HomeMy WebLinkAbout1994-06-27 - PB g7 TOWN OF ULYSSES PLANNING BOARD MEETING JUNE 27 , 1994 TOWN HALL PRESENT : CHAIRMAN : DAVID TYLER ; MEMBERS : BUDD STOVER , KRYS CAIL , DAN SMITH , GREGG HOFEMIRE ; SECRETARY : ROXANNE SMITH The meeting came to order at 7 : 40 PM . ® DOUG AUSTIC ' S LETTER TO MASTER PLAN COMMITTEE The Members discussed the area surrounding the Shur - Fine . They decided the acreage in question amounted to 65 to 70 acres . David stated he ' s not prepared to say the whole area behind Duddleston ' s be considered Commercial . Krys questioned why it couldn ' t be considered just for possible water and sewage and leave it as is otherwise . David stated that he thinks the Master Plan is considering that area for higher density use . LAND MARK CASE , OREGON Dan mentioned a land mark case , just decided in Oregon by the Supreme Court . It involved a land use question . The owner wanted to expand the size of his plumbing and electrical business . The munici - pality told him he would have to put in a bike path and something else ( relating to water ways ) . It was taken all the way to the Supreme • Court . Evidently it will have a major impact on all land use / planning d ecisions made in all townships across the Country . Dan had been following the case in the farm papers . Krys queried if it was the same case that had been mentioned in the construction trade journals . It was oriented toward the township making a condition of the expansion be , that the owner pay for all that stuff that had nothing to do with his business . It was the equivalent of the impact fees . The Town of Ithaca requires that you have 10 percent set aside for parks . Dan t hinks it goes beyond that as it got into land use / property owners rights . PREVIOUS MINUTES The minutes of June 20 , 1994 were approved unanimously . Krys made the motion for approval ; David seconded . IMPROVEMENTS TO THE ZONING ORDINANCE ® In Section lA of R1A ( Residence District ) item " b . " The word " could " will now be " can " . It will also state ( " up to " 10 % of the lot can be used for improvements . " ) In item " c " , Public library , . . . etc . , " higher learning including d ormitory accomodations . ( Up to 10 % of the lot can be used for improve - ments . ) ( Public museum will require a SPECIAL PERMIT , from BOARD OF ZONING APPEALS . ) " will be added . In item " d " , the Members added a period after accessory building , and the word " any " will be capitalized . In number " 2 . " , the Members added " contiguous Residential parcel . " after " any " and then deleted " residence " . In number " 3 " , " frequently " was deleted , and replaced with " at least weekly " . 1 31f TOWN OF ULYSSES 2 PLANNING BOARD MEETING JUNE 27 , 1994 TOWN HALL In item " 4 " , " birds " was deleted and replaced with " animals " , " or pasture , " was added after " open range " , and " a bird tight " was deleted and replaced by " an appropriate " . In number " 5 " , " Existing situations at the time of the enactment of this ordinance which do not conform to the above provisions must be brought into compliance within one year of the enactment of this ordinance . " was deleted . At this point the Members went back into R1 - A and Ri - B to add the following : yard setbacks shall apply to all Rl - A uses ( R1 - B ) as to 40 parking areas except for 1 or 2 family dwellings . Returning to item number " 5 " in Section lA of Residence Districts ( R1 - A ) , the words " application for " were deleted . The sentence should state : " Variations of the standards set forth herein shall require a SPECIAL PERMIT , from the BOARD OF ZONING APPEALS . " " Yard setbacks . . . " was deleted and moved to R1 - A and R1 - B . The Members moved on to " Section 2 ACCESSORY PERMITTED USES TN RESIDENCE DISTRICTS " . A new " a " was created , it is as follows : a . Accessory apartment in Sections R1 - A and Ri - B , with floor space limitation as set forth in the preamble of this ARTICLE ( ARTICLE IV ) . The previous item " a " was changed to " b " . The previous item " b " was changed to " c " . The previous item " c " is now " d " . The previous item " d " is now " e " , " BOARD OF ZONING APPEALS . " was added at the end . SECTION lA RESIDENCE DISTRICTS ( R1 - A ) " a . Dwelling " , the Members added " - Single family " . NOTE : The Members will return to SECTION 2 ACCESSORY PERMITTED USES IN RESIDENCE DISTRICTS at a later date to add " accessory building " , as only temporary buildings are mentioned now . The Members completed R2 and R3 and added them under SECTION 1B RESIDENCE DISTRICTS ( R1 - B ) , item d . They are as follows : R2 In any Residence District no land or building or part there of shall be used for other than any of the following purposes : a . Any use permitted under ARTICLE IV , SECTION lA and 18 SECTION 1 RESIDENCE DISTRICT ( R1 - A ) items a through k , except no SPECIAL PERMIT in c . , d . , and i . In R1 - B , items b . through d . , except no SPECIAL PERMIT in item d . R3 Everything in R2 , except lot coverage in SECTION 1A , b . and c . changes from 10 % to 25 % . In SECTION 1B , item c . , a SPECIAL PERMIT is no longer required . Golf driving range and miniture golf courses with SPECIAL PERMIT from BOARD OF ZONING APPEALS . ® The meeting adjourned at 9 : 20 PM . III
