BOARD OF ZONING APPEALS

PRESENT : Chairman George Tselekis, Members Joel Warren, Carl Mann, and Gerald
Van Orden; Code Enforcement Officer Alex Rachun; and Zoning Typist Karin Lanning.
ALSO PRESENT : Arthur Tauck, Frances Littin, Peter Demjanec , Architect, and Paula
Horrigan, Landscape Architect.
Chairman Tselekis called the meeting and a duly advertised public hearing to order at
7 : 30 pm . The purpose of the public hearing was to hear comments on an area variance
requested by Arthur Tauck and Frances Littin for the purpose of constructing a new
garage addition on their existing residence at 1359 Taughannock Boulevard, Tax Parcel
28 - 1 - 10, a lot that lacks the minimum 250 feet of frontage and 250 feet of depth.
Chairman Tselekis asked the applicant to describe the project .
Arthur Tauck explained they plan to demolish two existing sheds and an existing garage
and replace these structures with an attached garage . The new structure will add less than
90 square feet to the footprint of the residence .
Architect Peter Demjanec noted that the new structure would be further from the lot lines
than the existing structure is .
Chairman Tselekis asked the Zoning Typist to read correspondence into the record .
Zoning Typist Karin Lanning read a letter from Dawn E . Redlin, who earnestly supports
the request . Copy of letter is on file in the variance file .
Chairman Tselekis opened the floor to public comment .
Hearing no public comments, Peter Demjanec noted Landscape Architect Paula Horrigan
has a Preliminary Site Plan to submit .
Paula Horrigan submitted a Preliminary Site Plan to the Board . Ms . Horrigan briefly
described the Site Plan and the Board reviewed the Plan .
Chairman Tselekis asked if the garage structure will consist of two- stories . Mr. Demjanec
answered no . It will actually be three stories tall . The middle level will be at ground level
and will be used as a garage. The basement will be used for outdoor storage and the attic
will be used for household storage.
Chairman Tselekis asked if the Board Members had any questions for the applicants or
their agents .
Hearing no further comments or questions, Mr. Mann moved to adopt the following
resolution :
Whereas, there should be no undesirable change to the character of the
neighborhood and no detriment to nearby properties resulting from the requested
variance, and

Whereas, the benefit sought by the applicant cannot be achieved by a feasible
alternative method other than an area variance, the availability of land in the
neighborhood being very limited, and
Whereas, the variation is not substantial in comparison to the requirement, and
will, in fact, result in buildings being further away from the property lines than those that
currently exist, and

Whereas the variance requested will not have an adverse impact on the physical
or environmental conditions in the neighborhood, and
Whereas, the alleged difficulty was not self-created, but is inherent to lots along
the lakeshore,
Be It Therefore Resolved that an area variance is granted to Arthur Tauck and
Frances Littin from the requirements for 250 feet of frontage and 250 feet of lot depth for
the purpose of replacing their current garage at 1359 Taughannock Boulevard, Tax Parcel
28 - 1 - 10, with an attached 3 -story garage .
Mr. VanOrden seconded the motion .

The motion carried and the variance was granted .
Mr. Van Orden moved to approve the minutes of the August 17 , 2005 meeting and public
hearings as presented . Mr. Warren seconded.

Adopted .
Hearing no further business, Mr. Warren moved to adjourn the meeting. Mr. Mann
seconded .
