Heights Cafe
I have received an application from the Heights' Caf6 to add outdoor seating to their restaurant
openation. The Village's Zoning Odinance requires that restaurants have a special permit,
which they already have, and a change in use requires the planning board to do a site plan
review to modify theirexisting special permit. Site plan review requires a public hearing, which
has been scheduled for 7:00 pm on the night of the Trustee meeting.
I have attached the sestion out of the zoning ordinance for guidance and copies of the
applicanfs submittal. Planning Board actions usually require consideration of environmental
issues as NYS SEQRA regulations. The applicanfs proposal is considered to be exempt
accoding to NYCRR 617.po<. Therefore, this project does not require the Planning Board to
prcvide any furher environmental review.
Therefore, if after the public hearing has been closed and the applicant has satisfied alUif any of
your concems, and you are prepared to approve the reques[ the Planning Board will need to
pass the following resolution:

CAFE
\Mtereas, the Village has received an application by the owner/opemtor of the Heights' Caf6 at
903 Hanshaw Road to add outdoor seating and service to their existing restaurant business
which cunenfly has a special permit approved by the Village, and
Whereas, the Village's Zoning Ordinance requires the Planning Board to perform a site plan
review for such a request within the Commercial Zoning District, and
\Mrereas, the Village has duly advertised and conducted a public hearing on the application,
and
Whereas, the Village has determined that the projec't is exempt from SEQM review according
to NYCRR 617.po<, and
\y't/hereas, the Planning Board has considered the potential impacts of this request and have
determine that there are no negative impads to the health, safety and general welfare of the
community, and now
Therefore, the Village of Cayuga Heights' Planning Board hereby approves the application by
the Heights' Cafe and authorizes the Zoning Officer to add outdoor seating/service to their list of
corditions on their cunent special permit.

e. The provisions for parking;
f. The relation of the size of the building and 1ot to the
parking area.
g. Traffic and noise g'enerated by the proposed use.
h. Landscaping.
i. Architectural feacures.
j. Location and dinrension of buildings.
k. rrnpact of the proposed use on adjacent land uses.

Effect on the environment.
Effect on infrastrucure and existing village semices,
including sewer, water, drainage and solid waste.
Any other reasonable factors that wirr promote the safety
of the proposed use and the orderly development of the
Multiple Housing or Comnercial District.
Effect on population density, if any.
Any other factors reasonably related to the hearth,
safety and general weLfare of the community.
2. Minor subdivision. Any land owner who intends to
subdivide land in a manner that qualifies as a rtminor subdivisionrl
as defined herein shall apply to the Planning Board for approval of

I would like to be able to serve icod and beverage wihin the outside courtyard behind the restaurant. I
have been granted permiss'ron by the landlord as well as approval from the State Liquor Authori$. We
estimate 8 tables with 4 chairs around each. lf you could please advise me on how to proceed wrth the
Viflage of Cayuga Heights approval it uould be greaty appreciated. We are anticipating a June 1,2OU
date once we have received your approval, Thank you.
