Dear Mr. Cassidy,
I am in receipt of your September 20,2018letter constituting an appeal of the Village of Cayuga Heights'
denial of two of your requests under FOIL, as detailed in your June 6, 2018 letter requesting information
and in the Village's August 24,2018letter in response.
With regard to the first point of your appeal, please find attached the Final Deer Management Report
dated April 9,20l8thatyou had requested, which identifiesthe capture locations of the deer. Please
accept the Village's apologies for not having delivered this Report in response to your FOIL request,
which omission resulted from a misunderstanding of your request.
With regard to the second point of your appeal, I disagree with your analysis. The Village's application
to the NYS DEC for an Amendment of the Village's Permit was quite certainly an inter-agency
communication from the Village to the DEC. The Village's application in no respect constituted a "final
policy determination." There was, and could not have been, a final determination in the act of making
an application for an approval required from another governmental agency. The "final policy
determination" in this matter was made by the DEC in its issuance of the Amendment. The fact that the
DEC granted the Amendment does not, as your letter proposes, convert the Village's application into a
"final determination." Only the DEC had the authority to make a final determination in this matter.
For the foregoing reasons, I am denying your appeal for this record.
