Approval of Agenda Motion: Liddle motioned to approve the agenda as written; Gragg seconded. Vote: Liddle, aye; Gragg, aye; Klein, aye; McDonald, aye; Chair Klankowski, aye. Motion Carried. Approval of Past Minutes Motion: Gragg motioned to approve the amended August 20 meeting minutes; Gragg seconded. Vote: Liddle, aye; Gragg, aye; Chair Klankowski, aye; Klein, abstain; McDonald, abstain. Motion Carried. Privilege of the Floor No members of the public addressed the Board pertaining to items not on the agenda. Motion: Klein motioned to close privilege of the floor; Liddle seconded. Old Business Items MNSUB2310-04: Bennett 2 Lot Land Division, Sketch Plat Review 4450 Ploss Lane, Parcel Number 12.-3-12.2 The applicant, Charles Guttman, on behalf of the property owners, Marcie Bennett-Gray and Thomas Bennett Jr., applied for a minor subdivision for the subject site to subdivide the existing 1.56 acre lot into two lots. The R zone requires a minimum lot area of 32,000 square feet for lots with public water, 200 feet of lot depth, and 160 feet of lot width at the front lot line per the Code of the Town of Ulysses (CTU) 212-40. Guttman requested to grant final approval with the condition that nothing further can be built on the small parcel. The home is connected to municipal water and sewer. Motion: Klein motioned to schedule a public hearing for the October 1 meeting; Gragg seconded. Vote: Liddle, aye; Gragg, aye; Klein, aye; McDonald, aye; Chair Klankowski, aye. Motion Carried. Planning Board Meeting Minutes Page 2 of 3 September 17, 2024 SPR2407-01: Crown Trumansburg - AT&T Generator Final Site Plan Review 3250 Mekeel Road, Parcel Number 24.-2-5.22 The applicant, Catherine Conklin, AT&T agent on behalf of the owners Crown Castle, proposes to install a new back-up self-contained 30kW diesel generator and 4'x10' concrete pad within the leased area of the existing telecommunications tower. Per the Code of the Town of Ulysses (CTU) 212-145, the proposed generator is defined as a ‘telecommunications facility’, and per CTU 212-27.E, telecommunications facilities are permitted in the A/R zone but require site plan approval from the Planning Board. The applicant was not present. Tygesen noted that the County stated there would be no negative impact. No comments from neighbors have been received. Motion: Gragg motioned to accept Planning Board Resolution 2024-17: Resolution of SEQR Determination for the Crown Trumansburg AT&T Generator Site Plan Located at 3250 Mekeel Road, Town of Ulysses, Tax Parcel 24.-2-5.22; Klein seconded. Vote: Liddle, aye; Gragg, aye; Klein, aye; McDonald, aye; Chair Klankowski, aye. Motion Carried. Motion: Gragg motioned to accept Planning Board Resolution 2024-18: A Resolution of Final Site Plan Approval for the Crown Trumansburg AT&T Generator Site Plan Located at 3250 Mekeel Road, Town of Ulysses, Tax Parcel 24.-2-5.22; Klein seconded. Vote: Liddle, aye; Gragg, aye; Klein, aye; McDonald, aye; Chair Klankowski, aye. Motion Carried. Zoning Code Amendments ZCA2408-01: 212 Article XVIII Park/Recreation Zone Zoning Code Amendment Tygesen explained that the Salo Habitat Preserve never obtained a special use permit; parks are not a permitted use in the Park/Recreation Zone without a special permit. The Town Board is considering adding “public and private community parks, regional parks and preserves” as an outright permitted use in the PR zone. Gragg asked what unintended consequences could emerge. Tygesen noted that the largest area in the park zone is Taughannock State Park, and the State is not required to comply with Ulysses zoning laws. Discussion ensued over the definition of a park. Gragg asked when the Town Board found out about this; Tygesen recalled the discussion began after the Town received a grant from the County for improvements to the park including new boardwalks and picnic tables, from there the discussion developed into allowable uses and past decisions of the Town. The Board expressed agreement that removing the special permit requirement for parks in the PR Zone may present risks that outweigh possible benefits. In addition to Taughannock Falls State Park, other park zoned properties are the Girl Scouts Camp, Cayuga Nature Center, Smith Woods, Trumansburg Golf Course, and Jacksonville Park. Chair Klankowski suggested it is not functional to have a park zone where a park is not a permitted use. Tygesen suggested that a recommendation could be made to allow the special permit requirement to be removed for publicly owned parks only. The Board requested Tygesen draft a memo to the Town Board to be reviewed by Planning Board
