WHEREAS, Highway Law #142-d allows co-operative agreements for highway services and sharing of labor,
equipment and supplies; and
WHEREAS, General Municipal Law Article 5-G allows and encourages municipal co-operations, by joint or
contract basis, performance of powers and duties among themselves; and
WHEREAS, it is deemed beneficial to the Town of Ulysses to allow for shared highway agreements of
equipment and services with other nearby municipal highway departments;
WHEREAS the Agreement for the Expenditure and Repair and Improvement of Highway Moneys is
authorized by Highway Law #284, and an agreement to cover Custody of Highway Moneys is authorized by
Highway Law #283.
NOW THEREFORE BE IT RESOLVED that the Ulysses Town Board authorizes the Town Town ’s Highway
Superintendent pursuant to Highway Law #284 to take such action to implement said agreements consistent
with Town highway needs and availability, and Supervisor pursuant to Highway Law #283 to enter into
agreements for shared services and equipment with other municipalities and authorize, within existing budget
constraints, the maintain sufficient liability coverage to protect the town in such joint efforts.

WHEREAS by law, the Town Board must approve these expenditures for highway maintenance, Therefore, be it

WHEREAS, the timely repairs of Highway equipment are vital to safe roads and Town operations, and
WHEREAS, equipment repair services are considered sole-source vendors due to the nature of the repairs,
which can be both highly specialized for a specific piece of equipment and/or under warranty through a
specific vendor; therefore
BE IT RESOLVED that the Ulysses Town Board recognizes that the Town Highway Superintendent is in
adherence with the procurement policy to procure repair services as required from the following sole source
vendors: Beam Mack, Caskey’s Garage, and Regional International Corp.

RESOLUTION 2024-13: FINANCIAL REPORTING: ANNUAL UPDATE DOCUMENT (AUD)
BE IT RESOLVED that an annual financial report must be presented to the Town Clerk within 30 days of the end of the
fiscal year as required by Town Law Section 29(10), and further
RESOLVED, in lieu of the financial report, the Supervisor is hereby required and authorized to submit an annual update
document (AUD) to the state comptroller and Town Clerk within 60 days after the close of the fiscal year, and further,
RESOLVED, that the Town Clerk shall cause a summary thereof to be published in accordance with the law (Town Law
Section 29(10-a)), and further
RESOLVED that if the state comptroller approves a 60-day extension of the AUD, the Supervisor’s time for filing a copy
of the AUD with the Town Clerk is also extended.
RESOLUTION 2024-14: FINANCIAL RECONCILIATIONS
BE IT RESOLVED the Town follow the 2013 recommendations of auditor Insero and Company to have the Supervisor or
Bookkeeper review the reconciliation of the Town Clerk’s bank statements and the Town Clerk’s office review the
reconciliation of the Supervisor’s bank statements in order to safeguard the town’s finances. This shall be done at least
quarterly and reported to the Town Board.
RESOLUTION 2024-15: FINANCIAL INSTITUTIONS
BE IT RESOLVED that Tompkins Community Bank is designated as depository, in which the Supervisor, Town Clerk,
Justices, and other employees by virtue of their offices, shall deposit all monies coming into their hands and,
FURTHER RESOLVED the Town investments can be made at other banks and institutions as outlined in the Town’s
investment policy. The Town investment policy shall be reviewed and approved by the Town Board periodically and
revised as necessary.

WHEREAS Town Law Section 123 requires that on or before the twentieth day of January an audit is performed for
each Town department, or alternately, prior to the twentieth day of January the town may schedule an annual audit
with a certified public accountant to take place within sixty days after the close of the town’s fiscal year;

Personnel Policy shall report time used for vacation, sick time, holiday or other time off on a Town of Ulysses time card

RESOLUTION 2024-28: TOWN OF ULYSSES TITLE VI COMPLIANCE PLAN AND NONDISCRIMINATION POLICY
WHEREAS, the Town of Ulysses is committed to providing a welcoming and inclusive environment for the
public, staff, elected officials, and volunteers to conducting the important business of the Town; and
WHEREAS, Title VI, 42 U.S.C. § 2000d et seq., was enacted as part of the landmark Civil Rights Act
of 1964, and prohibits discrimination on the basis of race, color, and national origin in programs and activities
receiving federal financial assistance; and
WHEREAS, the Town Board recognizes that the best way to demonstrate compliance with Title VI is to adopt
an actional training and reporting plan; and
WHEREAS, the Town Board reviewed and discussed this plan at the July 25, 2023 Town Board meeting;
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board adopts the Town of Ulysses Title VI Compliance Plan and
Nondiscrimination Policy; and be it

RESOLVED that all employees (including elected and appointed public officers) and members of the Comprehensive
Plan Steering Committee are required to complete annual trainings in sexual harassment prevention, Civil Rights Title
VI, and ethics; and be it
FURTHER RESOLVED, that the Second Deputy Town Supervisor, Town Attorney and/or his designees, and the Town
Bookkeeper are authorized to designate a date or dates between March 1, 2024 and June 30, 2024, for direct in-
person training of said employees (including elected and appointed public officer and members of the Comprehensive
Plan Steering Committee); and be it
FURTHER RESOLVED that the Town Board, Planning Board and Board of Zoning Appeals are each further authorized to
either attend any of the in-person trainings offered by the Town before June 30, 2024, or designate dates for separate,
direct in-person training, in coordination with the following key personnel: Second Deputy Town Supervisor (for the
Town Board), the Town Planner (for the Planning Board and Board of Zoning Appeals), the Town Attorney and/or his
designees, and the Town Bookkeeper; and be it
FURTHER RESOLVED that the Comprehensive Plan Steering Committee members are further authorized to attend any

RESOLUTION 2024-30: MANDATORY REVIEW OF ALL ACCIDENTS INVOLVING TOWN PROPERTY
WHEREAS the Town’s insurance carrier has requested that a procedure be put in place to review all accidents involving
Town-owned property; and
WHEREAS the purpose of the purpose of this process is to document any health and safety events, including ‘near
misses’, in order to better understand how the Town might improve health and safety conditions for its employees;
therefore
BE IT RESOLVED that any employee involved in an accident involving Town property will complete the incident report
form provided by the Town Bookkeeper; and
FURTHER RESOLVED that the Town Board delegates the procedural review of any accident involving Town property to
the Town’s Safety Committee.

RESOLUTION 2024-35: POLICY FOR APPLYING AND RECEIVING GRANTS AND ENGAGING IN CONTRACTS
(Originally Adopted 6/26/2006 As The “Gatekeeper” Resolution), (Amended 1/14/2020)
WHEREAS the Town Board is the Executive body charged with speaking and acting on behalf of the Town (Town Law
Section 64), unless such powers are specifically delegated by resolution to the Supervisor, as per Town Law Section
29(16), or to another individual,
BE IT RESOLVED that any application (full or partial, new or revised) for grant funding or financing above $2,000, or
request for evaluation of funding potential, or any request for review or approval of any project proposed by the Town
of Ulysses to any government agency or other entity external Ulysses Town government be approved by Town Board
resolution before it is submitted to the appropriate agency, and;
FURTHER RESOLVED that all funding applications of any amount shall be evaluated for future impact on Town staff
time and resources by the Town Supervisor and any applicable staff before being submitted, and;
FURTHER RESOLVED that unless otherwise authorized, the Town Supervisor must also be given authority by the Town
Board to accept grant funds on any successful grant applications, and;

FURTHER RESOLVED that unless authorized in the Town of Ulysses Procurement Policy (or otherwise), the Town
Supervisor and Highway Superintendent must also be authorized by the Town Board to make contractual
commitments on behalf of the town, and;
FURTHER RESOLVED, all Town Board members including the Supervisor shall identify whether they are speaking by
authority of the Board or as an individual when talking with granting agencies, and
FURTHER RESOLVED, that this resolution hereby supersedes all previous Town Board resolutions which may be
interpreted as giving the Supervisor, any other member of the Town Board, Highway Superintendent, or any
professional contracted with by the Town of Ulysses the authority to make applications (full or partial) for grants,
loans, or any other type of project financing, make contractual commitments (verbal or written) on behalf of the Town,
or otherwise act in any legal or official capacity on behalf of the Town of Ulysses.

JANUARY 9TH, 2024: TOWN BOARD MEETING AND PUBLIC HEARING
RESOLUTION 2024-42: APPROVAL OF THE FIRE PROTECTION DISTRICT AGREEMENT FOR 2024
WHEREAS, a fire protection district known as the “Fire Protection District of the Towns of Ulysses, Hector and
Covert” (hereafter referred to as “the Fire Protection District”) has been duly established in the said towns;
and
WHEREAS, the Fire Protection District encompasses the following territory in the Town of Ulysses: All of the
Town of Ulysses, excepting the area within the limits of the incorporated Village of Trumansburg; and
WHEREAS, the Village of Trumansburg (hereafter referred to as “the Village”) maintains a volunteer fire
department, with adequate and suitable apparatus, equipment and training for the furnishing of fire
protection services within the Fire Protection District; and
WHEREAS, Town Law §184 permits a town to contract with a village which maintains adequate and suitable
apparatus and appliances for the furnishing of fire protection services in such fire protection district; and
WHEREAS, the Town wishes to contract with the Village to provide fire protection services in the Fire
Protection District; and
WHEREAS, a public hearing as required by §184 of the Town Law was duly advertised on Dec. 28, 2023; and
WHEREAS, the Public Hearing was held on January 9, 2024 at 7:05 p.m. and all members of the public wishing
to share their opinions in person or in writing had the opportunity to do so;
NOW, THEREFORE, BE IT
RESOLVED that the Town Board of the Town of Ulysses hereby approves and authorizes execution of the
attached Agreement between the Village and the Town, whereby the Village will provide the Town with fire
protection capable of responding to fire related and health related emergencies on an ongoing basis within
the Fire Protection District, for the period from January 1, 2024 until December 31, 2024; and be it further
RESOLVED that, pursuant to the Agreement, the Town shall pay the Village the sum of $248,837.05. for such
services and the bill will be paid no later than February 15, 2024; and be it further
RESOLVED that, the Supervisor of the Town of Ulysses is hereby authorized to execute the Agreement on
behalf of the Town of Ulysses.

ENGINEERING DESIGN SERVICES FOR CURRY ROAD OVER TRUMANSBURG CREEK CULVERT REPLACEMENT
PARTIALLY FUNDED BY BRIDGE-NY
WHEREAS the Town was awarded $1.5 million through the New York State Department of Transportation
(NYSDOT) Bridge NY infrastructure funding program for the replacement of the Curry Road culvert (PIN
3757.39); and
WHEREAS as documented in Resolution 2023-196, the Town of Ulysses went through the NYSDOT required
process to select a consultant for professional engineer design services; and
WHEREAS the firm Barton and Loguidice was selected to be the consulting firm; and
WHEREAS the Town Attorney has reviewed and approved the design contract provided by Barton and
Loguidice;
NOW, THEREFORE, BE IT
RESOLVED that the Ulysses Town Board authorizes the Town Supervisor to sign the engineering design
contract with Barton and Loguidice to provide engineering services for the Bridge NY project on Curry Road
over Trumansburg Creek for $218,000.

RESOLUTION 2024-64: AUTHORIZING USE OF FUNDS FROM THE TOWN OF ULYSSES DA233/DA878
HIGHWAY EQUIPMENT RESERVE FUND TO PURCHASE LOADER IN 2024
WHEREAS, the Town Board adopted the 2024 budget for the Town on October 24, 2023 which includes the
appropriation of $82,044 from the Capital Equipment Reserve Fund DA878 for the purpose of purchasing highway
equipment in 2024; and
WHEREAS, this reserve appropriation is planned and accounted for in the multi-year capital plan updated during
budget season; and
WHEREAS, the balance at the end of the 2023 fiscal year in the DA233/DA878 Highway Equipment Reserve Fund
will be approximately $132,000; and
WHEREAS, pursuant to General Municipal Law §6-c, an expenditure from a capital equipment reserve fund
requires authorization by the Town Board, and such authorization is subject to a permissive referendum; and
WHEREAS, the Town needs to purchase the following highway equipment: Volvo L90H Loader for the net
purchase price of $141,431; and
WHEREAS, the purchase of the above-referenced equipment falls within the purposes for which the
DA233/DA878 Highway Equipment Reserve Fund was established;
NOW, THEREFORE, BE IT
RESOLVED, that the Ulysses Town Board authorizes the following expenditures from the Town of Ulysses
DA233/DA878 Highway Equipment Reserve Fund for the purchase of highway equipment: $82,044 for the Volvo

Town of Ulysses, New York duly adopted Resolution _____ of 2024, an abstract of which follows below, which is
subject to a permissive referendum pursuant to General Municipal Law section 6-c. The resolution authorizes the

RESOLVED, the Ulysses Town Board authorizes the Town Supervisor to submit, or direct another employee to
submit, applications for funding up to $12,000 for recreation and youth services for 2024-2025 United Way
Funding.
RESOLUTION 2024-67: ADOPTION OF A RECYCLING POLICY AT TOWN FACILITIES
WHEREAS, the Town of Ulysses is committed to ecological sustainability and addressing climate changes issues
when possible; and
WHEREAS, recycling is a key component of waste management; and
WHEREAS, in practice Town facilities have integrated recycling into their operations; and
WHEREAS, the following policy will be included in subsequent annual organizational meetings and is meant to
clarify the Town’s commitment to recycling;
NOW, THEREFORE, BE IT RESOLVED, that the Ulysses Town Board adopts the following Recycling Policy:
Town of Ulysses Internal Recycling Policy for Town Owned Facilities
The Town of Ulysses will place recycling containers next to all trash receptacles in all Town owned facilities.
It is the responsibility of all Town employees to ensure that recyclable materials generated while at work are
cleaned, broken down and placed properly in the recycling container.

RESOLUTION 2024-69: AUTHORIZING BYLAW AMENDMENTS FOR THE THREE FALLS LDC
WHEREAS, the Towns of Covert and Ulysses, and the Village of Trumansburg (together, the “Municipalities”)
formed the Three Falls Local Development Corporation (the “LDC”) in 2023; and
WHEREAS, the creation of the LDC was intended to provide, among other things, flexibility and efficiency in
decisions and operations with respect to the future management of the Camp Barton property once it is acquired
by the New York State Office of Parks, Recreation, and Historical Preservation, as well as the negotiations for
licensing the right to manage the same; and,
WHEREAS, in its first year in office the members of the LDC Board of Directors have discovered certain
inefficiencies in its bylaws, included but not limited to:
• The requirement that most operating decisions of the LDC be approved by the individual Boards of each
Member Municipality rather than the Board of Directors of the LDC;

• The requirement that all agreements between the LDC and outside entities be approved by the individual
Boards of each Member Municipality rather than by the Board of Directors of the LDC;
• The requirement that all Member Municipalities share equally in all costs of the LDC regardless of
urgency, timing, or the ability to fund said costs; and,
WHEREAS, the Board of Directors of the LDC believes it will greatly improve the efficiency of operations of the
LDC to amend the bylaws to address the above, and better allow the LDC to carry out the purposes for which it
was formed; and
WHEREAS, that the Board of Directors of the Three Falls Local Development Corporation recommends to its
Member Municipalities that the Bylaws of the Corporation be amended as presented;
NOW, THEREFORE, BE IT

Corporation.

all required accessories, which is a planned purchase per the Highway Capital Equipment Plan; and

awarded a New York State Piggyback Contract through the NYS Office of General Services Procurement

RESOLUTION 2024-81: SCHEDULING PUBLIC HEARING ON THE REDUCTION OF THE NUMBER OF TOWN
COURT JUSTICES FROM TWO TO ONE
WHEREAS, the Town of Ulysses currently has two Justices for the Town Court. The Town Board has
determined that it will be in the best interests of the Town to reduce the number of Town Court Justices from

two to one due to a reduction in revenue and reasonable case load for a single jurist, effective upon the
expiration of Justice Thomas Schlee’s current term on December 31, 2024; and
WHEREAS, the Town Board desires to hold a public hearing with respect to the proposed reduction as stated
hereinabove.
NOW, THEREFORE, BE IT RESOLVED that a public hearing will be held by the Town Board of the Town
of Ulysses with respect to the proposed reduction of the number of Town Court Justices on May 14, 2024 at 7
p.m.; and it is further
RESOLVED, that the Town Clerk is hereby authorized and directed to cause public notice of said hearing to
be given as provided by law.

RESOLUTION 2024-83: ESTABLISHMENT OF RADIO METER OPT OUT FEE
WHEREAS, the Town of Ulysses has been undertaking the replacement of the water meters with radio water
meters to improve efficiency, accuracy, and safety of meter reading in Water District 3; and
WHEREAS, the significant majority of property owners have allowed the Town access to replace these radio
heads; and
WHEREAS, the Department of Public Works and Town Clerk’s Office has calculated the amount of time and
expense needed to read the non-remote meters directly and import that data into the water billing software;
and

WHEREAS, the Town of Ulysses has the ability to establish a reasonable fee and modify it periodically to
cover the provision of these additional services to property owners who have opted not to switch to the
radio meters;
NOW, THEREFORE, BE IT
RESOLVED, that the Ulysses Town Board establishes the Radio Meter Opt Out Fee; and be it
FURTHER RESOLVED, that the Ulysses Town Board sets the 2024 fee at $18 per meter per quarterly
reading; and be it

appropriate, to the Water District 3 water bills.

RESOLUTION 2024-85: APPROVAL OF THE 2024 AMENDMENT TO THE MUNICIPAL COOPERATIVE
AGREEMENT FOR THE GREATER TOMPKINS COUNTY MUNICIPAL HEALTH INSURANCE CONSORTIUM
WHEREAS, the Town of Ulysses is a Participant in the Greater Tompkins County Municipal Health
Insurance Consortium (the "Consortium"), a municipal cooperative organized under Article 47 of the New
York Insurance Law, and
WHEREAS, the municipal participants in the Consortium, including this body, have approved and executed a
certain Municipal Cooperation Agreement (the "Agreement"; effective date of October 1, 2010), and
WHEREAS, Article 47 of the New York Insurance Law (the "Insurance Law") and the rules and regulations of
the New York State Department of Financial Services set forth certain requirements for governance of
municipal cooperatives that offer self-insured municipal cooperative health insurance plans that requires any
amendments or restatements thereto, shall be subject to Board review and upon acceptance of any new
Participant hereafter, and
WHEREAS, the Municipal Cooperative Agreement requires that amendments to the agreement be presented to
each participant for review and adopted by a majority vote by its municipal board, and
WHEREAS, the Town of Ulysses is in receipt of the proposed amended Agreement and has determined that it
is in the best interest of its constituents who are served by the Consortium to amend the Agreement as set forth
in the Amended Municipal Cooperative Agreement, now therefore be it

RESOLUTION 2024-90: ADOPTION OF THE TOWN OF ULYSSES POLICY ON FUND BALANCE AND RESERVE
FUNDS
WHEREAS, the Town of Ulysses Finance Committee underwent an analysis of all Town Funds to inform an
update to the fund balance policy; and
WHEREAS, the goal of the analysis was to establish target fund balance levels based on the proportion to the
operational expense budget of individual Funds; and
WHEREAS, the State of New York and the Governmental Accounting Standards Board has established by
Statement No. 54, Fund Balance Reporting and Governmental Fund Type Definitions for fund balance
reporting; and
WHEREAS, reserve funds, essentially a legally authorized savings account for specific purposes, are an
important component in the Town’s financial planning for specific expenses, future projects, acquisitions and
other lawful purposes, and
WHEREAS, the Town may establish and maintain fund balances in accordance with New York State laws,
and the Town will also consider rules and/or opinions issued by the New York State Comptroller when they
are not in conflict with law; and
WHEREAS, the Town of Ulysses Finance Committee has proposed updates to the Town Fund Balance and
Reserve Fund policy (see Appendix);
NOW, THEREFORE BE IT
RESOLVED by the Town Board of the Town Ulysses that the proposed Town Fund Balance and Reserve
Fund Policy is hereby adopted as proposed; and be it

RESOLUTION 2024-100: ADDRESSING AG DISTRICT CONVERSATION BY TB ON 4/23/24
WHEREAS, the Town's Legislative representative on the Tompkins County Legislature verbally
asked the Town Supervisor on April 17, 2024 on whether the Town Board would be interested
in asserting an opinion on the inclusion of properties in the updated State Agricultural District,
particularly a single property located on Route 89 in the Town's Conservation Zone; and
WHEREAS, the Town Supervisor provided the materials from the County Legislator to the
Town Board, which were publicly posted on April 19, 2024 as part of the Town Board's agenda
packet; and
WHEREAS, the Ulysses Town Board verbally discussed and reached verbal consensus on a
pathway for determining whether or not to submit a letter of opposition to the exclusion of
the single parcel in the State Agricultural District under consideration by the Tompkins County
Legislature, as the Town Board wanted the Town Supervisor to seek additional legal
clarification from the Town Attorney; and
WHEREAS, the Ulysses Town Board acknowledges that it was an inadvertent oversight to fail
to hold a vote during the April 23, 2024 regular meeting of the board on the verbal consensus
reached; and
WHEREAS, the discussion by all five Town Board members on April 23, 2024 can be viewed by
the public on the Town's YouTube channel; and
WHEREAS, the Town Supervisor sought legal advice from the Town Attorney per the
discussion by the Town Board; and
WHEREAS, the Town Supervisor inaccurately believed she had been given authority to make
communications via email dated May 1 and May 2, 2024, which included the Town's County
Legislator, that the inclusion of the property in the State Agricultural District would not
automatically override the Town's zoning, that the Town Board would not be submitting a
letter in opposition to the inclusion of the property, and that the Town Board accepted (i.e.
was "ok" with) that this property may be added to the State Agricultural District list; and
WHEREAS, the Town Board has been advised by the Town's Attorney that it is appropriate to
retroactively approve the Town Supervisor's emails of May 1 and 2, 2024 as an accurate

representation of the discussion and consensus reached by the Town Board at the April 23,
2024 meeting;
NOW, THEREFORE, BE IT
RESOLVED, that the Ulysses Town Board recognizes the Town Supervisor's emails dated May 1
and 2, 2024 to the Town's representative on the County Legislature as an accurate
representation of the discussion held by the Town Board on April 23, 2024; and be it
FURTHER RESOLVED, that the Ulysses Town Board retroactively approves these statements
made by the Town Supervisor on behalf of the Town.

WHEREAS resolutions # 2024-57 and 2024-65 directed the Supervisor’s office to conduct a
preliminary scoping and estimate process for the highly ranked proposed projects for ARPA
funds use, which included the preliminary scoping and estimates for Town Hall safety
upgrades; and
WHEREAS the estimate included the ADA accessible backdoor upgrade, the project cost of
which has been earmarked for ARPA use of funds by the Town Board;

RESOLUTION 2024-109: REDUCING THE NUMBER OF TOWN COURT JUSTICES FROM TWO TO ONE
WHEREAS, the Town of Ulysses currently has two Justices for the Town Court; and
WHEREAS, the Town Board has determined that it will be in the best interests of the Town to reduce the
number of Town Court Justices from two to one due to a reduction in revenue and reasonable case load for a
single jurist, pursuant to Town Law § 60-a; and
WHEREAS, the Town of Ulysses scheduled a public hearing for May 14, 2024 at 7 p.m. and notice of said
public hearing was duly advertised in the official newspaper of the Town and posted on the Town Clerk ’s
signboard; and
WHEREAS, said public hearing was duly held on the 14th day of May, 2024 at 7 p.m. and all parties in
attendance were permitted an opportunity to speak on behalf of or in opposition to the proposed reduction of
the number of Town Court Justices; and
WHEREAS, said reduction of the number of Town Court Justices from two to one shall become effective
upon the expiration of Justice Thomas Schlee’s current term on December 31, 2024.
NOW THEREFORE BE IT RESOLVED, that the number of Town Court Justices is hereby reduced from
two to one as set forth herein above; and
RESOLVED, that, pursuant to Town Law §64-a, this resolution is subject to a permissive referendum.

RESOLUTION 2024-111: TOWN BOARD SUPPORT FOR THE WATER QUALITY IMPROVEMENT PROJECT
CONSOLIDATED FUNDING APPLICATION FOR GARRETT ROAD CULVERT REPLACEMENT
WHEREAS, the Town of Ulysses, Tompkins County, supports the submission of a 2024 New York State
Department of Environmental Conservation (NYS DEC) Water Quality Improvement Project (WQIP) on
behalf of the Town to construct improvements to the Garrett Road culvert; and
WHEREAS, the NYS DEC provides competitive statewide grant funding through the Non-agricultural
Nonpoint Source Abatement and Control project subcategory to make improvements to culverts and the Town
of Ulysses considers this project a priority; and
WHEREAS, if funding is received, it will allow the Town to replace this deficient culvert and address erosion
and aquatic connectivity in the area;
NOW, THEREFORE, BE IT
RESOLVED, the Town Board, on behalf of the Town, identifies the Town Supervisor as the authorized
representative for the project, able to execute necessary documents relative to and as required for this
application; and be it

FURTHER RESOLVED, the Town Board does hereby accept that they shall provide the required 25% match
for all grant funding awarded as a local match in the form of in-kind services or cash contributions hereby
appropriated and obligated from the Highway General Fund (i.e. the DA fund); and be it

RESOLUTION 2024-119: SEQR DETERMINATION FOR A PROPOSED LOCAL LAW TO
AMEND THE CODE OF THE TOWN OF ULYSSES 212-118.H NO. 1 OF 2024:
WHEREAS, the proposed action is in consideration of a proposal to adopt a Local Law that

would amend the Code of the Town of Ulysses 212-118.H; and
WHEREAS, the proposed action is an Unlisted action under the New York Codes, Rules, and
Regulations (NYCRR) Title 6, Part 617 State Environmental Quality Review (SEQR), for which
the Town of Ulysses Town Board is acting as Lead Agency in respect to the proposed local law;
and

WHEREAS, the Town Board, at a public meeting held on July 9, 2024, has reviewed and
accepted as adequate the Short Environmental Assessment Form (SEAF), Part 1 for the
proposed action; and
WHEREAS, the proposal should not create a material conflict with the 2009 land use plan or

WHEREAS, the proposal should not result in a significant change in the use or intensity of use

WHEREAS, the proposal should not impair the character or quality of the existing community;

WHEREAS, the proposal should not significantly impact existing water supplies or wastewater
treatment utilities; and
WHEREAS, the proposal should not impair the character or quality of important historic,
archaeological, architectural or aesthetic resources; and
WHEREAS, the proposal should not result in an adverse change to natural resources; and
WHEREAS, the proposal should not result in a significant increase in the potential for erosion,
flooding or drainage problems; and
WHEREAS, the proposal should not create a hazard to environmental resources or human
health;
NOW, THEREFORE BE IT RESOLVED that the Town Board of the Town of Ulysses hereby makes
a negative determination of environmental significance in accordance with the Consolidated
Laws of New York Article 8 of the Environmental Conservation Law and NYCRR SEQR for the
above referenced action as proposed, based on the information in the SEAF Part 1 and for the
reasons set forth above and in SEAF Parts 2 and 3, and therefore, an Environmental Impact

RESOLUTION 2024-120: APPROVING LOCAL LAW NO. 1 OF 2024- EXISTING
DEVELOPMENT DISTRICT ZONING CODE AMENDMENT
WHEREAS, the Town Board passed Resolution 99 of 2024 on June 11, 2024 to schedule a
public hearing on the proposed action for June 25, 2024; and
WHEREAS, notice was given that the Town Board scheduled a public hearing for June 25, 2024
at 7:00 p.m. for Local Law No. 1 of the Year 2024 entitled “Existing Development District
Zoning Code Amendment”; and
WHEREAS, notice of said public hearing was duly advertised in the official newspaper of the
Town on June 15, 2024, was posted on the Town’s website, and was posted on the Town
Clerk’s signboard; and
WHEREAS, pursuant to General Municipal Law Article 12-B Sections 239 L, M, and N of the
Consolidated Laws of New York the proposal was submitted to Tompkins County for review;
and
WHEREAS, the Department of Planning & Sustainability of Tompkins County submitted their
response letter to the Town dated June 28, 2024 that states they determined the proposed
action will have no significant county-wide or inter-community impact; and
WHEREAS, the Town Board passed Resolution 73 of 2024 that directed the Planning Board to
review the proposal and provide a recommendation to the Town Board; and
WHEREAS, the Planning Board reviewed the proposal on April 16, 2024; May 7, 2024; and on
June 18, 2024; and
WHEREAS, the Planning Board sent a memo to the Town Board dated June 18, 2024 that
states they support the proposed code amendment and passed Resolution 2024-010 that
recommends the Town Board amend the zoning code; and
WHEREAS, said public hearing was duly held on the 25th day of June 2024 at 7:00 p.m. and on
the 9th day of July 2024 at 7:00 p.m. and all parties in attendance were permitted an
opportunity to speak on behalf of or in opposition to said proposed Local Law, or any part
thereof; and
WHEREAS, in accordance with the Consolidated Laws of New York Article 8 of the
Environmental Conservation Law and the New York Codes, Rules, and Regulations Title 6, Part
617 State Environmental Quality Review, it was determined by the Town Board of the Town of
Ulysses on July 9, 2024, that adoption of the proposed Local Law constitutes an Unlisted
action, as defined under said regulations. The Town Board has considered the possible
environmental impacts of the Local Law. The adoption of said Local Law will not have a
significant adverse impact on the environment and the Town Board issued a negative
declaration of environmental significance with respect to the Local Law.
NOW, THEREFORE BE IT RESOLVED that the Town Board of the Town of Ulysses hereby adopts
said local law as Law No. 1 of the Year 2024 entitled “Existing Development District Zoning
Code Amendment” as shown in Exhibit A attached hereto; and it is further

WHEREAS, Rebecca Schneider has served on the Town of Ulysses’ Planning Board since 2006;
and
WHEREAS, Dr. Schneider was originally appointed to the Planning Board because of her
professional experience with stormwater management; and
WHEREAS, Dr. Schneider has served as important environmental advocate and expert on a
myriad Town planning projects, including the 2009 Comprehensive Plan, the 2013 Agricultural
and Farmland Protection Plan, the formation of the Conservation Zone in 2017 and the Town’s
zoning update in 2019; and
WHEREAS, Dr. Schneider’s appointed term was through December 31, 2028; and
WHEREAS, Dr. Schneider resigned from the Planning Board on June 25, 2024;

AUGUST 21ST, 2024: SPECIAL TOWN BOARD MEETING
RESOLUTION 2024-141: CENSURING TOWN BOARD MEMBER MICHAEL BOGGS
Whereas, a complaint was filed against Town Board Member Michael Boggs on January 29, 2024 and
February 13, 2024, alleging inappropriate conduct by Mr. Boggs in his actions as a Town Board Member
when interacting with a Town staff person; and
Whereas, the Town Board authorized an investigation of this matter at a meeting on February 8, 2024, and
delegated authority to the Town Supervisor to hire a law firm to conduct such investigation; and
Whereas, Kristen Smith, Esq., partner with the law firm Bond Schoeneck & King, was retained to conduct
such investigation; and
Whereas, Ms. Smith conducted such investigation and provided a report, dated July 8, 2024, in which she
concluded that the complaint was partially substantiated, in that Mr. Boggs had violated the Town of Ulysses'
Diversity, Equity and Inclusion Policy and Communications Policy through his treatment of a Town staff
person at Town Board meetings and other interactions, including email; and
Whereas, the time for the Town staff person and Mr. Boggs to appeal such conclusion has now expired,
leaving uncontested the report 's conclusions; and
Whereas, the Town Board finds that treating all persons with dignity and respect is crucial to a well-
functioning unit of government, and further finds that enforcing its policies will instill confidence that the
Board takes such policies seriously and that the Board will hold all Town officials to established standards of
conduct;
Now therefore be it resolved, that in consideration of the foregoing, the Town Board of the Town of Ulysses
hereby officially censures Town Board Member Michael Boggs for his violation of the Town of Ulysses'
Diversity, Equity and Inclusion Policy and Communications Policy; and be it further
Resolved, that Mr. Boggs is reminded of the expectations of all persons serving the Town of Ulysses to treat
others with dignity, respect, and decency.

WHEREAS, notice was given that the Town Board scheduled a public hearing for September 10, 2024 at 7:05
p.m. for Local Law No. 2 of the Year 2024 entitled “A LOCAL LAW TO OVERRIDE THE TAX LEVY
LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW § 3-C”; and
WHEREAS, notice of said public hearing was duly advertised in the official newspaper of the Town and
posted on the Town Clerk’s signboard; and
WHEREAS, said public hearing was duly held on the 10th day of September 10, 2024 at 7:05 p.m. and all
parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed
Local Law, or any part thereof; and

Board that adoption of the proposed Local Law constitutes a Type II Action as defined under 6 NYCRR
617.5(c)(26) and (33);
NOW, THEREFORE BE IT RESOLVED that the Town Board of the Town of Ulysses hereby adopts said
local law as Law No. 2 of the Year 2024 entitled “A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT

RESOLVED that the Town Clerk be and hereby is directed to enter said Local Law in the minutes of this

Mr. Goldman wanted to make it clear that the town has not gone over the cap in the past but is now responding to the
pressure of increased costs such as health insurance projected increases of 14% and Fire/EMS of 10%.
Ms. Olson said that the town looks for every opportunity to save money. If the town goes over the cap by 1% it
amounts to $16,000; 2% = $32,000; etc. To increase wages to be in sync with other munis in the county will cost the
town $33,000 not including benefits. She reiterated that Fire/EMS has increased 10% but the town wants to keep
providing these services to residents. She clarified that passing this law is not an override, it just gives the ability to do
so if needed.
Ms. Bouchard noted that budget meetings are this week.
Ms. Olson invited people to send comments to clerk, come to meetings, come to public hearing. She said that this is
not being done lightly and is proud that the town has had the lowest tax rate in county for a number of years.

RESOLUTION 2024-145: INTER-FUND LOAN FROM DA232 / DA883 BRIDGE REPAIR RESERVE FUND TO
CAPITAL FUND HA FOR SEED MONEY FOR THE CURRY ROAD BRIDGE REPLACEMENT PROJECT:
WHEREAS the Town was awarded $1.5 million through the New York State Department of Transportation
(NYSDOT) Bridge NY infrastructure funding program for the replacement of the Curry Road culvert (PIN
3757.39); and
WHEREAS the DA Fund and HA Capital Fund are the same tax base, and
WHEREAS General Municipal Law, §9‐a allows for inter-fund loan which states that any such temporary
advance shall be authorized in the same manner as prescribed by general, special or local law for making
budgetary transfers between appropriations. And that suitable records shall be kept of each temporary
advance, and
WHEREAS the BRIDGE NY funding program is a reimbursement process and the most efficient method for
short term cash flow required for this project is to borrow from internal sources, and
WHEREAS this loan will indeed cross multiple financial years, and
WHEREAS this practice of borrowing funds from the DA232 / DA883 Bridge Repair Reserve Fund was
successfully used in a similar project, the bridge replacement of Cemetery Road over Trumansburg Creek
(PIN 3756.59), and
WHEREAS an additional loan from the DA232 / DA883 Bridge Repair Reserve Fund will be required during
the construction phase of this project, tentatively scheduled for summer of 2025,
NOW, THEREFORE, BE IT
RESOLVED that the Ulysses Town Board authorizes the temporary loan of up to $150,000 from the DA232 /
DA883 Bridge Repair Reserve Fund to the HA Capital Fund, and
RESOLVED that the Ulysses Town Board instructs the Town Supervisor ’s Office to ensure a resolution at the
end of the year to acknowledge the cross-financial year interfund borrow in order to ensure proper
documentation.

APPLICATIONS FOR THE COMPREHENSIVE PLAN
WHEREAS, the Town of Ulysses in undertaking a comprehensive plan process and is committed to engaging
and soliciting public opinions; and

WHEREAS, the Town of Ulysses has a Social Media Policy (established in 2023 and affirmed by the Town
Board in January 2024) that is intended to direct official Town actions related to websites and social media,
with a priority on providing information to the public and not engaging in the creation of a public forum; and
WHEREAS, the Town of Ulysses Comprehensive Plan Committee would like MRB Group, the consultant hired
by the Town of Ulysses to guide the Comprehensive Plan process, to host a website for the purposes of
sharing publicly available information and enabling web applications to solicit and engage public feedback on
Comprehensive Plan topics; and
WHEREAS, while the collecting of public opinions is not expressly permitted in the Social Media Policy, the
purpose of the Comprehensive Plan prioritizes gathering and collecting public comments and this can be
achieved through a standalone website and web applications that do not create a public forum in violation of
the Social Media Policy; and
WHEREAS, it is more efficient and financially prudent for this work to be accomplished by a third-party
vendor under an existing contract than by Town staff on the current website;
NOW, THEREFORE, BE IT
RESOLVED, that the Ulysses Town Board authorizes MRB Group, overseen by the Town Planner and the Town
of Ulysses Comprehensive Plan Committee, to create a standalone website for engagement on the
Comprehensive Plan process and utilize web applications that collect public opinions and solicit information,
with the following conditions:
1. The Town’s Communications Manager shall either review or designate someone to review the
material posted to the MRB website and the web application content to ensure compliance with the
resolution, and any violations or concerns regarding these materials shall be promptly addressed with
MRB Group and edited or removed as necessary.
2. The independent website shall identify that it is approved by the Town of Ulysses and clearly identify
that it is part of the Comprehensive Plan process. This language will be approved by the Town’s
Communication Manager or designee.
3. The website is subject to records retention requirements by New York State and the Town of Ulysses,
and the Records Manager is directed to ensure a process whereby these records are collected and
saved as required by law.
4. All information posted to the website shall be public information (reports, data, educational
information) and is not editorializing on the part of either Town officials, members of the
Comprehensive Plan Committee, MRB Group or their affiliates.
5. All web applications utilized will be for collecting information from the public as part of the
Comprehensive Plan process and will not be used in such a way that creates a back-and-forth
dialogue between members of the public (i.e. public forum).
FURTHER RESOLVED, that the Town of Ulysses recognizes the Social Media Policy and approves this unique
deviation for the purposes of fulfilling its essential responsibility of engaging public feedback as part of the
Comprehensive Planning process.
