PLANNING BOARD MEETING
TOWN OF ULYSSES
FEBRUARY 4, 1997
Present: David Tyler, Krys Call, Budd Stover, Gail Zabawsky, Peter Demjanec,
The meeting came to order at 7 : 30 pm.
• The topic of discussion was the regulation of Telecommunications Towers.
Mr. Tyler handed out several articles concerning the topic which the members of the board
reviewed and then discussed.
The board discussed the current growth in the cellular industry.
Mr. Demjanec stated he feels that the towers are noticeable but that in most instances they are not
particularly objectionable, also most of them are built with a fairly fine line especially the ones
with guide wires. He noted the issues that concern him are the EMF radiation and the reception
issue ( TV & Telephone).
The board then discussed the findings that EMF radiation is not as much of a concern as earlier
reported.
Mr. Tyler stated that he feels that the issues they should be concerned with are aesthetics, health
and the reception issue. He noted that they should in the future examine topal maps to select
possible sites do to height restrictions.
Mr. Stover asked where they want a tower in the town of Ulysses ?
Mr. Tyler answered that one site he had heard mentioned was Mekeel Rd.
The board then discussed the existing towers on Searsburg Rd. , Cellular One, and The Statler.
They mentioned that there is a dead spot in this area which is the reason for the need for erecting
another tower.
Mr. Stover asked if this is a one time only situation, or will competitors be coming in with
requests.
Mr. Tyler answered that it is a competitive market but he feels that one company isn't likely to
lease its rights to another competing company, so that one is in and another would want a similar
facility to operate with.

Ms. Call noted that Alex Rachun had mentioned the possibility of requiring a company to share a
facility. They then discussed the plausibility and legal standpoint of making those restrictions.
Mr. Tyler noted that when they have something roughly put together they should have Bruce
Wilson look it over.

Mr. Demjanec stated that when the towers outside of the town went up he lost two of his
television channels 18 and channel 12 . They then discussed the problems with television reception
and telephone interference, also the inability of many residents to subscribe to cable TV.
Mr. Demjanec suggested the possibility of writing into the ordinance a requirement that anyone
erecting such a tower provide the town with an electrical consultant .
Mr. Tyler stated that the town would need someone to answer all of the questions that they have
concerning these issues .
Mr. Tyler asked if the Stanford report should be the model that they use to work from? Copies
were then handed out for examination.
Ms. Call then noted that she feels that included in the criteria should be the problem of children
attempting to climb the towers and the need for a high enough fence.
Mr. Demjanec noted that they should confirm if the 75 foot limit in the Stanford Ord. is an
attempt to preclude any towers.
Ms. Zabawsky asked if Alex Rachun has been approached for a permit ?
Mr. Tyler answered that they have only been asking about requirements etc.
Mr. Tyler then noted that they have the five following concerns to discuss .
1 ) Aesthetics
2) EMF
3) Reception
4) Height Line of Site
5 ) Impact on Neighbors

The Board then discussed the height restrictions in the Stanford ordinance. They have a setback
of two times the tower height with a 75 foot maximum height . Mr. Demjanec and Ms.Cail felt
that this was too diminutive and would allow the tower on too small of a lot.
Mr. Stover noted that the guide wires would require a larger lot than specified in this example. He
mentioned that if in the future the tower is no longer used they should have a function where the
company must dispose of it or it be at the expense of the property owner..
Ms . Cail suggested that they may need to define the area needed to make clear the amount of land
that is entered into the lease.
Mr. Demjanec asked how many sites there are within the township that would be appropriate for
a tower
Mr. Tyler answered two or three, Mekeel Rd. , Perry City Rd. , and Reynolds Rd. . They then
discussed the possibility of redefining the areas that would be feasible due to elevation, the
transmissions, and the line of site.
The board preceded to examine and discuss the Stanford ordinance.
They then discussed the need to get professional advise on the subject of EMF to answer the
questions that will arise on the subject.
The meeting adjourned at 9 :00 pm to readjoum when more information has been gathered.
