020: A Resolution of Final Site Plan Approval for the Lex New Detached Dwelling Unit Located at 1332 Taughannock Boulevard, Town of Ulysses, Tax Parcel 27.-4-2.21; Liddle seconded. SPR2410-01: Friedman Change of Use, Site Plan Review & Public Hearing 1708 Trumansburg Rd, Parcel Number 34.-1-9 The applicant, Josh Friedman of Friedman Properties LLC, proposes a change of use of an existing building for a residential dwelling unit to retail store for a NYS licensed cannabis dispensary located at the address noted above. Per the Code of the Town of Ulysses (CTU) 212-89.W, retail stores are permitted in the B1 zone but require site plan review pursuant to the provisions listed under CTU 212- 19. Friedman stated that the only changes to the site plan are the removal of one parking spot and the addition of details about lighting. Klein asked if Friedman had discussed ADA compliance with the New York State. Friedman responded yes, he was told packed gravel is ok but not great, and he would like to eventually pave the parking lot. George Cameron of 3111 Van Dorn Corners Rd shared concerns about the business being inappropriate in a neighborhood with young kids and mentioned traffic safety concerns. Margot McClure of 3159 Van Dorn Corners Rd shared concerns about traffic safety, noting in the dark the sharp turn is difficult to navigate. An unidentified resident of Van Dorn Corners Rd expressed that the entire neighborhood should have been notified. Randy French 3172 Van Dorn Corners Rd expressed concerns about visibility for drivers when entering and exiting the parking lot. Sally Maragni of 3169 Van Dorn Corners Rd spoke about the street not needing a business as it is a rural Planning Board Meeting Minutes Page 3 of 4 December 3, 2024 residential road, but Mama Said is a good restaurant. Doug Ellison of 3156 Van Dorn Corners Rd stated he did not want to see a business open here. McClure asked about age restrictions. Friedman responded that 21 is the minimum age for entry, and although he could employ someone as young as 18, he would not. Anyone underage is not permitted to enter, even when accompanied by a parent, and IDs will be scanned at the door. Friedman will operate the store. No use of cannabis is allowed on site. It is like a liquor store where you get what you want and then you go home. There will be perimeter security as required by the state. Products are stored in a secure access-controlled room like a vault. Customers say what they want, and orders are fulfilled in the back like a pharmacy. Bernnard asked if there is any anticipation of increased traffic. Friedman responded that he believes most customers will stop on the way during their commute. If it gets busy inside, he will limit how many people can enter. Klein suggested to Friedman that he contact DOT to ask about lighting for the intersection. Friedman said he would be happy to do this but thinks support from the Town would help. Tygesen mentioned that Van Dorn Corners Rd is a Town road so adding lighting there instead of on Route 96 may be more straightforward. Pete Houghton of 1333 Taughannock Blvd stated that he is a retired engineer from DOT and unless things have changed, they do not get involved in lighting. A permit from NYSEG to get a light and pay for it and the electricity could be obtained, or the Town could create a lighting district. The state is not going to put up a streetlight at a state and town intersection, this is a local issue not a state issue. Cameron asked why no one responded to the concerns about the type of business and asked if zoning was being changed. Chair Klankowski responded no, the zoning is not changing, the parcel is already zoned business, the zoning allows this business, and what is changing is just the use of the building from residential to commercial. Klein asked Friedman about state licensing. Friedman confirmed that part of the reason New York State approved the license is because Ulysses zoning allows a business here. Chair Klankowski explained that the Planning Board does not change zoning, and these concerns should be brought to the Town Board. Concerns about traffic issues and lighting can be addressed by the Planning Board. Motion: Klein motioned to close public hearing for SPR2410-01; Liddle seconded. New Business Items MGSUB2402-01: Bartishevich 2 Lot Major Land Division, Final Plat Review 7615 Willow Creek Rd, Parcel Number 14.-4-4.12 The applicant and property owner, Karen Bartishevich, applied for a major subdivision to subdivide the existing 17.75 acre lot into three lots; ‘Parcel A’, approximately 5.41 acres, ‘Parcel B’, approximately 7.59 acres, and ‘Parcel C’, approximately 4.75 acres. Per the Code of the Town of Ulysses (CTU) 212-141.A, subdivision of land resulting in three or more lots (including the parent lot) from the same original parent lot within three years is considered a major subdivision. The A/R zone requires a minimum lot area of 2 acres, 200 feet of lot depth, and 400 feet of lot width at the front lot line per CTU 212-29. Per
