The meeting was held in person at the Town Hall at 10 Elm St., Trumansburg NY as well as via Zoom

Ms. Olson called the meeting to order at 7pm.

APPROVAL OF AGENDA:
Motion:
Mr. Boggs moved to approve the agenda as presented. This was seconded by Mr. Goldman and
passed unanimously.

PUBLIC HEARING: A LOCAL LAW TO AMEND THE ZONING CODE- BZA
Mr. Goldman moved to open the hearing at 7:02pm. This was seconded by Ms. Weatherby and
passed unanimously.
Ms. Olson asked whether anyone online or in person wished to address the board. No one
responded.
She noted that the local law is related to public noticing for Board of Zoning Appeals projects- signs
will be required on applicant properties.

Mr. Goldman moved to close the hearing at 7:04pm. This was seconded by Ms. Weatherby and
passed unanimously.
PUBLIC HEARING: A LOCAL LAW TO AMEND THE ZONING CODE- PARK/REC ZONE
Ms. Olson explained that this local law would allow parks in the Park/Recreation Zone to be listed as
an allowed use. Currently, a special permit is needed for parks.
Mr. Boggs moved to open the hearing at 7:05pm. This was seconded by Ms. Weatherby and passed
unanimously.
Mr. Klankowski asked how the board was planning to deal with the USGS intermittent stream in the
Salo Drive/Habitat parcel. He said that there are discrepancies between GIS and USGS maps that
create issues for determining setbacks, etc.
The clerk noted that two comments were received, both in favor of the local law. (See attached).
Mr. Boggs moved to close the hearing at 7:09pm. This was seconded by Ms. Bouchard and passed
unanimously.
DISCUSSION:
Mr. Goldman asked Mr. Klankowski to clarify the relationship between the streams and the P/R law
change.
Mr. Klankowski said that the town’s zoning code has not authorized usage of the GIS stream
definitions so it doesn’t seem as if we can require setbacks according to that map.
Mr. Klankowski recommends that the Town Planning Dept. clearly identify whether the streams are
USGS or GIS.
Ms. Olson suggested that the Planning Board talk to legal counsel to see what can/should be done.
MUNICIPAL BOARD & STAFF REPORTS & ANNOUNCEMENTS:
Ms. Liddle said that a 2nd round of water testing was done by the NYS Dept. of Health. Results are
forthcoming. The committee will have a first draft of the water protection plan soon.
OLD BUSINESS:
2025 Budget:
Ms. Taetzsch shared updates to the budget since the last meeting.
She noted that the following with regards to the B Fund (town outside village):
• Can only use sales tax in this fund
• 2025 appropriations exceed the Fund Balance policy
• More money has been added for enforcement-related costs (legal and staffing) and the town
will likely not be able to collect any revenue (fines, etc.) to offset this
• Funds requested for additional water testing
• New expense for a GEIS (generic environmental impact study) to do along with the
Comprehensive Plan update
Mr. Tygesen gave more information on the GEIS:

• DEC, Town Planner, Attorney for the Town recommend doing it now as a best practice
• Some of the cost will be covered under the current grant so it will cost the town ~ $37,000
The group discussed how to fund these items.
APPROVING LOCAL LAW NO. 3 OF 2024- BOARD OF ZONING CODE APPEALS ZONING CODE
AMENDMENT
RESOLUTION # 153 OF 2024: APPROVING LOCAL LAW NO. 3 OF 2024- BOARD OF ZONING
CODE APPEALS ZONING CODE AMENDMENT
WHEREAS, the Town Board passed Resolution #142 of 2024 on September 10, 2024 to
schedule a public hearing on the proposed action for October 8, 2024; and
WHEREAS, notice was given that the Town Board scheduled a public hearing for October 8 at
7:00 p.m. for Local Law No.3 of the Year 2024 entitled “Board of Zoning Appeals Zoning Code
Amendment”; and
WHEREAS, notice of said public hearing was duly advertised in the official newspaper of the
Town on Sept. 17, 2024, was posted on the Town’s website, and was posted on the Town
Clerk’s signboard; and
WHEREAS, pursuant to General Municipal Law Article 12-B Sections 239 L, M, and N of the
Consolidated Laws of New York the proposal was submitted to Tompkins County for review;
and
WHEREAS, the Department of Planning & Sustainability of Tompkins County submitted their
response letter to the Town dated September 13, 2024 that states they determined the
proposed action will have no significant county-wide or inter-community impact; and
WHEREAS, the Board of Zoning Appeals reviewed the proposal on July 17, 2024; and
WHEREAS, the Board of Zoning Appeals sent a memo to the Town Board dated August 21,
2024 that states they support the proposed code amendment; and
WHEREAS, said public hearing was duly held on the 8th day of October 2024 at 7:00 p.m. at
7:00 p.m. and all parties in attendance were permitted an opportunity to speak on behalf of
or in opposition to said proposed Local Law, or any part thereof; and
WHEREAS, in accordance with the Consolidated Laws of New York Article 8 of the
Environmental Conservation Law and the New York Codes, Rules, and Regulations Title 6, Part
617 State Environmental Quality Review, it was determined by the Town Board of the Town of
Ulysses on October 8, 2024 that adoption of the proposed Local Law constitutes an Unlisted
action, as defined under said regulations. The Town Board has considered the possible
environmental impacts of the Local Law. The adoption of said Local Law will not have a
significant adverse impact on the environment and the Town Board issued a negative
declaration of environmental significance with respect to the Local Law.
NOW, THEREFORE BE IT RESOLVED that the Town Board of the Town of Ulysses hereby
adopts said local law as Law No. 3 of the Year 2024 entitled “Board of Zoning Appeals Zoning
Code Amendment” as shown in Exhibit A attached hereto; and it is further

RESOLVED that the Town Clerk be and hereby is directed to enter said Local Law in the
minutes of this meeting and give due notice of the adoption of said Local Law to the Secretary
of State; and it is further
RESOLVED that this resolution will take effect immediately upon filing with the Department of
State.

SEQR FOR PARK/RECREATION ZONE ZONING CODE AMENDMENT
RESOLUTION #154 of 2024: SEQR DETERMINATION FOR A PROPOSED LOCAL LAW 4 OF 2024
TO AMEND THE CODE OF THE TOWN OF ULYSSES 212 ARTICLE XVIII- P/R ZONE
WHEREAS, the proposed action is in consideration of a proposal to adopt a Local Law that
would amend the Code of the Town of Ulysses 212 Article XVIII; and
WHEREAS, the proposed action is an Unlisted action under the New York Codes, Rules, and
Regulations (NYCRR) Title 6, Part 617 State Environmental Quality Review (SEQR), for which
the Town of Ulysses Town Board is acting as Lead Agency in respect to the proposed local law;
and
WHEREAS, the Town Board, at a public meeting held on October 8, 2024, has reviewed and
accepted as adequate the Short Environmental Assessment Form (SEAF), Part 1 for the
proposed action; and
WHEREAS, the proposal should not create a material conflict with the 2009 land use plan or
with the current zoning regulations; and
WHEREAS, the proposal should not result in a significant change in the use or intensity of use
of land; and
WHEREAS, the proposal should not impair the character or quality of the existing community;
and
WHEREAS, the proposal will not have an impact on the environmental characteristics that
caused the establishment of a Critical Environmental Area; and
WHEREAS, the proposal should not result in an adverse change to the existing level of traffic
or affect existing infrastructure for mass transit, biking, or walkways; and
WHEREAS, the proposal should not cause a significant increase in the use of energy; and

WHEREAS, the proposal should not significantly impact existing water supplies or wastewater
treatment utilities; and
WHEREAS, the proposal should not impair the character or quality of important historic,
archaeological, architectural or aesthetic resources; and
WHEREAS, the proposal should not result in an adverse change to natural resources; and
WHEREAS, the proposal should not result in a significant increase in the potential for erosion,
flooding or drainage problems; and
WHEREAS, the proposal should not create a hazard to environmental resources or human
health.
NOW, THEREFORE BE IT RESOLVED that the Town Board of the Town of Ulysses hereby makes
a negative determination of environmental significance in accordance with the Consolidated
Laws of New York Article 8 of the Environmental Conservation Law and NYCRR SEQR for the
above referenced action as proposed, based on the information in the SEAF Part 1 and for the
reasons set forth above and in SEAF Parts 2 and 3, and therefore, an Environmental Impact
Statement will not be required.

WHEREAS, the Town Board passed Resolution #153 of 2024 on September 10, 2024 to

NEW BUSINESS
RE-LEVY OF WATER DISTRICT 3 DELINQUENT WATER FEES
RESOLUTION # 156 OF 2024: RE-LEVY OF DELINQUENT WATER FEES FOR DISTRICTS 3 & 4

WHEREAS, Town Code Chapter 200-10(C)(2) provides for delinquent water bills, taxes,
assessments, fees, rents, or other service charges of Water District 3 & 4 to be placed on the
ensuing year's tax roll as a re-levy; and
WHEREAS, Town Code Chapter 200-10(C)(2) defines delinquent as "a period of at least 60
calendar days as of October 1 of any year"; and
WHEREAS, customers were notified that they could make payments on delinquent amounts
through Sept. 30, 2024,
NOW THEREFORE BE IT RESOLVED, that the Ulysses Town Board approves the re-levy of
unpaid delinquent water charges in the amount of $6237.49 to the 2025 Town and County Tax
Roll; and be it
FURTHER RESOLVED, that a certified copy of this resolution along with a listing of the
properties with re-levied water charges will be sent to the Tompkins County Assessment
Department for the purpose of adding these delinquent charges to the 2025 Town and County
Tax Roll.

NEW YORK STATE ENERGY RESEARCH AND DEVELOPMENT AUTHORITY AGREEMENT
Ms. Olson thanked Ms. Marino for her work on the project.
RESOLUTION # 157 OF 2024: NEW YORK STATE ENERGY RESEARCH AND DEVELOPMENT
AUTHORITY AGREEMENT
RESOLVED that the Ulysses Town Board authorizes the Town Supervisor to sign the New York
State Energy Research and Development Authority (NYSERDA) Agreement, accepting $50,000
towards the purchase of an electric vehicle; and be it
FURTHER RESOLVED, that the Ulysses Town Board directs the Town Clerk to submit the signed
contract to the appropriate contact at NYSERDA.

RESOLUTION #158 OF 2024: CHANGES TO THE 2025 TENTATIVE BUDGET, ADOPTION OF 2025
PRELIMINARY BUDGET, AND SETTING OF PUBLIC HEARING
WHEREAS, the Town Budget Officer presented the 2025 Tentative Budget to the Town Clerk
and the Town Board at the September 24th Regular Town Board meeting, and
WHEREAS, prior to the presentation of the Tentative Budget, there were three public sessions
to conduct line-by-line budget review on 9/9, 9/11, 9/12; and
WHEREAS, the Town Board discussed and considered the 2025 Tentative Budget on 9/24 in a
regular meeting and 10/9 in a regular meeting; and
WHEREAS, the following changes were made to the Tentative Budget at the 9/24 and 10/9
Regular Town Board meetings:
• Reduce A1910.4 Liability Insurance by $5,000 due to updated estimated from
Insurance Agent
• Increase A9060.8 Health Insurance by $1,000 based on increase in retiree health
insurance premium
• Increase A2610 Fines and Forfeited Bail by $3,000 based on updated estimate of
actual results through August 2024, and prior year performance
• Decrease A599, Appropriated Fund Balance by $7,000 to accommodate total A
fund revenue and expenditure adjustments
• Increase DA9060.8 Health Insurance by $2,500 based on increase in retiree health
insurance premium

Dear Clerk Parlato,
On behalf of the Jacksonville Community Association (JCA) which owns a 10-acre community park in the
Park/Recreation zone in the hamlet of Jacksonville, I would like to convey our support for the proposed zoning
amendment to make “Public and private community parks, regional parks and preserves” a permitted use without a
special permit.
In 2023, the JCA submitted plans to improve the accessibility of the park. Under the current zoning, we were
required to submit a Special Permit request to secure permission to make improvements to our park in the park
zone. The Special Permit application was in addition to the other applications required by the Planning Board and
Board of Zoning Appeals and was essentially a duplication of other documents we had to submit. To have our
Special Permit approved, the Town was required to spend time and money to conduct a public hearing on our
request. We were grateful to be granted the Special Permit along with site plan approval and zoning variances to
install a very small accessible parking area and path to our pavilion and ADA compliant restroom.
The proposed change makes common sense, reduces confusion, and improves efficiency for applicants and we urge
the Town Board to approve the amendment as presented.

EXHIBIT A OF LOCAL LAW #3 OF 2024 (RESOLUTION # 153):
Be it enacted by the Town Board of the Town of Ulysses as follows:
Section 1. Section 212-16 entitled “Board of Zoning Appeals” shall be amended as
follows:
A.(1) through (9) Remains the same.
A.(10) The Board of Zoning Appeals shall act in accordance with the provisions
hereinafter contained in this section, hold public hearings to determine appeals from
any refusal of a building permit or statement of compliance by the Zoning Officer, or
review any order, decision, interpretation or refusal thereof of the Zoning Officer,
where such order or decision is based upon the requirements of this chapter. An
appeal must be made within the time prescribed by the rules of the Board of Zoning
Appeals. All Board of Zoning Appeals procedures shall comply with Town Law § 267-a,
as amended from time to time. Notice of public hearings shall, in addition to all other
requirements for publication of a hearing notice pursuant to the Laws of the State of
New York, be posted on the subject property in a manner that is readily visible to the
public from the nearest adjacent public road at least 10 days prior to the subsequent
public hearing.
A.(11) Remains the same.
B through D Remains the same.
Section 2. Remainder
Except as hereinabove amended, the remainder of the Code of the Town of Ulysses
shall remain in full force and effect.
Section 3. Severability
The provisions of this Local Law are severable and if any provision, clause, sentence,
subsection, word or part thereof is held illegal, invalid, unconstitutional, or
inapplicable to any person or circumstance, such illegality, invalidity or
unconstitutionality, or inapplicability shall not affect or impair any of the remaining
provisions, clauses, sentences, subsections, words, or parts of this local law or their
application to other persons or circumstances. It is hereby declared to be the
legislative intent that this local law would have been adopted if such illegal, invalid, or
unconstitutional provision, clause, sentence, subsection, word or part had not been
included therein, and as if such person or circumstance, to which the local law or part
thereof is held inapplicable, had been specifically exempt therefrom.
Section 4. Effective Date

This Local Law shall take effect immediately upon filing with the New York State
Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.
EXHIBIT A OF LOCAL LAW #4 OF 2024 (RESOLUTION # 155):
Be it enacted by the Town Board of the Town of Ulysses as follows:
Section 1. Chapter 212 Article XVIII entitled “PR – Park/Recreation Zone” shall be
amended as follows:
110. Purpose. Remains the same.
111. Permitted uses.
In the PR — Park/Recreation Zone, no building or structure shall be erected, altered or
extended, and no land or building thereof shall be used for any purpose or purposes
other than the following:
A. Farm operation.
B. Public and private community parks, regional parks and preserves.
112. Uses permitted by special permit.
The following uses are allowed within the PR — Park/Recreation Zone upon approval
of a special permit pursuant to Article III, § 212-18, upon receipt of site plan approval
from the Planning Board pursuant to Article III, § 212-19, and subject to the design
standards set forth in relevant sections of Article XX:
A. Signs as regulated under Article XX, § 212-122.

Section 2. Remainder
Except as hereinabove amended, the remainder of the Code of the Town of Ulysses
shall remain in full force and effect.
Section 3. Severability
The provisions of this Local Law are severable and if any provision, clause, sentence,
subsection, word or part thereof is held illegal, invalid, unconstitutional, or
inapplicable to any person or circumstance, such illegality, invalidity or
unconstitutionality, or inapplicability shall not affect or impair any of the remaining
provisions, clauses, sentences, subsections, words, or parts of this local law or their
application to other persons or circumstances. It is hereby declared to be the
legislative intent that this local law would have been adopted if such illegal, invalid, or
unconstitutional provision, clause, sentence, subsection, word or part had not been
included therein, and as if such person or circumstance, to which the local law or part
thereof is held inapplicable, had been specifically exempt therefrom.
Section 4. Effective Date
This Local Law shall take effect immediately upon filing with the New York State
Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.
