REGULAR TOWN BOARD MEETING
MAY 13TH, 2003

Supervisor Austic called the meeting to order at 7 : 30 pm, and led those assembled in the
Pledge of Allegiance to the Flag of the United States of America.
APPROVAL OF MINUTES — Regular Town Board Meetings of 4/8/2003 , Special
Board Meeting of 4/21 /2003 and 4/28/2003
After minor corrections and/or changes Ms . Poelvoorde moved, seconded by Mrs .
Duddleston to approve the minutes of the Regular Town Board Meeting of April 8 , 2003 .

The minutes of the special Town Board meeting were tabled until the next meeting.
APPROVAL OF MONTHLY CLAIMS
Mr. Scott moved, seconded by Mrs . Duddleston to approve the previously examined
vouchers # 182 — 230 in the amount of $ 96 ,403 . 22 .

REPORTS OF REPRESENTATIVES

Richard Coogan, Planning Board Report
Mr. Coogan reported the Planning Board is scheduled to meet tomorrow evening. They
plan on addressing the matter of getting minutes out in a timelier manner. They have an
idea of how many days we have. Mrs . Georgia pointed out that minutes are technically
suppose to be posted within two weeks of the meeting and approved shortly after that .
Mr. Coogan asked if they could be posted as a draft copy. Mr. Austic stated when a

decision is made we have to have a certified copy within five days . So if the Planning
Board wants to look them over they would have to have another meeting within a day or
two . Mr. Coogan asked if the Board had any idea about when straining will be provided
to the Planning Board. Ms . Poelvoorde said the Planning Board should look at dates then
she would check to see if they were available .
Mrs . Duddleston asked if the Planning Board had discussed the request from Robert
Brown of Flo-Tech. The Planning Board will be provided this and Mr. Brown will be
asked to attend .
E .M.0 Report
Christian Boisonnas reported that the Jet Ski report has been trashed. He has no sense of
what they really want and there is a lack of agreement around the lake.
Ms. Poelvoorde had attended a meeting last Thursday night with other representatives
from the Town of Ithaca and Lansing and the City of Ithaca. They reviewed the report
that was a result of what came out of the subcommittee, which was charged with looking
at the personal watercraft issue and other issues. The report did go to the Water Resource
Council . (Ms . Poelvoorde had never seen the report previously. ) What Ms . Poelvoorde
got out of this meeting was a pre-empted strike against the County again. The
recommendations in the report is to pass some regulations, pass some programs and the
general consensus is that they do not want the County to do thus, land use regulations
should be up to the Towns . So Thursday night they went through the document and went
through the recommendations . The recommendations ranged iin controlling activities to
issues of water quality. They went through each one . The first one was to devise a
program to phase out two -cycle marine engines on the lake and also require maintenance
of engines . They discussed that the County could take on the inspection of engines . The

next section dealt with the personal watercraft safety, noise, and setting up a zone. What
was talked about was setting a zone from the shore and what was thrown out at the
meeting was potentially going out 250 ' from shore to have it 10 miles per hour. The next
dealt with personal watercraft and hours of operation. The County had 6PM, but they
talked about going to 8PM . Next section related to the prohibiting operation of any
personal watercraft to anyone less than 16 years of age, unless accompanied or observed
by a parent g uardian within 250 ' . Maybe doing something like the motorcycle law.

Another section related to limiting rentals of personal watercraft, another one was on
tubing and pulling objects . Another one was operating a certain distance from shore,
exempting fishing boats . There is a whole section on reducing noise . Everyone at the
meeting agreed that would be way too difficult to enforce . There are already laws under
the navigation law that regulate this . There was something on mooring, not letting boats
tie up together. They were not really against this . Than they talked about speed limits . In
the report it is 45 mph during the daytime and 25PMH at night. The 25 at night did make
sense. The last one is establishing standards for anti-fouling paint. That is beyond the
purview of the County or Towns .
Mr. Boisonnas was confused because the report Ms . Poelvoorde was discussing was
consider dead. Ms . Poelvoorde also had gotten that idea but had been asked to attend the
Thursday meeting. Ms . Poelvoorde stated the Towns and the City do have some
consensus that something needs to be done about regulating use on the lake and it is not
just personal watercraft it is the whole boating issue and again viewing these things that
operate on the lake, they are vehicles and there are safety problems . The meeting was to
go through the report to see if any of the recommendations made sense . The Tompkins
County Municipals Officials will also discuss the topic at their next meeting. The
overriding issue is , do the Towns want to do something and do something that everybody
agrees with so that enforcement is for the whole area?
TOWN REPORTS
Highway Superintendent
Mr. Meeker reported that the highway crew hauled stone, finished back grading and
replacing sod that got dug up through the winter plowing, helped the County do a little

tiling project on Bostwick Road, cleaned up the brush on VanDorns Corners Road (billed
INYSEG for this) , cold patched some pot holes and pulled the salt boxes off of the trucks
and washed them out. The cemeteries have been cleaned up and are ready for Memorial
Day. Last but not least, the new tuck has been delivered .
Code Enforcement Officer
In Mr. Rachun ' s absence, Supervisor Austic read his report. Ten permits were issued for
the month, one for a single- family residence, 3 for two- family residences, 4 additions,
and 2 for businesses and one Zoning only permit .
Town Clerk
Mrs . Georgia collected a total of $ 1 , 053 . 50 for the month of April and $ 644 . 94 was
turned over to the Supervisor along with her monthly report. Second notices were mailed
out for unpaid taxes ; all but $ 85 , 000 has been collected . She has received a couple of
calls for Plans for Water District #3 , but the callers decided to call Barton & Loguidice to
order them. A list has been started of interested contractors to dig the waterlines from the
main to the house and hook up the water. Mr. Austic stated it was suggested to him the
Town license these contractors and by licensing you give them the plans or procedures to
follow . It may just be an approval plan. People will be allowed to do their own but they
would still have to have it inspected . More information will be needed on this . Barton &
Loguidice are submitting a plan on how to do this hook up .
Board Members and Committees
Mrs . Duddleston reported 15 property owners came to the Local Grievance on
Assessment that was held last Monday. They did have one property owner from Rice
Road come and ask for a reduction in assessment based on the condition of the property
directly across from them that is in violation of the Town ' s Zoning Ordinance. Mr.
Rachun has been aware of this situation and not only would the property owner like it
looked into , the Department of Assessment does also . The property owner had stated that
assessments go up because of lake views than why shouldn ' t they go down because of a
horrible view. It was pointed out that a view of the lake is a permanent view but this
view is there because the Town of Ulysses is not enforcing their Zoning Ordinance . The
property owner feels that because it has gone un-enforced for so many years it may be
permanent. The Board will check with Mr. Rachun . Mr. Austic stated that he would see
that something gets done about it .

Mr. Austic reviewed the Financial Report and no questions were heard . Mr. Austic
presented the following modifications in the budget .

OLD BUSINESS
Water District # 3 Update
The advertisement was published for bids on Water District #3 and the bid opening is
scheduled for Thursday May 29th, 2003 at 11 am. The engineers will review these after
opening and the bid will be accepted on June 10th, 2003 , at the Regular Town Board
Meeting.

Voting Machine Proposal From T.C.
Mr. Austic responded to Dooley Kiefer' s letter in reference to the proposal of new
electronic voting machines . Basically his response was more questions than comments
and her response to him was that she was looking for just that sort of feedback. The
Board is waiting for more information. Supposedly the Federal government is mandating
the electronic voting machines .
Zoning Ordinance Meeting Scheduling
The next meeting was scheduled for May 27th, 2003 at 5 : 30 Pm at the Town Hall 10 Elm
Street, Trumansburg, NY .
Robert Brown Request, Update
Mr. Brown has not furnished any additional information. The Planning Board will
review what he has submitted and his request to relocate his business, Flo-Tech, on
Halseyville Road.
Mr. Austic spoke to Attorney Bruce Wilson in reference to if the project will fit in our
current zoning or how to fit it in with our proposed zoning. He explained it that the
Town could look at the zoning we have purposed and pass the agriculture zone part, and
than designate Mr. Brown ' s property as an ag-zone, than since Cottage Industries are
allowable in an ag-zone he could go forward. That is one way to do it . The intent follows
the Comprehensive Plan and it follows the proposed zoning. Mr. Austic feels this is the
only approach they can follow at this point. The Planning Board will review and provide
their opinion.

The only other business Mr. Austic mentioned was to get information on how to register
contractors/plumbers for the hook- up of water.
HEARING FROM INDIVIDUALS AND GROUPS
None heard.
CORRESPONDENCE
Site Plan
Mr. Austic provided copies of the Town of Ithaca ' s Site Plan Review and Approval
Procedure for the Board to review . There may be a couple of things we might want to
use .
Grants
Mr. Austic received from Governor Pataki ' s office information on grants funded under
New York State ' s Environmental Protection Fund . Mr . Coogan wants to take a look at
this . The other is Appalachian Regional Commission Program for FY 2004 .
Food-Net Request
Mr. Austic spoke with Irene Stein and she has stated the County is going to cut the food-
net program out of their budget . Locally they are talking about the funding for the
program at the Baptist Church in Seneca County where they delivered 25 meals to
residents in Ulysses, 25 meals a day to residents in the Village of Trumansburg and 26
meals in Seneca County. These are home-delivered meals ; five days a week and also
they serve 15 people who come to the church to eat once a day. They are requesting
around $ 1700 from the Town. They contract with Seneca County, the food is prepared in
Seneca County and brought down here and they supply the funding for food preparation
and bringing it down . The 26 people in Seneca County are being funded by Tompkins
County because they are bringing the food down . Ms . Poelvoorde asked if the Village of
Trumansburg would also be asked . Mr. Austic stated they did not but the Town could go
to the Village and ask for half because it is serving both municipalities . The Board feels
it is a good program .
Energy Smart
Mr. Austic explained briefly the Energy Smart Program . Information on file in the
Clerk ' s Office.
ADJOURNMENT
Hearing no further business Mr. Scott moved, seconded by Ms . Poelvoorde to adjourn the
meeting. Hearing no objection the Board unanimously approved to adjourn. Meeting
adjourned at 9 : 05 PM .
