HomeMy WebLinkAbout2003-09-29 - PB TOWN OF ULYSSES PLANNING BOARD MEETING September 29, 2003 Present: Chairman Richard Coogan , Planning Board Members David Tyler, Mark Ochs, Rose Hilbert; Code Enforcement Officer Alex Rachun ; Absent Planning Board Members George Kennedy (excused) and Lorren Hammond (unexcused) . Note : No secretary — these minutes are done with the notes from Chairman Coogan (tapes on file) . Chairman Coogan called the special meeting to order at 7 : 11 PM. Tonight they are meeting with Alex Rachun to discuss Applicability and Site Plan Modification Procedures . They are trying to balance SPR ' s against the amount of cases the Planning Board could reasonably handle given the fact that Ulysses does not have a paid professional Planning Department. APPLICABILITY The Planning Board feels that the Applicability section in the current ordinance works more effectively than the proposed one. Currently Site Plan Review states all projects are subject to Site Plan Review with the following exceptions . • The issuance of a permit did not necessarily need to mean Site Plan Review • Residential accessory structures with a footprint larger than 1000 square feet and/or more than 20 feet in height would require Site Plan Review . • Under changes in use, another condition for Site Plan Review would be if the hours of operation changed so that the establishment was open after standard business hours ( 11PM through 6 AM) • Waiver of Requirements for Site Plan Approval — the Town Board would not have the right to waive requirements. If an applicant felt that the Planning board was making an unfair request, the applicant could ask the Town Board to have a mediator try to resolve the issue . Mediator could not be a member of the Town Board or any functionary. Mediation would not be binding and process would be optional. Applicant would retain the right to sue under Article 78 . The Town Board would decide if the Town would pay mediator. MODIFICATIONS On page 77 of the draft ordinance dated Spring 2003 under "or if modification of final site plan approval involves" remove item number 2 and 5 . The Planning Board discussed color as a requirement, which lead to the Planning Board deciding that it should not be a part of Site Plan Review approval unless the design standards clearly defined aesthetic concerns . The Planning Board did discuss there may be other mitigating factors that could be employed if the color scheme caused problems for the neighbors . This could be having an increased vegetative buffer if the finish on a building was highly reflective . DESIGN STANDARDS The Planning Board feels that this is a critical area to zoning but they feel the Planning Board does not have the experience or expertise to draft the standards. The Planning Board requests that the Town Board consider having this area improved. FINAL COMMENTS The Administration Article will be revised and sent shortly for review . The general consensus of the Planning Board is there are still unresolved issues with the draft ordinance, but the Planning Board realizes the importance of moving the draft ordinance into law. The Planning Board is requesting the Town Board to consider Planning Board Meeting 09/29/2003 moving the ordinance forward with the understating that the technical aspects will be refined after passage. The Planning Board also requests a follow up joint meeting with the Town Board to discuss the map and to follow up on the tasks that George Frantz has been assigned to work on from the last joint meetings .
