A zoning permit application to replace an existing poolfence with a new 6'fence at the above
referenced property has been denied. The fence is located within 2.5' of the property line in
back of the house (that has frontage on Devon Road), which is less than the minimum 25'
required by the Village of Cayuga Heights Zoning Ordinance Section 6: Setbacks. The owner is
seeking a variance to allow the reduced front yard. Therefore a public hearing has been
scheduled for 8:15 pm on June 22nd , 2016 at Marcham Hall, 836 Hanshaw Road.
It should also be noted there is an existing poolhouse (associated with the fence) that is at
approximately 15' setback from the same property line. According to the Tompkins County
Assessment records, the pool and poolhouse were installed in 1960, which was after the
establishment of the current zoning regulations. Although this project does not propose to
change the poolhouse, the ZBA should consider granting of an area variance to allow the
poolhouse to remain.
