Dear Local Official:
In accordance with the provisions of Article 6 of the New York State Public Offrcers Law (the
New York Freedom of Information Law), and all other appropriate provisions of law, we request
that you provide a copy of all documents responsive to the below requests. To provide some
context for this request, I am enclosing a letter from Kevin Speicher, Chief, Pipeline Safety
Section, of the New York State Department of Public Service. As stated in the letter, it is
important that we obtain the requested materials as quickly as possible; therefore, we ask that
you provide the materials below on a rolling basis, as they become available, so as to avoid any
delay that may be associated with copying some of the larger items (such as oversized maps).
As set forth in the enclosed letter from Mr. Speicher, we have been tasked with identifying the
age of the sewer and water infrastructure within your jurisdiction. Consequently, we ask that
you produce the following, whether in your possession, custody, or control (including within the
possession, custody, or control of any Water Board, Water District, Sewer Board, or Sewer
District, or similar entity):
o All Documents concerning or describing the date of installation of all sewer andlor water
mains located within your organization's jurisdiction;
o All Documents concerning or describing any maintenance or repair work (including any
relining) on any sewer and/or water main located within your organization's jurisdiction;
. All maps, whether maintained electronically or in hard copy, depicting the locations of
sewer andlor water mains located within your organization's jurisdiction; and
o To the extent'not requested above, all engineering studies concerning the planning and/or
construction of the sewer andlor water systems within your organization's jurisdiction.
For purposes of the above requests, the term "Documents" includes, but is not limited to, the
original of any method of communicating information, including writings or recordings of any

nature whatsoever, whether typewritten, handwritten, printed or recorded, or reproduced by any
mechanical or electronic process, including, but not limited to the following: notes;
correspondence; memoranda; books; records; reports and summaries of records and
conversations, telephone calls, interviews and investigations; charts; graphs; calendars; diaries;
minutes and records of meetings and conferences; opinions and reports; working papers;
receipts; financial statements and records; information contained in any computer, video, audio,
magnetic or other mechanical device or machine, whether or not printed out and all drafts and
non-identical copies thereof; e-mail messages and electronic information backed up from
software systems, whether on tape, disk, or other format; photographs, drawings, and/or sound or
videotape recordings.
We understand that there may be statutory fees involved in this request. If for any reason any
portion of this request is denied, please provide, in writing, the reasons for the denial and the
name and address of the person or body to whom an appeal of your determination should be
directed.
