APPROVAL OF MINUTES After discussion about the minutes and minor changes and corrections were made Ms . Marino moved, seconded by Ms . Tyler the following : BE IT RESOLVED that the Town Board of the Town of Ulysses approve the minutes of the Regular Town Board Meeting of November 14, 2006, the Public Hearing of November 9, 2006 and Public Hearing of December 12 , 2006 as corrected. Marino the following : BE IT RESOLVED that the Town Board of the Town of Ulysses approve the 2006 Budget Modifications as presented by Supervisor Austic . FURTHER RESOLVE that Supervisor Austic is authorized to make any other modifications to balance the budget and after said 2006 Budget is balanced Mr. j Austic will prepare a financial report for the Town Board . Tyler the following : BE IT RESOLVED that the Town Board of the Town of Ulysses approve the previous examined voucher # ' s 554 through 589 in the amount of $24, 833 . 79 for 2006 and voucher # ' s 1 through 20 in the amount of $ 5 ,468 . 82 . REPORTS OF REPRESENTATIVES Tompkins County Board of Representative Jim Dennis reported that the County Legislature has re-organized for 2007 and Tim Joseph has been elected chair. Mr. Dennis said that he maintained his chairmanship to the personnel committee and is a member on I . .. . , _ 3 Regular Town Board Meeting 01 /09/2007 the planning committee and also a member of a newly formed committee called the building committee, which is going to be charged with finding a site and design a new County Health Building. Mr. Dennis mentioned that he had been contacted by a man named John Ranchik who is interested in putting up a wind turbine . Mr. Ranchik is coming before the County Planning committee to talk about his proposal . Mr. Dennis is not aware of any plans to look in Ulysses for any sites . The Board discussed the Health Department building site and expressed some thoughts . Trumansburg Fire Department — no one in attendance . Planning Board Chairman Report — no one in attendance . PUBLIC PRIVILEDGE OF THE FLOOR No one spoke . TOWN REPORTS Highway Superintendent James Meeker reported the following : • Trucks all inspected and serviced for winter operations • Salted as needed • Finished mowing back roadsides where it wasn ' t to wet • Cut brush and took down some hanging branches with a bucket truck • Installed driveway on Houghton Road • Picked up tree limbs in cemeteries Mr. Meeker thanked the Board for the holiday gift certificates . Code Enforcement Officer Alex Rachun reported that no building permits were issued in December. Mr. Rachun reviewed his annual report and reported that 55 permits were issued for 2006 which breaks down as 14 for single family homes, 34 for remodeling and 6 for business . • Town Clerk Marsha Georgia reported that she collected $ 1 , 346 . for the month of December and distributed $ 526 . 95 to the Supervisor, $ 140 for Water Permits and $ 531 . 60 to DECALs . Mrs . Georgia presented her annual report and stated that a total of $47 ,257 . 15 was collected for 2006 which was $6 ,680 more then 2005 . The 2007 taxes have been mailed and collection has started . Board Members and Committees Ms . Tyler announced that the Environmental Management Council is promoting having a program sponsored by the Cayuga Lake Watershed group on Docks & Moorings a forum for municipalities on March 29th at the Fire Hall just north of Fayette at 7 pm. This has to do with enclosed buildings and structures constructed on docks . Supervisor Austic said that by the end of the week he should have all the modifications done in the 2006 budget and will get that to the Board as soon as possible . Mr. Austic also said that he will be starting the Annual Financial Report due to the State and may be done at the end of January if any Board member wishes to review . Mr. Austic gave a brief report on his meeting with Bolton Point to discuss the availability of water for the Village . Mr. Ellis also attended this meeting and gave comment. 4 Regular Towni Board Meeting 01 /09/2007 I Mr. Austic is hoping that Mr. Pond will submit his report to the Board before the Village of Trumansburg ' s public information meeting that is tentatively scheduled for January 22 , 2007 . Mr! Austic announced that the Town received the Shared Services Grant . Deputy Supervisor Richard Coogan reported that the contract is in place to do the fly- over but the date has not been set. I Mr. Coogan said that the Stormwater Design Manual has had a big change where you will be allowed to do rain gardens instead of pits(for drainage) , like Kinney' s was made to do . OLD BUSINESS Action on Stormwater Law Ms . Geldenhuys provided the Town Board with minor changes to the Stormwater Law and a revised copy had been previously distributed . The Board wished to review and table until a later date . Other Revised 2007 Local Law for Code Enforcement Mr. Rachun distributed a revised copy of the new law and the Board will also review this and approve at a later date. Fee Schedules Mr. Ellis suggested that Mr. Coogan put together a fee schedule for the different areas that need fees and put that together for the Boards review and possibly some comparisons of what other townships charge. Rules and Procedures Mr. Ellis re-distributed the Rules and Procedures and reminded the Board that on August 2nd, 2006 they voted unanimously to approve them, but at the time the rules stated that it had to be voted on at two consecutive meetings for them to be approved and now that has been removed. Mr. Ellis moved, seconded by Ms . Tyler to approve the Rules and Procedures . Ms . Marino said that because she was not at the meeting where they were discussed she would like time to review. Mr. Austic felt the same he also would like to further review. Mr. Austic moved, seconded by Ms . Marino to table the Rules and Procedure policy until the next Town Board meeting to be held on January 22 , 2007 . Mr. Austic aye Mr. Ferrentino aye Ms . Tyler aye Mr. Ellis nay Ms . Marino aye Adopted. Organizational Agenda 2007 Ms . Marino moved , seconded by Mr. Ellis the following : BE IT RES I LVED, the Regular Monthly Board meetings of the Ulysses Town Board will be held on the second Tuesday of each month at 7 : 30 PM in the Ulysses Town Hall • 5 Regular Town Board Meeting 01 /09/2007 at 10 Elm Street, Trumansburg, NY . Board review of monthly claims will begin at 7 : 00 PM prior to each scheduled Regular Board Meeting. BE IT FURTHER RESOLVED the designated news media is advised of the foregoing schedule and those meeting notices are posted, in accordance with the open meeting law, on the clerk' s bulletin board . BE IT RESOLVED mileage at a rate of 48 . 5 cents per mile shall be paid to Town Officials and employees conducting official business and driving their personal vehicles and that such mileage shall be reported on the appropriate forms provided . BE IT RESOLVED the Highway Superintendent is authorized to incur expenses not to exceed $ 3000. 00 for repairs and maintenance of highway equipment without prior Board approval. BE IT RESOLVED the Building and Maintenance Chairman be authorized to incur expenses not to exceed $ 1500 . 00 for emergency repairs and maintenance following established procurement policy procedures . BE IT RESOLVED the following bond undertakings for Town Officials is hereby approved as follows : A. Town Clerk/Tax Collector $250, 000 B . Justices (2) $4,000 each C . Court Clerical $4, 000 D . Code Enforcement Officier $ 1 , 000 E . Highway Superintendent $ 1 , 000 F . Town Supervisor $ 500,000 G. Deputy Supervisor $ 15 ,000 H . Deputy Town Clerk $ 15 ,000 BE IT RESOLVED in lieu of the report required by Town Law Section. 29( 10), the Supervisor be and hereby is authorized to submit to the Town Clerk a copy of his annual report to the State Comptroller and that the Town Clerk shall cause a summary thereof to be published in accordance with the law. BE IT RESOLVED the Ithaca Journal shall be and are hereby designated as the official Town publication. BE IT RESOLVED the Tompkins County Trust Company is designated as depository in which the Supervisor, Town Clerk, Justices, and other employees by virtue of their offices, shall deposit all monies coming into their hands and, FURTHER RESOLVED the Town investments can be made at other banks as outlined in the Towns investment policy. BE IT RESOLVED the Town Board authorizes the Supervisor to pay in advance of audit of claims for utilities, postage and equipment rental leases which if delayed may result in loss of discounts or the accrual of service charges . Tyler the following : Resolution of Authorization : WHEREAS , Highway Law # 142-d allows co -operative agreements for highway services and sharing of labor, equipment and supplies ; and WHEREAS , General Municipal Law Article 5 -G allows and encourages municipal co- operations, by joint or contract basis , performance of powers and duties among themselves ; and WHEREAS , it is deemed beneficial to the Town of Ulysses to allow for shared highway agreements of equipment and services with other nearby municipal highway departments ; 8 Regular Town Board Meeting 01 /09/2007 NOW THEREFORE BE IT RESOLVED THAT the Ulysses Town Board authorizes the Town Supervisor pursuant to Highway Law #283 to enter into agreements for shared services and equipmentwith other municipalities and authorize, within existing budget constraints, the Town ' s Highway Superintendent pursuant to Highway Law #284 to take such action toiimplement said agreements consistent with Town highway needs and availability, and maintain sufficient liability coverage to protect the town in such joint efforts Mr. Austic aye Mr. Ferrentino aye Ms. Tyler aye Mr. Ellis aye Ms . Certificate of Designation Several people are interested in attending the NYS Association of Towns meeting this year in New York City, Ken Zeserson, Richard Coogan and Judge Rector. The Board needs to nominate a representative to attend the Annual meeting and vote on the resolutions (previously distributed to the Town Board and will vote on next meeting) Mr. Ellis moved, seconded by Ms . Marino to nominate Richard Coogan as the Town of Ulysses representative at the Annual NYS Association meeting. Mr. Austic aye Mr. Ferrentino aye Ms. Tyler aye Mr. Ellis aye Ms . Marino aye Adopted. Water Survey Letter Mr. Austic previously distributed a water survey letter but he stated that tonight is not the time to discuss it and can be at a later date. Junk on Seneca Road — Seneca County Ms. Geldenhuys reported that she had checked, at Mr. Ellis ' s request on the junk vehicles on Seneca Road in Seneca County. Ms . Geldenhuys said that there are certain provisions in the NYS Fire Prevention and Building Codes depending on the exact situation and also under General Municipal Law regulating of junkyards but it would really depend if that would fall under a definition of a junkyard. Ms . Geldenhuys said that it is not a hundred percent clear ,to her until she could learn more about the situation . Ms . Geldenhuys feels the best course of action would be to write a letter of complaint to Seneca County which enforces the State Codes in the Town of Covert. Mr. Ellis moved, seconded by Mr. Austic that Mr. Ellis will write a letter of complaint to the Seneca County Code Enforcement Office Ken Canfield, on behalf of the Town Board. Marino aye Adopted. 9 Regular Town Board Meeting 01 /09/2007 Recreation Partnership Letter Mr. Austic said he would write a letter to the Town of Covert and Hector asking them to consider donating to the Recreation Partnership contract now that the Town has information that 14% of the participants in the youth programs attend from these two townships . Ms . Marino would like to investigate what that fair share would be, before asking Covert and Hector for any set dollar amounts . Agenda for Special Town Board Meeting January 22 , 2007 • Work on year agenda for 2007 and what the Board members feel are the priorities • Rules and Procedure Policy Mr. Austic said that JV Smith would be willing to attend the meeting on January 22 , 2007 and answer any questions the Board may have. The general consensus of the Board was there would not be enough time at the 22nd and suggested that Mr. Austic check to see if he could come on January 29th, 2007 . Georgia Ulysses Town Clerk MLG: mlg Town of Ulysses Comprehensive Plan Committee January 9, 2007 Approved 02/27/07 with corrections Present : Sue Poelvoorde, Sue Ritter, Elizabeth Thomas, David Tyler, John Wertis Absent : Robert Brown, Heather Filiberto, David Kerness, Darien Simon, Robert Weatherby, Debbie Watkins . Ms . Poelvoorde called the meeting to order at 7 : 08 pm . She presented the minutes from the December 12th meeting. Mr. Wertis made the MOTION to approve the minutes, Mr. Tyler seconded the MOTION. The vote on the MOTION was unanimous, MINUTES APPROVED Ms . Thomas stated she had read that the Village of Trumansburg would be holding public meetings to report the results of the Comprehensive Plan Survey they had completed. She indicated she would be attending and stated if may be beneficial for other members to attend . The meetings will be January 18th and January 20th and are being held at the Fire Hall . Ms . Poelvoorde agreed this would be a good idea and other members indicated they would try to get to one of the presentations . Ms . Poelvoorde stated the members had received copies of the revisions that Liz Thomas had prepared . Ms . Carlisle Peck stated she had compiled the revision Sue Ritter and Liz Thomas did so the committee would be looking at one document . The committee continued the meeting with discussion and made revisions to the areas they had issues or concerns with. Ms . Thomas agreed to prepare the next draft with these revisions for the next meeting. The new draft as prepared by Ms . Thomas . Town of Ulysses Comprehensive Plan Survey 1 /15/2007 Dear Town of Ulysses Resident : The Town is currently updating its comprehensive plan for the future of our town .
