HomeMy WebLinkAbout2004-02-18 - BZA TOWN OF ULYSSES ZONING BOARD OF APPEALS 2/18/2004 PRESENT : Chairman George Tselekis, Zoning Board of Appeals Members Ken Christianson, Carl Maim, and Joel Warren . Code Enforcement Officer Alex Rachun, and Zoning Typist Karin Lanning. ALSO PRESENT : Gary Weiss, representative of the applicant. Chairman Tselekis called the meeting and duly advertised public hearing to order at 7 : 30 pm. The purpose of the public hearing was to hear comments on an area variance request from Francesa Crannell and M . Kent Garrison for the purpose of adding onto their existing residence located at 35 Maplewood Road, also known as tax parcel 29- 1 -27 . An area variance is needed because the property consists of less than one acre of land, has less than 200-feet of frontage, and it is not possible to inscribe a 200-foot diameter circle of usable area on the property. Chairman Tselekis asked Gary Weiss , representing the applicants, to briefly describe the project. Mr. Weiss explained the house is on a steep and long, narrow parcel . The owners want to extend up-hill from the current boundaries of the house, with the idea being to reduce the number of steps that they have to descend before reaching the residence. Weiss stated they will be using the same septic and water systems . Chairman Tselekis noted no members of the public are present to comment, and stated one letter of comment was received concerning the project . The letter is strongly in support of the area variance being granted. Chairman Tselekis asked if the number of bedrooms or bathrooms will change. Mr. Weiss stated the number of bedrooms and bathrooms will remain the same. Hearing no further comments, Mr. Maim moved the following resolution : Whereas, the variation in relation to the requirement is not excessive, especially given the lake-front location of the property, and Whereas, there will be no or minimal increase in population density and, therefore, no or minimal increased demand on the available governmental facilities, and Whereas, the variance would result in no or minimal change in the character of the neighborhood and no substantial detriment to adjoining properties; indeed, the only comment received in regards to the area variance request indicates the proposed project would be an improvement to the neighborhood, and Whereas, it appears that the difficulty cannot be feasibly obviated by some means other than a variance, and Whereas, given all of the above considerations it would appear that the interests of justice dictate the variance be granted, Be It Therefore Resolved, that the Town of Ulysses Zoning Board of Appeals hereby grants an area variance to Francesa Crannell and M . Kent Garrison for the purpose of adding onto their existing residence, located at 35 Maplewood Road, and also known as Town of Ulysses Tax Parcel 29- 1 -27 . Mr. Christianson seconded . Mr. Christianson aye Mr. Maim aye Mr. Tselekis aye Mr. Warren aye The variance was granted. The next order of business was approval of minutes. After brief review, Mr. Mann moved to approve the minutes of the Meeting and Public Hearing of 1 /21 /2004 as presented. Mr. Christianson seconded. Mr. Christianson aye Mr. Mann aye Mr. Tselekis aye Adopted. The final order of business was a request for Zoning Board action from Carl Mann concerning his property at 2290 Trumansburg Road. Code Enforcement Officer Rachun and Chairman Tselekis noted they have not consulted the Town Attorney on this matter as of yet, but will need to do so in order to determine what Z . B . A. action is appropriate in this situation . Mr. Tselekis agreed to contact the Town Attorney right away. The next meeting date was determined to be March 17th, and Mr. Rachun will advertise the meeting and hearing concerning Mr. Mann ' s request for that date once he has been advised by the Town Attorney.
