Special Board Meeting
5/16/2006
PRESENT : Supervisor Doug Austic , Councilpeople Rod Ferrentino , Don Ellis, Roxanne
Marino , and Lucia Tyler . Town Clerk Marsha Georgia.
ALSO PRESENT : John Hrubos , Village of Trumansburg Trustee .
RECORDING MINUTES : Marsha Georgia, Ulysses Town Clerk.
The meeting was called to order at 7 : 00 pm .
The Board reviewed Eric Pond ' s written response to Roxanne Marino ' s questions . These
questions and responses are set forth in a document entitled, "May 15 , 2006 R. Marino
Comments & Responses".
Trumansburg Village Trustee John Hrubos initiated a lengthy discussion of the
development concern associated with water service extension .
Supervisor Doug Austic requested the Board ' s authorization for him to continue moving
forward on preliminary Water District #5 work by undertaking such tasks as working on
agreements with Bolton Point, setting up negotiation meetings with the Village of
Trumansburg, and researching cost information, with the understanding that he will keep
the other Town Board members informed. Austic noted these items are all necessary
before a Map, Plan & Report can be completed . Austic also stated he sees no reason why
the Comprehensive Plan revision process cannot take place parallel to Map, Plan &
Report development for Water District #5 .
Councilman Rod Ferrentino noted that none of these items bind the Town, and suggested
allowing Supervisor Austic to proceed with these steps in parallel to revising the Zoning
Ordinance as soon as possible and also starting the Comprehensive Plan revision process.
Trumansburg Village Trustee John Hrubos noted the Board has to know what the Town
is going to look like before it can sensibly update its Zoning Ordinance .
Roxanne Marino expressed agreement with a sense that this did not happen with the latest
Zoning Ordinance revision.
Austic explained the Zoning Ordinance was revised based on what was planned and
existent over the years, drawing from the Comprehensive Plan . Austic also noted the
Comprehensive Plan may not need extensive revision . Austic explained, with the Zoning
Ordinance already in place, it made sense to go forward with Water District #5 .
Brief heated discussion ensued .
Rod Ferrentino asked the Board Members, individually, if they are in favor of the water
district
All answered yes, except that Don Ellis noted he sometimes feels that he is the only
person at the table who sees where this Project might not happen. Mr. Ellis thinks it
possible that it not go because of opposition to it and he thinks that the Town really has to
deal with the opposition and address the kind of fears that have been brought up . The
Town needs to have something that is a real response to all of the concerns.
Ms . Marino stated that she has no problem with the goal of the Water District but she is
not certain that she wants it as laid out as actually as it is . She still has questions about an
alternative that she would like addressed . Ms . Marino thinks it is a good goal to provide
water to people that need it and it is an advantage to the Park. Ms . Marino said that she

agrees with John that the Town needs economic development but she does not agree that
it should be just anywhere but she thinks there needs to be a plan.
Discussion of the balance of interests in protecting the character of the neighborhood
versus providing potable water to citizens currently lacking this commodity ensued
amongst the Town Board members .
Austic proposed scheduling two public information meetings — one for residential
citizens within the proposed Water District and one for commercial/industrial property
interests within the area.
Don Ellis submitted that the Board should meet and review an information packet before
the meetings are scheduled.
Austic asked the Board to schedule a meeting now, and he will get this information right
away.
Don Ellis replied no, the information packet should be assembled for the Board ' s review
and be reviewed by the Board before public meetings are scheduled . .
Austic noted the public is expecting these meetings to take place in early June.
Ellis agreed to schedule the meetings tonight.
Roxanne Marino stated she wants the information about the meetings mailed to everyone
within the proposed district.
Austic affirmed this can be done . A meeting to discuss and review the information was
scheduled for Thursday, May 25th. Supervisor Austic stated he will send the information
out to Board Members as soon as it is ready, and asked that they get back to him right
away if they see any issues with the information. A public information meeting was
tentatively set for the week of June 5th

Rod Ferrentino suggested laying out a timeline for the Zoning revision and
Comprehensive Plan review processes .
Roxanne Marino noted the Comprehensive Plan Core Committee has a meeting on May
23rd.
Rod Ferrentino requested Board authorization for Supervisor Austic to continue work on
Water District #5 planning and development on the Town ' s behalf, so long as he does not
commit the Town ' s financial resources in so doing .
Roxanne Marion asked for a list of tasks Austic will undertake in this process .
Lucia Tyler submitted a proposed resolution that would better accomplish the objectives
of the April 11th resolution addressing Austic ' s communication with outside agencies . .
Discussion of the nature and limitations of Austic ' s work ensued .
Lucia Tyler made a motion to authorize Supervisor Doug Austic to enter into preliminary
discussions with Bolton Point, the Town of Ithaca and NYS DOT, and to research the
SHPPO review process .
Don Ellis seconded and discussion ensued .

The resolution related to communication of the Town Supervisor or his agents
passed on 4/ 11 /06 was intended to include the Board by vote on any
communication by the Supervisor or his agents that would indicate commitment
of the Town, application by the Town or authorization by the Town to third
parties concerning Water District #5 .
Be It Resolved that the scope of the Supervisor ' s and the Town Board members '
communications should in all respects conform to the law and the 4/ 11 /06
resolution should be construed as consistent with the law . It is hereby resolved
that the above clarification be made part of the 4/ 11 /06 resolution for the record.
Don Ellis seconded and discussion ensued.
Doug Austic moved to take action on the resolution off the table .
Rod Ferrentino seconded .

The motion carried and action on the proposed resolution was taken off the table . After
discussion, it was agreed that action on this resolution will be included on the next
regular board meeting agenda as old business .
Hearing no further business , Lucia Tyler moved to adjourn the meeting. Rod Ferrentino
seconded.
