SPECIAL TOWN BOARD MEETING
Draft Zoning Ordinance
April 28, 2003
PRESENT : Supervisor Austic ; Councilpeople Sue Poelvoorde, Carolyn Duddleston and
Lee Scott ; Marsha L. Georgia, Ulysses Town Clerk ; Councilman Robert Weatherby and
Code Enforcement Officer Alex Rachun absent.
Supervisor Austic called the meeting to order at 510 PM to review the Draft Zoning
Ordinance .
The 'Board reviewed the new definitions discussed at last week ' s meeting.
The following changes and/or corrections were done :
Mrs . Duddleston asked how they were distinguishing between, what we keep calling,
open land/open space and agricultural , or aren ' t we? The general consensus of the Board
was everyone could have a difference of opinion of open space . Ms . Poelvoorde stated
she would provide a definition used by the State .
Discussion of Kennel came up and that it is not actually in any zone yet but is in the
definitions . Change definition to read : Any place or facility for the business of boarding,
grooming, training and competing animals not owned by the owner of the property. It
was decided to put this in Agricultural District under a special permit.
Article IV — Al — Agricultural District
4 . 1 Purpose - put a comma after promote and possible
4 . 2 Right to Farm - no changes
4 . 3 Permitted Uses - Roadside stand - Section 18 . 11 . 1 should be 18 . 12
Stable - Section 18 . 11 . 2 should be 18 . 17
Double-wide manufactured homes — maybe include that they have to be skirted.
Define skirting under definitions and explain that it has to be permanent durable skirting.
Mr. Austic will check with the attorney.
Farm worker residences — add as regulated by NYS Code .
4 . 4 Permitted Accessory Uses
Delete Customary, conducted solely by residents of the dwelling — just have
Home occupations
Delete paragraph about Dish Antennae (delete this through the entire document)
Delete Office of a resident accountant, doctor, dentist, musician, engineer,
teacher, lawyer, architect, landscape architect, artist, real estate broker or person engaged
in similar occupation and replace with just Professional Office and replace building in
the next sentence with property.
Signs — add Section 18 . 4
4. 5 Uses Allowed by Special Permit (Title to Change to — Uses Allowed by Approval
by the Planning Board) the following uses are allowed upon approval by the
Planning Board pursuant to Article XVII, Section 17. 2 , subject to the standards set
forth in Article XVIII.

Move the following to permitted uses but make sure that under Article XVIII that
standards are made .
Bed and breakfast — refer to Sections for parking, lighting etc .
Business directional signs, subject to limitations set forth in Article XVIII,
Section 18 . 4 . 2
Cemetery and the building and structures incidental to cemetery operations (Find
out if they are regulated by State)
Elder Cottage
Lodge — Update definition — A multiple dwelling used primarily for the purpose of
furnishing lodging, with or without meals, to 15 or less transient occupants, for
compensation.
Add : Kennel
Add : Adult care group — will need definition for this and will be needed to be
added to definitions up front. Use definition same as Child Care Group but change to read
adult. The care, protection and supervision for fee, at least twice a week, of not more
than six (6) but not more than twelve (12) adults at any one time by a resident of the
dwelling
Sawmill — under the design standard page 86 change the time of operation to 8 am

5 . 1 Purpose - no changes

Remove this whole section — Transfer Communication transmission towers and
telecommunications facilities, subject to the provisions of Article XVI to Permitted Uses
5 . 2 . Tower Ordinance needs to be re-visited.
5 . 5 Lot Area & Yard Requirements - Change to 5 .4 - no changes
5 . 6 Buffer Areas - Change to 5 . 5 - no changes
Article VI — R1 - Moderate Density Residence District
6 . 1 Purpose — again open space was talked about and getting, a definition — (was
definition in the Town Comprehensive Plan) . Ms . Poelvoorde will look at the State open
space plan and Mr. Austic will check with George .

Delete everything after Two-family
