Present: Chairperson Ken Zeserson, Planning Board Members : Rod Hawkes,
David Means, Rod Porter, Rebecca Schneider, Deputy Supervisor Dick Coogan,
Excused : John Wertis
Applicant : Architectural Technologies Group, Inc . , Jason Demerast — Architect
Mr. Zeserson called the public to order at 7 : 30 pm . He noted the hearing had been
advertised per Town Hall in the legally required time limit. There were no individuals
representing the public thus he stated they would keep the public hearing open for a
minimum of 10 minutes to allow for late corners. He stated he did not see the need for
Mr. Demerast to present a description since this Board had already heard this .
He asked if the members had any questions or comments in the interim.
Ms . Schneider stated she likes what they are doing and understands they received the
variances for the parking and height requirements . She noted effort in upgrading
stormwater runoff for the ponds, they did 1 - 10- 100 year storms, but if it is already full
there will be some infiltration. She asked if it would divert out and into the stream .
Mr. Demerast stated yes, it would be diverted to an overflow pipe beneath the gravel
drive, the rip rap at the outlet would diminish the erosion, then naturally go back to sheet
flow.

Ms. Schneider she just wanted to make sure, they really do not have a law to regulate
this . They are taking 2 . 7 acres of water and channeling it to a pond. If the pond is full it
gets dumped to the stream, channelized flow goes out the side to the stream. Channeling
causes increased discharge rate thus erosion and sediment movement in the stream. It is
high intensity long events, normally what flows across the land is diffused, it is because it
is channelized this happens. They have a nice idea and they have done what they can. She
wanted to note that climate predictions are showing increased high intensity events for
the northeast region. We will get at least 1 more 2 inch event within the next 5 years .
He is using historical vs. predictions . They are agreeing to allow flow through that
stream, it is a good design.
Mr. Zeserson noted that based on historical data it is a good plan. But if the futurists are
predicting more outside of this application this Board may want to consider this as data.
Mr. Porter stated even if the pond is full it will provide some buffer.
Ms . Schneider stated this is true, it depends on how quickly it infiltrates into the ground.
It is a B and C soil type, it is fairly decent, you want the water to go underground, if there
is enough break between waterfall, the rip rap will slow the flow. But this is the Board ' s
chance to say it could be a problem . They have followed the buffer, a gully may form
along the rocky area to the stream. Depending on velocity and flow it may cut into the
streams, it is not a major but once channeling starts it could be problematic .
Mr. Zeserson stated it is not this applicant ' s problem but this Board should use this with
the conservation area.
Ms . Schneider stated she is on a group that is identifying vulnerabilities and strategies.
They are looking at using the most recent vs . historical to reflect more accurate

development. It is not a perfect solution but it is a good solution. They may end up with
erosion.
Mr. Zeserson stated they could review this plan over the next five years and monitor this
process .
Ms . Schneider stated that would be a good idea.
Mr. Means asked if it could be written they have access to the property.
Mr. Porter stated he does not know if they can do that.
Mr. Zeserson asked if they want to be proactive could they do this?
Mr. Demerast stated the property maintenance code allows annual inspections of the
building and the property. There are elements that are beyond the building that
Mr. Rachun could inspect and review under NYS laws . He stated Scott Gibson works for
the City and his design was pretty intense . It is designed for a 100 year storm, it would be
Noah Ark status . Once it is overflowing it is just clear water, it will hit and may dig in,
they outlet 70 feet from the stream, it will be spread 30-40 feet. The stream is getting the
same volumemhether there is development or not. If someone needs to crack down on
stormwater they need to address the farms.
Mr. Zeserson asked if there further questions .
The members stated they did not.
Mr. Zeserson closed the Public Hearing at 7 :42 p . m. , no individuals from the public
attended the meeting.
Ms. Schneider asked if the silo was still in.
Mr. Demerast stated it is and they are using a 6/ 12 pitch. The one next door they were
hoping to take down cannot be used. They will have the fire stairs in the silo .
Mr. Zeserson stated they need to do the SEQR Hearing/Review. Copies of the SEQR as
completed by Mr. Demerast were distributed.
The members reviewed the SEQR form and determined there were no impacts based on
the thresholds .
Mr. Zeserson stated he had prepared a draft of a resolution and read the draft to the
members .

MOTION made by Ms Schneider, seconded by Mr. Porter,
WHEREAS the Town of Ulysses adopted zoning regulations in Local Law No . 4 2007
that includes Section 3 . 4 establishing criteria for Site Plan Review,
WHEREAS Architecture Technology Corporation (ATC) has participated in a Sketch
Plan Conference and relevant follow-up meetings, submitted the required documents and

paid the fees for Site Plan Review,
WHEREAS the proposed project, a facility which will house a software business is to be '
located at 1610 Trumansburg Road in an IL--Light Industrial District and the proposed
use and lot requirements for this project constitute a legal and conforming use as set forth
in the Zoning Law in addition to variances granted by the Zoning Board of Appeals,
WHEREAS other involved or interested agencies have been notified and been afforded
an opportunity to respond to this project and no objections have been registered,
WHEREAS the Town of Ulysses notified the Tompkins County Planning Department
about the proposed project pursuant to General Municipal Law 2391, m and n and the
project has been deemed to have no negative impact by the county,
WHEREAS the Town of Ulysses Planning Board made findings and a determination on
the environmental impact of the project under 6NYCRR Part 617 State Environmental
Quality Review (SEQR) and declared this to be an Unlisted Action requiring no
coordinated review due to the low environmental impact of the proposed project on the
site,
WHEREAS the proposed project complies with the Town of Ulysses Local Law 01 of
2007 Stormwater Management and Erosion & Sediment Control and all control measures
are in compliance with the NYS Stormwater Management Design manual, and
WHEREAS a Public Hearing was held on the project site plan on Aug. 5 after due
Bulletin Board posting and publication in the official newspaper for the town ten days
prior to the public hearing„
WHEREAS the Town of Ulysses Planning Board has given due consideration to all
information and comments in conducting Site Plan Review, now
THEREFORE IT IS HEREBY RESOLVED that the Planning Board of the Town of
Ulysses hereby approves the Site Plan proposed by ATC .
The vote on the motion resulted as follows :
AYES : Mr. Hawkes, Mr. Means, Mr. Porter, Ms . Schneider, Mr. Zeserson
NAYS : NONE
ABSENT : Mr. Wertis
ABSTAINED : NONE
THE RESOLUTION WAS PASSED UNANIMOUSLY.
The Board informed Mr. Demerast the resolution had passed.
Mr. Demerast stated he had a comment on a procedure he has encountered in other
municipalities. The preliminary site plan is the public hearing, what he likes about this is
if there are issues he can prepare and rectify the problems . He realizes this Board may
want a slower process, but in this case they had a delay from the county.
Mr. Zeserson stated the folder must be complete and usually it is not complete at the
preliminary.
Mr. Coogan stated if it is a controversial item this could be an option. But unless they
think there is a problem they won ' t.
Ms . Schneider and Mr. Porter agreed they have had problems where the application is not
complete, they Board is looking for more information so it can be presented to the public
in it ' s entirety. They are supposed to be more versed in this system yet they feel they
need to have the information at hand before they present it to the public .

Mr. Zeserson agreed with Ms . Schneider, and noted this application was really on top of
these things but they have had others that are not as well prepared.
Mr. Coogan stated Mr. Zeserson has five days to stamp and sign the application. After
that Mr. Rachun can authorize the permits .
Mr. Zeserson asked Mr. Coogan if it makes sense to get the public involved at the sketch
plan conference as offered by Mr. Demerast.
Mr. Coogan stated the sketch plan conference is between Mr. Rachun, the Chairperson.
This came from the standpoint is the Chairperson ready to have the Board review the
application. The Board can determine how many public hearings they want, when they
want to have them. If the applicant would like to have an early public hearing, it is at
their expense; they try not to apply extra expenses . They also can have public hearing and
not close it, the hearing can be adjourned then there is not additional expense.
Mr. Zeserson, stated that could be a case by case basis . He stated there is supposed to
have a meeting in August, at this point in time there are no applications to review.
Ms. Schneider asked what the status of the conservation zone was . She had seen the
maps and really like those.
Mr. Zeserson stated Mr. Coogan had obtained a summer intern that was doing work for
them compiling the names of land owners ' s within the zone. He asked when the next
meeting should be August 19 .
Mr. Porter and Mr. Hawkes stated they would be out of town .
Mr. Zeserson, stated he would prefer to hold the meeting when the majority of the
members could be in attendance.
Mr. Coogan stated there are preliminary meetings that could be done this month. The
members should meet with the Farmland Protection Board, Debbie Teeter is the contact !:
person at that office . Having them review and supportive of this zone will weigh heavy
with the State Ag and Markets division.
Mr. Zeserson, offered this is a good contact, and they also want to meet with Jay Franklin
from County , Assessment. The land will not go up in value but the fact that there is
decreased land available once property starts selling the new assessments will be done
and the land value increases .
Ms . Schneider agreed these would be good meetings to have .
Mr. Zeserson stated they do not have to meet in a public meeting but he would prefer to
have as many members attend as possible. He stated he will inquire and advise the other
members . Another individual he would like to speak with is Daniel Kwosknowski from
Dryden. He was involved with the Town of Dryden when they were addressing this issue.
A discussion determined that due to Labor Day the next meeting would be
September 16th
The meeting was adjourned at 8 : 10 p .m.
