2ND SCHEDULED TOWN BOARD MEETING
FEBRUARY 28 , 2008
PRESENT : Supervisor Douglas Austic ; Council David Kerness, Elizabeth Thomas and
Lucia Tyler; Mr. Ferrentino absent; Town Clerk Marsha L. Georgia.
Others Present : Geoffrey Hart, Mike Cirri, Mike May, Roxanna Marino, Carol Hoffman,
Steve Penningworth and Eric Pond.
Mr. Austic opened the meeting at 8 : 35 am.
The Board had scheduled an interview with Chris Austen for Dog Control Officer for
8 : 30 am . Mr. Austen did not arrive .
Mr. Austic said that a letter of recommendation for Mr. Austen was received from the
Town of Covert and he had distributed it to the Board .
Mr. Austic will forward the resolution for both the Cirri and Kline Development District
to the attorney.
Mr. Austic pointed out that the Town Board has not received anything from the Planning
Board of the Subdivision of the Kline property.
Mr. Austic started the meeting introducing and moving a resolution for a Negative
Declaration for the Cirri Development .
NEGATIVE DECLATION // CIRRI
WHEREAS a duly advertised public hearing for SEQR review was held on February25 ,
2008 at the Trumansburg Fire Hall in Trumansburg, NY and
WHEREAS the Ulysses Town Board has reviewed the information supplied by the owner
on Part I of the Full Environmental Assessment form , and reviewed Part II and other
supporting information, and
WHEREAS the Ulysses Town Board, as Lead Agent for SEQR review, has considered
both the magnitude and importance of each environmental impact of the proposed project
and has reasonably made a decision on those impacts, now
THEREFORE BE IT RESOLVED that the Town Board of the Town of Ulysses has
determined the project for the Cirri Planned Development District will not result in any
significant environment impact; therefore declare a Negative Declaration will be
prepared.
Ms . Thomas felt that the Board should wait until 9am for Ms . Tyler.
The Board talked briefly about dog control .
Ms . Tyler arrived.
Cirri Development District
The Board discussed the concerns that the residents had that were brought up at the
Public Hearing on the 25th . They discussed concerns brought up about the noise, hours of
operation and the concern for alcohol use . The Boards general consensus was that Mr.
Cirri had addressed these concerns and no changes were made in the development district
but Mr. Cirri said he would post sign for no alcohol and put in cameras for security.
Mr. Austic brought up the parking and felt that section should be revised.

The following will be inserted into the requirements of the development district under
16 . 3 . 11 (g) Parking
The owner (Cirri) is required to provide 48 off-street parking spaces for phase-one and to
maintain additional open space required in the Planning Board requirements that can be
developed for future parking up to a maximum of 113 spaces if the owner determines the
need for additional parking with the additional phases of construction.

Mr. Austic moved, seconded by Mr. Kerness the following :

Mr. Austic moved, seconded by Ms . Thomas the following :

Mr. May Attorney for Mr. Kline requested that the Board incorporate somewhere in there
resolution for the Kline Development that if the sale of land does not take place the
property will revert back to the original DD #5 and also stipulate the removal of the
tractor trailers used for storage be removed . Mr. May said he could contact Marietta on
this.
All information will be forwarded to Attorney Geldenhuys for review.
Purposed Water District #5 Alternatives
Mr. Pond said that based on the meeting last week where 3 alternatives were presented,
had a conference call with EFC and DOH. Mr. Pond said that he had told the Town
Board that he would go back and rework the parcel data and make sure the EDU ' s are
accurate, look at the engineering in more detail, and answer Mr. Kerness ' s question about
how many households that would be served. Mr. Pond has summarized all this and has
presented a new packet of information to the Town Board.
Mr. Pond said basically we have not learned any new, we are up against a comptroller
limit of $613 for EDU, up against a project capital cost limit of $ 10 million, and the
alternative C concept with the revisions as discussed plus a couple more he will enlighten
the Board on, meets the requirements as far as funding is concerned.
Mr. Pond said that in the packet you have a map, which is the 2007 Tompkins County
GIS data. The shaded in blue is Water District #3 , shaded in white is potential service
area for District #5 . Mr. Pond said that one significant addition is Wilkins Road be
included because for engineering they need to go up Wilkins because they needed
additional hydraulic to serve upper end with the higher elevation and needed to make that
connection with District #3 . It also lets you have more areas to move water through the
district. Also as previously discussed it brings the water line to the Town of Ithaca line
on Rt. 89 and restored the area originally in District #5 and no more water lines west of
Searsburg Road.
Mr. Pond said that this is just a preliminary boundary map which can be revised but the
next step would be to look towards doing the MPR.
Mr. Pond said all cost have been updated and included in the packet.
The Board reviewed, asked questions and discussed items with Mr. Pond.
