Sept. 10, 2024
The meeting was held in person at the Town Hall at 10 Elm St., Trumansburg NY as well as via Zoom
videoconference. Notice of Town Board meetings are posted on the Town’s website and Clerk’s board.

CALL TO ORDER:
Ms. Olson called the meeting to order at 7:02pm.

APPROVAL OF AGENDA:
Motion:
Mr. Boggs moved to approve the agenda as presented. This was seconded by Ms. Bouchard and
passed unanimously.

PUBLIC HEARING (A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL
MUNICIPAL LAW § 3-C”:
Mr. Goldman made a motion to open the hearing at7:02pm This was seconded by Mr. Boggs and
passed unanimously.
Ms. Olson gave some background on the tax cap levy: In order to stay under the tax cap, the town
would need to keep the tax rate below 3% at a time when insurance and other costs have increased
above 3%.

Ms. Olson asked for comments from anyone in person, then from anyone online. No comments were
made. She asked twice more and did not receive any comments.
Spencer Schaffner said that he opposes the tax cap.
Melissa Littlefield on Krums Corner Rd. opposes it as well and is concerned that there is no limit on
how far over it the town can go up. School taxes were increased even with the assessment increase
and it seems like a push to push people out who can’t afford it. Some of the board’s actions do not
reflect what is happening or the needs in the community.
Ms. Olson asked the clerk whether any comments were received. The clerk replied in the affirmative,
noting that a comment was received from Greg Allen on 9/4 (see below) and was shared with the
board at that time.
Comment received 9/4 from Greg Allen:
I would like to offer my 2 cents on the proposed override of tax levy limit, I am opposed to this. We
have had 2 consecutive mild winters, so winter highway maintenance was less. There should have
been a surplus of funds because of this, which should have been carried over and could have been
used for unseen circumstances.
MOTION TO CLOSE THE HEARING:
Mr. Goldman made a motion to close the Public Hearing at 7:09pm. This was seconded by Mr. Boggs
and passed unanimously.
MUNICIPAL BOARD & STAFF REPORTS:
Ms. Koreman shared the following updates from the Tompkins County Legislature:
• Budget season for county. Current draft has a 4.3% increase. The legislature is tasked with
creating a 2.5% increase budget so there will be cuts
o More public hearings are scheduled to try to hear from more members of the public-
1st one is 9/30 at 5:30pm- will be a Zoom option or submit in advance
• Emergency planning – the county is obligated to house folks when the windchill is below 32
degrees aka “code blue”
• Planning for center of gov location
• Airport breakfast with flights, hot air balloons, airplane displays, dunktank, ice cream
o Decreased revenues may necessitate closing the customs facility
Mr. Klankowski shared that the Planning Board is interested in doing some long-range planning and
the Comp plan will start to pick up soon.
Ms. Weatherby shared the following updates on the Comp Plan Steering Committee:
• She will bring items to the Town Board meeting on 9/24 for review and adoption
• They would like to create a website specific to the CPSC in line with town’s
Communication/Social Media policy
• A joint meeting between the Town and CPSC in Dec. is desired

Ms. Marino shared the following:
• WSPPC:
o Working on implementation strategies
o Tech consultant from NYRW is working on the technical items required for DEC to
approve the plan
o Albany DEC folks in town to sample more wells- will have about 50 total and then will
create the final report
• CSAC:
o Submitted grant and shared with the town for retention
o Getting quotes for HVAC, insulation, EV
o $10K funds approved so check is on the way
o Hasn’t heard about $50K approval
Ms. Weatherby added that the Ag Committee met last night and two folks attended. She and Ms.
Bouchard are hoping to get feedback for the comp plan.
Ms. Olson shared the following:
• Youth Commission
o Increase in minimum wage affects budgets of youth programs
o This has been 1st year that town has run youth dev programs (formerly administered by
CCE) and has spent $9000 less than when contracted with CCE
• 3 Falls LDC
o Assured that property transfer closing will happen soon
Mr. Boggs shared that the JCA park bathrooms are done and he has toured them.
OLD BUSINESS:
“A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW § 3-
C”
RESOLUTION # 141 OF 2024: APPROVING LOCAL LAW NO. 2 OF 2024-“A LOCAL LAW TO
OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW § 3-C”:
WHEREAS, notice was given that the Town Board scheduled a public hearing for September
10, 2024 at 7:05 p.m. for Local Law No. 2 of the Year 2024 entitled “A LOCAL LAW TO
OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW § 3-C”; and
WHEREAS, notice of said public hearing was duly advertised in the official newspaper of the
Town and posted on the Town Clerk’s signboard; and
WHEREAS, said public hearing was duly held on the 10th day of September 10, 2024 at 7:05
p.m. and all parties in attendance were permitted an opportunity to speak on behalf of or in
opposition to said proposed Local Law, or any part thereof; and
WHEREAS, pursuant to the State Environmental Quality Review Act, it has been determined
by the Town Board that adoption of the proposed Local Law constitutes a Type II Action as
defined under 6 NYCRR 617.5(c)(26) and (33);

NOW, THEREFORE BE IT RESOLVED that the Town Board of the Town of Ulysses hereby adopts
said local law as Law No. 2 of the Year 2024 entitled “A LOCAL LAW TO OVERRIDE THE TAX
LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW § 3-C”; and it is further
RESOLVED that the Town Clerk be and hereby is directed to enter said Local Law in the
minutes of this meeting and give due notice of the adoption of said Local Law to the Secretary
of State; and it is further
RESOLVED that this resolution will take effect immediately upon filing with the Department of
State.

Mr. Goldman wanted to make it clear that the town has not gone over the cap in the past but
is now responding to the pressure of increased costs such as health insurance projected
increases of 14% and Fire/EMS of 10%.
Ms. Olson said that the town looks for every opportunity to save money. If the town goes over
the cap by 1% it amounts to $16,000; 2% = $32,000; etc. To increase wages to be in sync with
other munis in the county will cost the town $33,000 not including benefits. She reiterated
that Fire/EMS has increased 10% but the town wants to keep providing these services to
residents. She clarified that passing this law is not an override, it just gives the ability to do so
if needed.
Ms. Bouchard noted that budget meetings are this week.
Ms. Olson invited people to send comments to clerk, come to meetings, come to public
hearing. She said that this is not being done lightly and is proud that the town has had the
lowest tax rate in county for a number of years.

2025 TOWN BUDGET UPDATES
Ms. Weatherby said that the Health Consortium is considering a 14% increase. The last several years
have been 4-5%. The consortium board will meet on the 26th to vote. More munis have joined the
group but claims have increased.
Mr. Goldman is concerned that the consortium does not have a subscriber & spouse plan (only single
or family). He wants to get other quotes for health insurance next year.
NEW BUSINESS:

INTRODUCTION OF A LOCAL LAW: “BOARD OF ZONING APPEALS ZONING CODE AMENDMENT” AND
SCHEDULE PUBLIC HEARING
Ms. Olson gave a synopsis of the proposal- that signs will be required (in addition to the mailings
currently required) to let neighbors know that a variance is requested on a property.
Mr. Tygesen said that they would like to get the county’s feedback as well.
RESOLUTION # 142 OF 2024: SETTING A PUBLIC HEARING ON A PROPOSED LOCAL LAW TO
AMEND THE BZA SIGNAGE REQUIREMENTS
WHEREAS, a draft local law entitled “Board of Zoning Appeals Zoning Code Amendment” was
introduced at this meeting as shown in Exhibit A attached hereto (see Appendix); and
WHEREAS, the Town Board desires to hold a public hearing with respect to the adoption of
said Local Law.
NOW, THEREFORE, BE IT RESOLVED that a public hearing will be held by the Town Board of
the Town of Ulysses with respect to the adoption of the aforesaid Local Law on October 8,
2024 at 7:00 p.m., or as soon thereafter can be heard; and it is further
RESOLVED, that the Town Clerk is hereby authorized and directed to cause public notice of
said hearing to be given as provided by law.

INTRODUCTION OF A LOCAL LAW: “PARK/RECREATION ZONE ZONING CODE AMENDMENT” AND
SCHEDULE PUBLIC HEARING
Mr. Tygesen explained that the town received grant funds from the county. During this process it was
discovered that the zoning code requires a special permit (which requires a public hearing and
approval) for the area to be a park. He suspected that this probably due to an oversight in the 2019
zoning update. He noted that this change will apply to 7 other areas zoned this way.

WHEREAS, a draft local law entitled “Park/Recreation Zone Zoning Code Amendment” was
introduced at this meeting as shown in Exhibit A attached hereto; and
WHEREAS, the Town Board desires to hold a public hearing with respect to the adoption of
said Local Law.

APPOINTMENTS TO THE PLANNING BOARD
Mr. Goldman said that both candidates were interviewed and recommended to be appointed.
RESOLUTION # 144 OF 2024: PLANNING BOARD APPOINTMENTS
RESOLVED, the Town Board appoints Jeff McDonald to a full seat on the Town of Ulysses
Planning Board for a term through December 31, 2028; and be it
FURTHER RESOLVED, the Town Board appoints Simon Bernnard to an Alternate Seat on the
Town of Ulysses Planning Board for a term through December 31, 2024; and be it
FURTHER RESOLVED, that the Town Board thanks both appointees for their service to the
Planning Board and the Town of Ulysses.

Ms. Bouchard expressed concern that they are both village residents. Mr. Goldman corrected
that one of the candidates has purchased a house in the town.

INTER-FUND LOAN FROM DA232 / DA883 BRIDGE REPAIR RESERVE FUND TO CAPITAL FUND HA
FOR SEED MONEY FOR THE CURRY ROAD BRIDGE REPLACEMENT PROJECT

Ms. Olson explained that this is necessary for cash flow and we will be reimbursed by grant funds on
an ongoing basis.
RESOLUTION # 145 OF 2024: INTER-FUND LOAN FROM DA232 / DA883 BRIDGE REPAIR
RESERVE FUND TO CAPITAL FUND HA FOR SEED MONEY FOR THE CURRY ROAD BRIDGE
REPLACEMENT PROJECT:
WHEREAS the Town was awarded $1.5 million through the New York State Department of
Transportation (NYSDOT) Bridge NY infrastructure funding program for the replacement of the
Curry Road culvert (PIN 3757.39); and
WHEREAS the DA Fund and HA Capital Fund are the same tax base, and
WHEREAS General Municipal Law, §9‐a allows for inter-fund loan which states that any such
temporary advance shall be authorized in the same manner as prescribed by general, special
or local law for making budgetary transfers between appropriations. And that suitable records
shall be kept of each temporary advance, and
WHEREAS the BRIDGE NY funding program is a reimbursement process and the most efficient
method for short term cash flow required for this project is to borrow from internal sources,
and
WHEREAS this loan will indeed cross multiple financial years, and
WHEREAS this practice of borrowing funds from the DA232 / DA883 Bridge Repair Reserve
Fund was successfully used in a similar project, the bridge replacement of Cemetery Road
over Trumansburg Creek (PIN 3756.59), and
WHEREAS an additional loan from the DA232 / DA883 Bridge Repair Reserve Fund will be
required during the construction phase of this project, tentatively scheduled for summer of
2025,
NOW, THEREFORE, BE IT
RESOLVED that the Ulysses Town Board authorizes the temporary loan of up to $150,000 from
the DA232 / DA883 Bridge Repair Reserve Fund to the HA Capital Fund, and
RESOLVED that the Ulysses Town Board instructs the Town Supervisor’s Office to ensure a
resolution at the end of the year to acknowledge the cross-financial year interfund borrow in
order to ensure proper documentation.

PRIVILEGE OF THE FLOOR (3 min limit per person):
Ms. Marino supports getting someone on the Planning Board with a strong water background.
Mr. Boggs drew attention to Mr. Klankowski’s memo to the Town Board.

Mr. Klankowski suggested that an ad hoc committee of town & planning board members and the
code officer be formed to address zoning issues. He would like to take advantage of the next few
years before the zoning updates begin to work on these issues such as perennial streams and
wetlands as referenced in the law.
Ms. Olson supports this but wants to be mindful of staff time and be open to hiring support if
necessary and feasible.
Mr. Klankowski offered that he and the Planning Board can work on it.
Ms. Olson would like to craft a resolution for the next meeting and have the planning board identify
some areas.

LOCAL LAW NO. 2 OF THE YEAR 2024:
A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW § 3-C
Be it enacted by the Town Board of the Town of Ulysses as follows:
Section 1. Legislative Intent
It is the intent of this local law to override the limit on the amount of real property taxes that may be levied by
the Town of Ulysses pursuant to General Municipal Law § 3-c, and to allow the Town of Ulysses to adopt a
budget for the fiscal year beginning January 1, 2025 and ending December 31, 2025 that requires a real
property tax levy in excess of the “tax levy limit” as defined by General Municipal Law § 3-c.
Section 2. Authority
This local law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes
the Town Board to override the tax levy limit by the adoption of a local law approved by vote of at least sixty
percent (60%) of the Town Board.
Section 3. Tax Levy Limit Override
The Town Board of the Town of Ulysses, County of Tompkins, is hereby authorized to adopt a budget for the
2025 fiscal year that requires a real property tax levy in excess of the amount otherwise prescribed in General
Municipal Law § 3-c.
Section 4. Remainder
Except as hereinabove amended, the remainder of the Town Code of the Town of Ulysses shall remain in full
force and effect.
Section 5. Separability
The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, word or part
thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstance, such illegality,
invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions,
clauses, sentences, subsections, words, or parts of this local law or their application to other persons or
circumstances. It is hereby declared to be the legislative intent that this local law would have been adopted if
such illegal, invalid, or unconstitutional provision, clause, sentence, subsection, word or part had not been
included therein, and as if such person or circumstance, to which the local law or part thereof is held
inapplicable, had been specifically exempt therefrom.
Section 6. Effective Date
This Local Law shall take effect immediately upon filing with the New York State Secretary of State in
accordance with Section 27 of the Municipal Home Rule Law.

LOCAL LAW NO. ___ FOR THE YEAR 2024
BOARD OF ZONING APPEALS ZONING CODE AMENDMENT
Be it enacted by the Town Board of the Town of Ulysses as follows:
Section 1. Section 212-16 entitled “Board of Zoning Appeals” shall be amended as follows:
A.(1) through (9) Remains the same.
A.(10) The Board of Zoning Appeals shall act in accordance with the provisions hereinafter
contained in this section, hold public hearings to determine appeals from any refusal of a
building permit or statement of compliance by the Zoning Officer, or review any order,
decision, interpretation or refusal thereof of the Zoning Officer, where such order or decision
is based upon the requirements of this chapter. An appeal must be made within the time
prescribed by the rules of the Board of Zoning Appeals. All Board of Zoning Appeals
procedures shall comply with Town Law § 267-a, as amended from time to time. Notice of
public hearings shall, in addition to all other requirements for publication of a hearing notice
pursuant to the Laws of the State of New York, be posted on the subject property in a manner
that is readily visible to the public from the nearest adjacent public road at least 10 days prior
to the subsequent public hearing.
A.(11) Remains the same.
B through D Remains the same.
Section 2. Remainder
Except as hereinabove amended, the remainder of the Code of the Town of Ulysses shall remain
in full force and effect.
Section 3. Severability
The provisions of this Local Law are severable and if any provision, clause, sentence, subsection,
word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or
circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or
impair any of the remaining provisions, clauses, sentences, subsections, words, or parts of this
local law or their application to other persons or circumstances. It is hereby declared to be the
legislative intent that this local law would have been adopted if such illegal, invalid, or

PARK/RECREATION ZONE ZONING CODE AMENDMENT
Be it enacted by the Town Board of the Town of Ulysses as follows:
Section 1. Chapter 212 Article XVIII entitled “PR – Park/Recreation Zone” shall be
amended as follows:
110. Purpose. Remains the same.
111. Permitted uses.
In the PR — Park/Recreation Zone, no building or structure shall be erected, altered or
extended, and no land or building thereof shall be used for any purpose or purposes other
than the following:
A. Farm operation.
B. Public and private community parks, regional parks and preserves.
112. Uses permitted by special permit.
The following uses are allowed within the PR — Park/Recreation Zone upon approval of a
special permit pursuant to Article III, § 212-18, upon receipt of site plan approval from the
Planning Board pursuant to Article III, § 212-19, and subject to the design standards set forth
in relevant sections of Article XX:
A. Signs as regulated under Article XX, § 212-122.

Section 2. Remainder
Except as hereinabove amended, the remainder of the Code of the Town of Ulysses shall remain
in full force and effect.
Section 3. Severability
The provisions of this Local Law are severable and if any provision, clause, sentence, subsection,
word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or
circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or
impair any of the remaining provisions, clauses, sentences, subsections, words, or parts of this
local law or their application to other persons or circumstances. It is hereby declared to be the
legislative intent that this local law would have been adopted if such illegal, invalid, or

unconstitutional provision, clause, sentence, subsection, word or part had not been included
therein, and as if such person or circumstance, to which the local law or part thereof is held
inapplicable, had been specifically exempt therefrom.
Section 4. Effective Date
This Local Law shall take effect immediately upon filing with the New York State Secretary of
State in accordance with Section 27 of the Municipal Home Rule Law.

Middle School Programs:
Registration already full (waitlist active) for Youth Cross Country (Grade 3-6) starting 9/12.
Ulysses Rec Dept. hired a Cornell student to help Zak administer this program.
After-school Outdoors Club- Fall Fridays 3-5:15pm
Registration now open on Rec Desk, grades 5-7, to start 9/20.
Currently in planning stage, including intended activities and life/soft skills to target.
Youth Employment:

Reps attended.
It was good to get together and hear some details from even a few program
participants. Mena Schlossberg, who worked at the Tburg Library, mentioned
meeting many new people and developing an increased sense of connection with
her community. She dropped some good buzzwords, but it was unprompted and
authentic :)
In the written/survey evaluation (7 responses so far), employees wrote in specific an
non-specific ways about improved confidence, problem-solving, communication
and leadership skills, responsibility, and time management.
The program has a good team of employers too. A good variety of jobs, and
supervisors who are invested in a degree of mentorship for their youth employees.
Professional Development:
Zak and Rachel both working through “Positive Youth Development 101”, an online
curriculum created by ACT for Youth at Cornell and Cornell Social Media Lab.
Other: Working on a Mission and Vision statement for the dept.

Planning Board
The Planning Board held a meeting on August 6 to discuss the following items:
• The Board conducted sketch plat review for the ‘Wilcox Subdivision’, a proposal to subdivide the existing
10.38 acre lot into two lots, and scheduled a public hearing for August 20.
• Board members continued discussions related to training.
• Board members continued discussions related to zoning code amendments.

The Planning Board held a meeting on August 20 to discuss the following items:
• The Board conducted final plat review with a public hearing and approved the ‘Wilcox Subdivision’ noted
above.

Greetings Board Members: Accompanying this report are the August 2024 financial statements,
which are referenced in my narrative.
Balance Sheet
As detailed in the Supervisor’s Report, total cash balances as of 8/31/2024 were $1,29,249.29, an
increase of $64,642.25 from the end of July. A few notable items to comment on for this month:
• Sales tax payments continue to come on a timely basis, having received payments
through July at the end of August.
• EMS payments are current through July 2024.
• Cash receipts were routine, including normal monthly operations. We also received grant
payments for our Curry Rd Capital Project (HA), and our NPS Engineering Grant (DA).
• Typical cash outlays occurred for operating expenses. In addition, we paid for the
purchase of the new loader – the $141,431 paid was net of the trade in value of the old
loader. Funds were transferred from the equipment reserve to fund $82,044 of this
purchase.
In addition to cash balances, the Town had investments valued at a total of $2,734,134.44 as of
August 31, 2024. The value of the investment decreased from last month, as a $250,000
maturity was liquidated and added to the A, B, and DA funds for cash flow purposes.
Other than cash, investments, and interfund transactions (due to/due from other funds), there are
no significant assets and liabilities in the Town’s operational financial statements.
Income Statement
Revenues through August 2024 are as expected. Sales tax payments have been received through
July, as have fees collected through the Clerk’s Office. Justice Court Revenue has only been
recorded through June. EMS payments are current through July.
Expenditures through August 2024 are also as expected, with some spending being front loaded
(such as payments for Fire and Ambulance services, and some insurance costs). Spending for
summer programs continues in August, reflected primarily in A fund salary for recreation and
youth employment programs. And, as mentioned earlier, we paid for a new loader in the DA
fund.

Bookkeeper/Budget Officer Activities
Below are some highlights of my activities:
• Personnel: I continue to support employees and retirees with benefit administration,
human resources support, employment, and civil services functions. I continue to be
busy with summer camp and youth employment programs, with over 40 seasonal
employees.
• Finance Committee: I continue to support the work of the finance committee. Notes from
these meetings are available in SharePoint.
• Budget Officer Activities: Maintaining accurate, up to date, financial data is a priority for
me. This allows me to provide data in support of budget development, which is in full
swing right now. In my new role as Budget Officer, I have:
o Prepared the budget schedule for 2025, including the plan for line-by-line
departmental budget review.
o Prepared budget documents for the Youth Commission and attended one meeting
to review the information with members of the Commission.
o Met with multiple departments and staff to better understand their budgets and
seek input from them to inform the tentative budget and well as current year
budget projections.
o Gained a better understanding (still a work in progress) of the various inputs to
the Town of Ulysses budget, including youth programs, fire and EMS services,
water districts, and grant funded projects.
